The above referenced subdivision was created by map November 3, 1913 (Book 7 of Maps, Page 27). Lots range from 10-15 acres in size. On March 5, 1993, the owners of the property requested review of these lots for compliance with the County Subdivision Ordinance. Applications for Determination were filed for all the lots in the subdivision. Subsequently, after meeting this Department's conditions which included the determination of required usable area for sewage disposal and provision of drinking water, Certificates of Compliance were issued on certain subdivision lots. Some of the lots were merged with portions of adjacent lots and reconfigured through the Certificate process. The zoning is AG-20, which is Agriculture, 20 Acre Minimum Parcel Sizes. The 10-acre properties cannot be subdivided any further. The Agricultural zone allows commercial agricultural activities, and allows one residence, along with an Accessory Dwelling Unit. Development would be subject to review by the Agricultural Commissioner for compliance with the Agricultural Buffer from adjacent agricultural properties. Water for the referenced parcels is proposed from individual domestic wells. Under current code, our Division requires adequate proof that a well can be drilled that is capable of producing a minimum of one gallon per minute. It may be necessary to actually drill the well in order to provide this proof of adequacy. At this time, our Division is not aware of any other regulatory, policy or site constraints that would preclude approval of an individual drinking water well permit upon submission of an application, a satisfactory plot plan, and verification that an adequate supply of potable water can be provided. To date, one parcel# 042-010-013 has finaled a large diameter irrigation well, permit# EHWL 17-0004 on 04/16/2018, and one parcel #042-010-116 has finaled a domestic drinking water well, permit #EHWS15-0174 on 06/02/2016. Sewage Disposal for the referenced parcels will be by individual septic tank systems. At this time, our Division is not aware of any other regulatory, policy or site constraints that would preclude approval of a septic permit upon submission of an application and a satisfactory plot plan.
