Smet Eagle Creek Renewable Energy, LLC 7315 Wisconsin Ave , Suite 1100W Bethesda, Maryland 20814 Subject: Water Quality Certification Status for the Kanaka Hydroelectric Project Dear Ms. Smet: This regards our pending review of a surrender application filed by STS Hydropower, LLC (STS or licensee), on September 30, 2022, for the Kanaka
Hydroelectric Project No. 7242. The project is located on private property on Sucker
Run Creek, a tributary of the South Fork Feather River, in Butte County, California, near
the town of Feather Falls. Supplements to the surrender application were filed on February 28, and April 28,
2023. In the February 28 supplement, STS informed the Commission that a notice of
intent to submit a water quality certification (certification) application was provided to
the California State Water Resources Control Board (California SWRCB) on
December 7, 2022. On May 12, 2023, STS submitted a certification application to the
California SWRCB. By letter to STS dated May 26, 2023, the California SWRCB
indicated the application was complete and the expected reasonable time period for action
on the application was May 12, 2024. In a letter to STS dated April 23, 2024, the California SWRCB denied , without
prejudice, STS’s request for certification. The California SWRCB advised STS to submit
a new request for certification after adequately addressing Cal ifornia SWRCB’s concerns and additional information request. These concerns primarily relate to an October 11,
2023 site visit, in which California SWRCB staff observed the inadvertent diversion of

Project No. 7242-060 - 2 - flows from Sucker Run Creek into the project’s penstock.1 Breaks along the above
ground portion of the penstock resulted in this water being discharged to nearby
hillslopes. In order to proceed with review of the surrender application, Commission staff
requests that you file, within 90 days of the date of this letter (i.e., by July 25, 2024), your
appeal of the April 23 denial or a new certification request with the California SWRCB. The Commission strongly encourages electronic filing. Please file comments,
motions to intervene, and protests using the Commission’s eFiling system
