Project Overview
The Northern Circle Indian Housing Authority (NCIHA, Applicant ) proposes to develop a grant-funded,
multi-phase housing development, the Maidu Mountain Lion Housing Development, to provide
housing for the Berry Creek Rancheria of Tyme Maidu Indians of California (Tribe) on the approximately
7.76-acre parcel identified by Assessor’s Parcel Number (APN): 068-341-010 located at 4001 Hildale
Ave, Oroville, California (Site), directly adjacent to land held in trust for the Tribe.
The Site is fee land within the jurisdiction of the County of Butte (County) and has a land use designation
of Medium Density Residential (MDR) per the Butte County General Plan 2040 and a zoning designation
of MDR. In order to develop the Site with 22 new residential units, the Applicant requests a General
Plan Amendment and Rezone to change the land use and zoning designations of the Site to Planned
Unit Development (PUD) and Planned Development (PD), respectively. Additionally, the Applicant
proposes a 2-lot Minor Subdivision to facilitate two (2) phases of development at the Site, each with
potentially distinct income restrictions on the housing, depending on the funding source. The Applicant
understands that additional development in the future would require a subsequent Planned
Development application.
Purpose and Need
The Tribe faces a critical housing shortage, particularly for its elderly population. Many Tribal members
struggle to find suitable alternatives due to a combination of factors, including aging infrastructure,
limited accessibility, and rising housing costs. According to the Annual Formula Response form for fiscal
year 2025 issued by the U.S. Department of Housing and Urban Development (HUD), the Tribe has a
housing shortage of 310 homes, which equates to approximately 45 percent of the Tribe’s membership.
The Tribe seeks to develop the project for Tribal members experiencing homelessness and elders
currently living in overcrowded conditions.
The NCIHA is a Tribally Designated Housing Entity (THDE) that works on behalf of 8 Federally Recognized
Tribes, including the Tribe, to administer affordable housing programs, projects, services, and
community development opportunities. The NCIHA seeks to improve the overall quality of life for Tribal
members and contribute to the long-term strength and resilience of the community by addressing the
housing needs of the Tribe.
Project Setting and Location
The Site is located east of the city limits of Oroville, within the Oroville Sphere of Influence (SOI) in
unincorporated Butte County, California, southeast of the intersection of California State Route 162
(SR-162) and Arbol Avenue, and southwest of the intersection of SR-162 and Oakvale Avenue. The Site
is owned by the Tribe. Surrounding land uses adjacent to the Site include Tribal trust land to the north

and scattered single-family residential development to the west, south, and east. The Site is bordered
to the south by Hildale Avenue.
The Site is relatively flat and is characterized by mixed oak woodland generally around the periphery.
An approximately 3,550 square feet (sf) single-family residence, approximately 1,421 sf garage, and
driveway from Hildale Avenue are concentrated in the southwest portion of the Site. The remainder of
the Site contains unimproved trails, trees, and low-growing vegetation.
Project Description
As discussed above, the proposed project would change the land use designation of the Site from
MDR to PUD and zoning designation from MDR to PD through a GPA and Rezone, respectively, and
subdivide the Site into two (2) parcels to allow for the development of multi-family housing over two
(2) phases with distinct income restrictions for each phase. Phase 1 is proposed to include the
development of 12 new single family residences and associated infrastructure, and internal access
roads on an approximately 4.5-acre parcel. The 12 residences would be constructed on the west and
east side of proposed Road A and each residence would include a garage and driveway. Fencing
would be installed around each residence to provide individual yards. Front yard fencing would be 4-
foot-tall black vinyl chain link, while side and rear yard fencing would be 6-foot-tall cyclone fencing
with privacy slats. The proposed fencing would be consistent with the existing Tribal housing northeast
of the Site. Phase 2 is proposed to include the development of 10 accessible homes for Tribal elders
and associated infrastructure on an approximately 2.8-acre parcel. The units would be developed in
5, 2-unit clusters with parking for each cluster. Phase 2 would be constructed along a short road with a
cul-de-sac. The existing residence and shop would be demolished.
Primary access to the Site would be via a gated entry on Hildale Avenue, with secondary gated access
from the Tribal trust land to the north. The secondary access to the north is intended to connect to
future roadways on the Tribal trust land, if/when developed in the future in order to provide future
residents of the Site with pedestrian and vehicular access to the Tribal trust land. Internal access roads
would be designed in accordance with Butte County private road standards and in consideration of
City of Oroville private road standards, as necessary. The gated entrances would include 6-foot-tall,
powered metal gates.
The Site is within the service area of the Lake Oroville Area Public Utility District (LOAPUD) for wastewater
services, South Feather Water & Power Agency (SFWPA) for water services, and Pacific Gas & Electric
(PG&E) for electric services. The proposed project would be served by these utility providers via
connection to existing infrastructure in the vicinity of the Site and on-site utility lines would be installed
within the proposed access roads to the extent feasible. Recology provides solid waste collection
services in the area and would serve future residents of the Site. The Site would be graded to convey
surface drainage to a proposed bioretention/Low Impact Development (LID) area at the southeast
corner of the Site. This bioretention area would outfall to an existing drainage ditch that conveys off-
site stormwater.
Phases 1 and 2 would be funded by a combination of funding sources including 2023 Homekey Tribal
Program administered by the California Department of Housing and Community Development (HCD),
the Indian Housing Block Grant (IHBG) Competitive Grant Program though HUD, and the Tribal
Homeless Housing Assistance and Prevention Program (Tribal HHAP) administered by HCD. As the Tribe’s

TDHE, the NCIHA seeks to develop, own, and operate the project on behalf of the Tribe. The Tribe
intends to convert this land to Trust in the future.
Construction Overview
Construction activities would generally include site cleanup, demolition activities, grading, site
preparation (including vegetation removal), building installation, road construction, and utility
trenching. Construction of the project would require clearing and grubbing of low-growing vegetation
such as grasses and shrubs and removal of trees within the footprints of the proposed access roads and
residential structures. Construction is anticipated to occur over approximately 15 to 18 months.
During construction, Best Management Practices (BMPs) would be implemented in accordance with
a Stormwater Pollution Prevention Plan (SWPPP) to be prepared for the project pursuant to the General
Permit for Storm Water Discharges Associated with Construction and Land Disturbance Activities (CGP),
administered through the State Water Resources Control Board (SWRCB). Compliance with the CGP
and a project-specific SWPPP would help to prevent the discharge of construction waste, debris, and
contaminants from construction materials, tools, and equipment from leaving the Site.
The following list of equipment and machinery that may be utilized for construction of the project is not
an all-inclusive list. This list exemplifies typical machinery and equipment used for similar projects; exact
equipment types and methods are at contractor’s discretion.
• Front-end loader and dump truck (or other earthmoving equipment): Used together for
loading and hauling earth, rock, and asphalt.
• Grader, scraper, excavator, transfer unit.
• Angle-blade bulldozer: Used for small and medium jobs where cuts and fills average less than
5 feet and a small amount of rock will be moved.
• Clinometer or Abney level: Inexpensive handheld tools used to measure road grade.
• Survey equipment, survey flags, colored plastic tape, or stakes: Used to mark the proposed
route and location of culverts, dips, edges of cut/fill slopes, etc.
• Ax, brush hook, chainsaw, and additional handheld or gas-powered tools: Used to drive stakes
and to cut dense vegetation.
Proposed Setbacks
The following minimum setbacks are proposed for the project. Due to the nature of the Site, street side
setbacks are not applicable.
