Subject: Status Report and Notification of Change in Schedule for Sandy Beach
recreation improvements – Article 404
Dear Ms. Walther:
On October 16, 2024, you filed a status update report and notified the Commission
regarding a change in the schedule to complete recreation improvements at the Sandy
Beach recreation site at the Poe Hydroelectric Project No. 2107.1 The recreation
improvements are a requirement of the approved Recreation Management Plan pursuant
to Article 404 of the license,2 State Water Resources Control Board’s section 401 water
quality certification condition 8, and U.S. Forest Service (Forest Service) condition 26.
Ordering paragraph (D) of the 2022 Order requires you to file annual status reports
providing an updated schedule for the Sandy Beach recreation improvements until the
improvements are constructed and the documentation of completion report has been filed,
due to the ongoing Highway 70 right-of-way coordination with the California
Department of Transportation (Caltrans) and consultation requirements with the Forest
Service.

Your letter states you submitted design drawings to the Forest Service at the 30%,
60%, 90%, and 100% design stages. Forest Service had no comment on the 30% and
60% design drawing; however, they provided comment on the 90% design drawings.
You addressed these comments in the 100% submittal on October 4, 2023. You followed
up with the Forest Service regarding the Sandy Beach recreation improvements on
March 26, 2024, May 9, 2024, June 6, 2024, and October 10, 2024, however you have yet
to receive concurrence from the Forest Service on the 100% design drawings. You
indicate you will file the concurrence with the Commission once it is received. Your
filing includes documentation of consultation with the Forest Service.
You also indicate implementation and maintenance of road and parking
improvements are dependent upon the results of consultation with Caltrans, and that
discussions with Caltrans are ongoing. You will file the results of your consultation with
Caltrans once it is complete.
At this time, due to delays in receiving concurrence from the Forest Service and a
feasibility determination from Caltrans, you have updated the construction schedule to
September 1, 2025, through November 30, 2025. Please continue to keep the
Commission informed regarding future changes to the construction schedule for the
Sandy Beach recreation improvements. Once you have completed construction for all
improvements, you are reminded you must file a report documenting completion of the
improvements as required by ordering paragraph (C) of the2022 Order.
