Basis for Intervening:
The Pacific Gas and Electric Company (licensee) requests a temporary
reduction in minimum instream flow below Poe Dam down to 100 cubic feet per
second, as measured at compliance point NF-23 (United States Geological
Survey gage 11404500), from June 1 until November 15, 2025, to facilitate
recoating and replacing the seals of the Poe Bypass radial gate. While work
on the radial gate is being performed, minimum instream flows will be
released through an existing 36-inch pipe during the variance period, at its
opportunities, the licensee proposes a make-up schedule of November 15 & 16,
and November 22, & 23, 2025, of similar boating flows, if the variance is
approved. In addition, the licensee also requests to postpone monitoring
activities performed under the Poe Tributary Access Monitoring Plan, if 2025
is determined to be a dry or critically dry water year type.
Pursuant to Rule 214 of the Federal Energy Regulatory Commission's Rules of
Practice and Procedure, 18 C.F.R. §385.214, the California Department of
Fish and Wildlife (CDFW) files this notice of intervention in this
consultation pursuant to the Federal Power Act Section 10(j). (16 USC
