Reese: The following is a list of why this is a VERY bad idea. PG&E wants to shut off all water down the Centerville Canal permanently. This Canal has served the people of Nimshew Rd long before PG&E took over. Background: Prior to PG&E moving in, there was the Cherokee/Centerville Canal. PG&E put their reservoir in and Cherokee became the Butte Canal and below remained the Centerville Canal. 1 By lowering the cfs that low in these locations it will cause irrevocable damage to our lives and property. If nothing else, the cfs needs to be raised significantly. Better still if they are going to not use the hydo plants just tear down the dam. 2 Several years ago there was damage to the Butte Canal which is one of our water sources. The main one actually. I believe FERC told them to repair it ASAP. They have not. We were recently told that they will NOT be making the necessary repairs for us to get our water. Because of this decision, those of us with water rights have barely received any water at all. OUR WELL IS CURRENTLY FALTERING AS OF 5-27-25, ti 3 For years, PG&E has said we only get Butte Canal water. This was proven false with their own documentation. If needed I can supply a copy. We feel that is why PG&E has refused to repair the Butte Canal. 4 In September 25, 2012, Governor Edmund G. Brown Jr. signed Assembly Bill (AB) 685, making California the first state in the nation to legislatively recognize the human right to water. One of the only good things he did for California.) This landmark legislation is now codified in the Water Code as Section 106.3. It explicitly states that "every human being has the right to safe, clean, affordable, and accessible water adequate for human consumption, cooking and sanitary purposes." This right extends to all Californians, including disadvantaged individuals and communities in both rural and urban areas. It underscores the importance of providing universal access to clean water, regardless of socioeconomic status or geographic location. This legislation has been pivotal in addressing water equity and emphasizing the human impact of unsafe water in the state. Additionally, it's worth noting that Governor Brown also took further steps to address water conservation. In 2018, he signed two bills, SB 606 and AB 1668, which require cities, water districts, and large agricultural water districts to set strict annual water budgets. These entities potentially face fines of $1,000 per day if they fail to meet these water conservation targets, and during drought emergencies, the fines can escalate to $10,000 per day. Without the water flowing down the Canal our wells are not fed 5 I feel we have been in a battle with PG&E since 2015 for our water rights. That year, during our drought, PG&E had our canal shut off June, July and August. I lost my orchard, expensive trees, my yard. We have 12 acres, 5 of which we maintain. We had no water at all for the whole summer. PG&E provided no water that year. No water to drink, wash, clean or flush the toilets. No fire protections We have no hydrants down the entire street. The last hydrant is 2 miles above our home. 6 I continue to be a victim of PG&E's poor leadership and hateful„ callous, corrupt and selfish treatments. 7 PG&E continues to prove that PG&E doesn't care about its customers as people only that we are their cash cow. Considering PG&E is asking Congress and claiming the need of a 6th bill rate hike this year. So we are paying for PG&E's criminal mistakes, not PG&E. 8 PG&E refuses to repair and maintain the Butte Canal (Cherokee/Centerville Canal) This is a Canal they say they own, but didn't build. This canal was built in the 1800's for the miners and the populations of Nimshew and Irish Town. This is the water for the Centerville Canal. So this is a direct act of terrorism against the people of Nimshew Rd. 9 At a recent meeting, it was revealed that Butte Creek has two hydro plants, that - receive water from the Butte Canal and the Centerville Canal, are currently shut down. I was told these plants are able to run. For some reason they have been shut down on purpose. I would think that this act falsely creates high energy costs for the lack of electricity for the people of Butte County and California. 10 No water has flowed past the last diversion box, unless we have rain, in the last two years. 11 Wells no longer being fed by our canal. 12 PG&E has killed more trees and landscape on my land than I can count, every time PG&E shuts down our canal. After every shut down we try to restore what they have killed. During the last two year halt we have lost 2 more Japanese maples and a large pine. All we have to have removed, again on our own dime. We can't afford to keep doing this. 13 Theft of water rights to those of us with water rights, especially my address and beyond. So, PG&E plans on killing off more of our orchards and yards 15 Is some of our extra bill increase monies going to politicians and their 80 or so VP's. Yes, I recently found out that over the years PG&E went from 8 VPs, which was a lot, to 80 VPs. This is ridiculous and makes PG&E a financially top heavy business. 16 By continualing to shut down our canal for long periods of time, then doing a restart, our irrigation systems get full of mud when the water reaches just our diversion boxes. This too, is costly to us. 17 PG&E expects all of us to build a new wells. Most of us are senior citizens. we personally, put in a second well after 2015, thanks to PG&E. We were living in a third world county in America because of PG&E did not supply water to any of us at that time. We went down as far as we could afford and that appears to still be not enough. 18 PG&E expects us to believe they are working with Del Oro Water, a company that controls the water in our area. PG&E claims that repairing the Canal will cost millions. We already begged Del Oro Water to extend their lines down the rest of the way on our road. They said that would cost millions. 19 Should this happen, we wouldn't be able to connect to it, We personally live over 600 feet from where that line would be installed on the main road. Here, people have to pay to connect to their line. We already know that this water company failed everyone during the Camp Fire. No generator back up. Plus, it continues to have problems with the line already down Nimshew. It requires work on it all the time. Their line stops 2 miles above my home. So, we who have free water, virtue of our water rights, will then be forced to pay for our water. The ONLY good thing about this idea is that there will be fire hydrants and our insurance will go down. 20 Our canal was here before PG&E. the water in the reservoir ran free to us for years until they put a shut off valve on it, that steals our water rights, just prior to our 2015 incident. Go figure. 21 We have a right to our water rights. There are right holders past the last distribution box that for years do not get water to support their wells. 22 This action by PG&E makes us no longer safe from fire, as our canal saved our homes during the 2018 Camp Fire, caused by PG&E. 23 PG&E continues to infringe on our Fifth and Fourteenth Amendments of the Constitution. The Fifth Amendment ensures no one shall be deprived of property without due process of law, and the Fourteenth Amendment which protects citizens from the deprivation of life, liberty or property without due process of law. 24 Certain bureaucratic measures and oversight by PG&E has led to restrictions on the rights of the citizens of Nimshew Rd., and private entities to fully utilize their riparian rights, especially when our water sources are adjacent to or cross our lands. PG&E has caused undue interference in our ability to develop, irrigate, and utilize our lands due to excessive control by PG&E. They have allowed, over the years, people who do not own water rights to take it. During the previous shut off, it took 3 months before we received water into the distribution box. That is on them. By the way, as for the maintenance part, PG&E has only stepped foot on our property twice, since 2002 to do any maintenance. They say now, that they don't do maintenance. This is funny as when we purchased our home we had to sign a document that allowed them an easement to come on our property to do maintenance. 26 By the way, the PG&E commercials are nothing but a slap in the face of those of us who have faced loss of either friends and/or property. Those of us with a brain, know that we, of course, are the ones paying for their commercials. 27 Should they completely shut off our canal forever, who will be responsible for filling in the canal in, which, when that happens, the Canal will become a hazard to people and animals? IT WILL NOT BE US. Perhaps you can encourage DOGE to investigate PG&E. PG&E is most definitely not a company that is concerned about the welfare of its customers. They continue to lie and make lame excuses for their actions. They refuse to respond to calls or emails. They are not running the hydro plants, so they think they can shut off water to all of us down Nimshew Rd. They think we are stupid hicks. We are not. I'm just tired of being an abused senior citizen.
