C. 20426 OFFICE OF ENERGY PROJECTS Project No. 2107-067, -068, -069 ---California Poe Hydroelectric Project Pacific Gas and Electric Company August 13, 2025 VIA FERC Service Stephanie Maggard, Director Pacific Gas and Electric Company 300 Lakeside Drive Oakland, CA 94612 Subject: Request for Additional Information - 2025 Amendment Requests and Biological Monitoring Plan Revisions Dear Mrs. Maggard: This is in response to your amendment requests, filed with the Federal Energy Regulatory Commission on June 2, 2025, for the Poe Hydroelectric Project No. 2107.1 The project is located on the North Fork Feather River in Butte County, California. You request to amend Section 401 Water Quality Certification (WQC) condition 1 and U.S. Forest Service Section 4(e) condition 23 to permit you to temporarily modify minimum instreams flows to perform maintenance or repairs on Poe dam, outlet facilities, and release facilities, when needed, and with agreement from the resource agencies. You also request to amend WQC condition 9 to reflect a process that can incorporate past and future revisions in certain biological monitoring plans by referencing the approved plans instead of repeatedly updating the text of condition 9 when revisions occur. One such requested revision is to the Poe Amphibian Monitoring Plan, to change the start of yearly foothill yellow-legged frog monitoring from being based on a water temperature trigger to being set to April 15 each year, until temperature data indicates breeding may be starting earlier. Another such plan revision is proposed for the Poe 1 Order Issuing New License (165 FERC ¶ 62,172), issued December 17, 2018. Document Accession #: 20250813-3027 Filed Date: 08/13/2025 Project No. 2107-067, -068, -069 - 2 - Bypass Reach Fish and Benthic Macroinvertebrate Monitoring Plan, to update the plan to incorporate that an additional year of monitoring has occurred, and to reflect schedule changes that have required alteration of future monitoring years. Commission staff have reviewed your June 2, 2025, request and, in order to continue our review, we are requesting the following additional information: 1. Please request to be designated as a non-federal representative for Endangered Species Act section 7 consultation regarding your requests, where required, and provide us a biological evaluation/assessment for our review as appropriate. A review conducted on the U.S. Fish and Wildlife (FWS)‘s website, Information of Planning and Consultation (IPAC), indicates that several federally listed species may be present in the area affected by your request. IPAC included the following aquatic species that occur in the affected area and should be included in consultation with FWS; threatened California red-legged frog and foothill yellow-legged frog, proposed to be listed northwestern pond turtle, and the proposed critical habitat of foothill yellow-legged frog. 2. Please provide documentation of coordination and agreement with the Forest Service and California SWRCB regarding the proposed amendments and plan changes. This requirement is described by paragraph 8 in both the Poe Bypass Reach Fish and Benthic Macroinvertebrate Monitoring Plan 2 and the Amphibian Monitoring Plan 3 orders, and agency agreement is required prior to filing revised plans with the Commission for approval. This documentation will need to be filed on the record before the Commission can further consider approving the updated plans or amending their conditions. 3. Previously, on December 7, 2023 and supplemented on February 28, 2024, you requested to revise your Amphibian Monitoring Plan in substantially similar ways as your current June 2, 2025 request. As this most recent filing appears to be a repeat of your previous request, please consider this notification that we are dismissing your previous request under subdocket P-2107-062 as moot, so that the most current version of the plan is considered for our review. 2 Order Approving Bypass Reach Fish and Benthic Macroinvertebrate Monitoring Plan Pursuant to Article 401 (171 FERC ¶ 62,050), issued April 16, 2020. 3 Order Approving Amphibian Monitoring Plan Pursuant to Article 401 (173 FERC ¶ 62,100), issued November 24, 2020.
