On July 16, 2025, Commission staff notified the Environmental Protection Agency
(EPA), via EPA’s online portal, that a water quality certification has been received for the
pending surrender application for the Kanaka Hydroelectric Project No. 7242. On
August 15, 2025, EPA provided its response.
A copy of the EPA’s email is attached.

Pursuant to 40 CFR 121.12(b), EPA reviewed the proposed Kanaka Project Surrender project,
and has determined that there is not likely to be an adverse effect on neighboring jurisdiction
water quality, based on the location of the project, the type of project, the associated
discharges and 401 certification conditions.
