Existing parcel sizes are 3.99 acres (Parcel A) and 2.57 acres (Parcel B). The project proposes to transfer .01 acre from Parcel B to Parcel A, resulting in parcels with sizes of 4.0 acres (Parcel A) and 2.56 acres (Parcel B). Parent Parcel APN Acres Before LLA Acres After LLA Parcel A 017-160-021 3.99 4.0 Parcel B 017-160-005 2.57 2.56 •The project site is at 2262 and 2298 Honey Run Road, approximately 1.5 miles northeast of Centerville Road, in the Butte Creek Canyon area east of the City of Chico. •The subject parcels are zoned FR20-BCC (Foothill Residential, 20-acre minimum parcel size- Butte Creek Canyon Overlay). Both parcels have a land use designation of Foothill Residential in the Butte County General Plan. •Surrounding parcels are zoned FR20-BCC and largely consist of single-family residential uses. MEMORANDUM August 20, 2025 • The existing parcel sizes of both parcels do not conform to the zoning’s minimum parcel size requirement. • Parcels A and B each feature a single-family residence and accessory structures. An accessory structure (shed) on Parcel A is positioned along the shared interior-side property line of Parcel B, with part of the structure currently extending onto the neighboring parcel. • The minimum interior side yard setback for the zone district is 10 feet. The proposed property line adjustment would place the entire structure on Parcel A with a 10-foot setback. Analysis • The project would not result in the creation of any new parcels. • The Butte County Public Works Department verified that both parcels were created in conformance with the Subdivision Map Act and local regulations. • Resultant parcels will retain frontages off Honey Run Road, a County road. • Existing Parcel B is non-conforming with the zoning’s minimum parcel size requirement of 20 acres. An exception to reducing the minimum parcel size is permitted under Butte County Code section 24-032.A.1., which allows a non-conforming parcel's size to be reduced by no more than ten percent or ten acres, whichever is less. Parcel B will be reduced by approximately 0.004 percent. • The Land Development Division of Public Works, Environmental Health Division of Public Health, and Butte Fire reviewed the project. None of the agencies objected to the proposed project, subject to the conditions of approval noted in Exhibit A below. CEQA Issues This project is exempt from the California Environmental Quality Act (CEQA) requirements under Categorical Exemption Section 15305(a). ACTIONS FOR CONSIDERATION: Staff recommends that the Director of Development Services take the following action: I. Find that the project is exempt from environmental review under Section 15305(a) of the California Environmental Quality Act (CEQA). A Class 5 exception consists of minor alterations in land use limitations in areas with an average slope of less than 20%, which do not result in any changes in land use or density, including but not limited to minor lot line adjustments, side yard, and setback variances not resulting in the creation of any new parcel. II. Approve the Lot Line Adjustment for Town Surveys Inc., APNs: 017-160-005 & 017-160-021; Project # LLA25-0008, subject to the Conditions of Approval in Exhibit A: III. Find that the proposed adjustment is consistent with Butte County Code Section 24-302.A (Exceptions for minimum parcel size) because the resulting size of Parcel B is not reduced by more than 10 percent. EXHIBIT A CONDITIONS OF APPROVAL Town Surveys Inc, Lot Line Adjustment LLA25-0008 APNs: 017-160-005 & 017-160-021 Public Works 1. Deeds and plats (if required) with the appropriate checking fee shall be submitted to the Department of Public Works, Land Development Division for checking and approval prior to recordation and shall contain the notes specified below. 2. Provide documentation from a title company of the applicant's choice verifying that any deed of trust affected has been partially re-conveyed or modified to reflect the lot line adjustment and to prevent the creation of any additional lot or parcel. 3. Prior to recordation of deeds, provide documentation verifying payment of taxes as required by Subsection (d)(4)a. of Section 20-95.1 of the Butte County Code and as specified in Article 8 of Chapter 4 of Division 2 of Title 7 of the Government Code, commencing with Section 66492. 4. Prepare a plat showing approved Lot Line Adjustment. 5. Record plat with deeds if one or more of original lots or parcels was created by map. If a record of survey is prepared to show the lot line adjustment, recording of a plat is not required. Deed Note (To be placed on any deed to effect lot line adjustment) The purpose of this deed is to effect a lot line adjustment as approved by the Butte County Director of Development Services on ______________________. The above described lands are to be combined with and become a part of those lands as described in the deed to ________________________________ as filed for record in Butte County Official Records at Serial Number _____________ Book _____________ Page ___________. No additional lots or parcels are created hereby. The scope of review of said lot line adjustment was limited as specified in Government Code Section 66412(d), and approval of it does not constitute assurance that future applications for building permits or other land use entitlements on the modified lots or parcels will be approved by the County of Butte.
