PREAMBLE
1.
THIS AGREEMENT concerns Wildland Fire Services and is made and entered into as of
April 1, 1998 by and between the United States Department of the Interior, acting Y b and
through the Bureau of Indian Affairs, Sacramento Area ice, hereinafter called Bureau and
the State of California, through its Director of the Department of Forestry and Fire
Protection, hereinafter called State.
RECITALS
2.
The Bureau desires the State to provide Wildland Fire Suppression, Repair f Suppression

Activity Damage, Preliminary Fire Investigation and appropriate law enforcement .activities

under Public Law 2802 herein atter referred to as Wildland Fire Services on Indian Trust
Lands located within or adjacent to State Responsibility Area (SRA) and other federal agency
lands where the State provides direct wildland fire protection. Indian Trust LandsP rotected
by the State shall herein atter be called State Protected Indian Trust Lands.
3.
Public Resources Code Section 4127 provides that any lands owned or controlled by the
Federal Government, or any agency of the Federal Government, may not be classified as art

of the SRA regardless of location.

The Federal Government retains the primary financial responsibility revention and
P tY of P
suppression of wildland fires on Federally -controlled lands including those which happen to be
surrounded by the SRA, and also including those held in trust by the United States for the
Indians of California. These lands held in trust for the Indians of California shall be referred to
as Indian Trust Lands.
5.
Both the Bureau and State agree that effective Wildland Fire Services is essential to the
watershed areas of both Indian Trust Lands and the SRA lands.
6.
The State maintains and operates an effective fire protection organization with readily
available capability for both fire prevention and initial attack fire suppression throughout

much of the watershed and range lands of California.
7.
Public Resources Code Section 4141 authorizes State to "enter into gr'

with the Federal Government for the prevention and suppression of forest fires in any timber,
brush, grass, or other flammable vegetation'
8.
Public Law 93 -63 8, as amended, allows Indian Tribes to legally contract or compact Fire
Management Programs currently being conducted , by the Bureau. Fire management personnel

of Tribes that have contracted/compacted the Bureau Fire Management Program must meet
National Wildfire Coordinating Group qualifications standards and are considered to be
Bureau firefighting resources when performing wildland fire suppression act'* ies.:For the

owned vehicles and equipment, and qualified Bureau and Tribal fire fighters. The training and
qualifications records of Tribal fire fighters who are used as emergency fire fighters are
recorded by the Bureau. For the purposes of this agreement, Tribes which have elected to
compact or contract a Bureau wildland fire program will be considered the same as the
Bureau and are delineated in Appendix D. Indian Trust Lands protected by the Bureau shall
be known as Bureau Protected Indian Trust Lands.
9. The Bureau has entered into a cooperative agreement with the Southern California Indian
Natural Resources Consortium (SCINRQ that allows the Bureau to reimburse member Tnbes
for fire suppression expenses. The training and qualifications records of Tribal fire fighters
who are used as emergency fire fighters under the SCINRC agreement are recorded by the
Bureau. Each fire fighter must meet National Wildfire Coordination Group qualification
' standards and is considered to be a Bureau fire fighting resource when performing wildland
fire suppression activities.
10. Under authority of the act of September 28, 1922 (42 Stat. 857, 16 U.S.C. 594) and the
delegations of authority set forth in Secretarial Order 2583, Section 16 (c) dated January 11
1949, and Section 232 of the Commissioner's Order No. 551, Amendment No. 2 dated July
251P 1951, the Area Director of Bureau may negotiate and execute cooperative fire suppression
agreements for the protection of Indian Trust Lands and resources.
11. Words and phrases used herein may have different meanings or interpretations for different
readers. To reach a common understanding, such words and phrases are included in a
Glossary attached hereto as EXhHBIT A. The first time a word or phrase contained in the
Glossary is used in the agreement or an exhibit, it will appear in italics.
NOW THEREFORE, in consideration of the mutual promises and considerations herein made, it is

STATE PROTECTED INDIAN TRUST LANDS
12. Wildland Fire Services
The State shall provide wildland fire services on Indian Trust Land which are located '

or adjacent to SRA lands and other federal agency lands where the State provides direct

wildland fire protection by agreement. The State shall utilize local Bureau fire fighting
resources, where available, on wildland fires occurring on State Protected Indian Trust
Lands. The use of any Bureau fire fighting resources b the State for fires on State Prot

Indian Trust Lands will be at no cost to the State.
The use of local Bureau fire fighting resources by the State for wildland fires on State
Protected Non -Indian Lands will be in accordance with Sections 23 Two o

13. Location of State Protected Indian Trust Lands
The Bureau shall furnish the State with maps showing the location of all Indian Trust Lands in
California to be protected by State. The location of Indian Trust Lands shall be documented
on official maps maintained by the State and Bureau.
The Bureau shall notify the State by April l each year of any changes in the protection status
of Indian Trust Lands to be protected by the State and the acreage in each county to be
protected by the State. Whenever the State finds that it can no longer provide wildland fire
protection services to State Protected Indian Trust Lands covered by this agreement, it will
provide Bureau with one year written notice.
14. State Protected Indian Trust Lands ODeratin, Plans
The appropriate State Ranger Unit and each Bureau Agency Office and Tribe that receives
wildland fire services from the State shall jointly develop and annually review Operating Plans. Y p g
which will document the location of State Protected Indian Trust Lands and detail the
subjects identified in the Operating Plan Outline attached hereto as ENICHBIT B. Operating

Plans will be consistent with Bureau, Tribal and State policy and the terms of this agreement

The Operating Plan shall be an attachment to this agreement. It shall be forwarded to the
Bureau Area Director and the State by May 15, following approval by designated the desi ated State
representative, Tribal Official and the Bureau Agency Superintendent. The State or the
Bureau may request afield review of an Operating Plan(s).

15. Fire Notification and Reporting
The State shall notify Bureau of all known fires on State Protected Indian Trust Lands within
24 hours of the start of the incident by sending a facsimile copy of Exhibit E, Bureau of Indian
Affairs Fire Report Form and Telephone Notification to the closest Bureau Office or by
calling that office to verbally report the information. Only that information ravailable at
the time of notification is required. This notification is not required for fires where Bureau
fire management personnel or Bureau fire fighting resources, as identified in the operating
plan, are on scene.
The State shall transmit to the appropriate Bureau Office a copy of the State fire report for
each fire on State Protected Indian Trust Lands within 30 days of the control of the fire.
16. Initial Attack and Drawdown of Initial Attack Forces
The State agrees to aggressively pursue initial attack plans that utilize closest fire suppression
resources. The State shall notify the appropriate Bureau Agency Office when State initial
attack resources protecting Indian Trust Lands have reached Drawdown Level and are
expected to be at or below this level in excess of 48 hours. During this temporary period of
drawdown, the Bureau may elect to place Bureau fire fighting resources on emergency
staffing status at Tribal facilities for initial attack purposes. Emergency staffing will be at no
cost to the state. The State shall notify the appropriate Bureau Agency Office when State
initial attack resources protecting Indian Trust lands are no longer at or below Drawdown
Level 3.
17. Use of Bureau Facilities and Improvements
The Bureau shall permit the State to use all roads, truck trails, springs, reservoirs, fire tanks,
and other available "as is" facilities and improvements maintained by Bureau for State's use in
fire protection activities except as noted in the special management considerations section of
the operating plan.
18. Comeration for Fire Hazard Reduction
It is mutually agreed that both parties will cooperate in Mutual Interest Projects, (Section 52)
to reduce fire hazards, promote fire prevention education and other pre -fire engineering
projects on State Protected Indian Trust Lands.
19. Appropriate Suppression Action Policies
Except where modified by the terms of this agreement as negotiated and specified in the
Operating Plan or the Wildland Fire Situation Analysis (WFSA), all fire suppression activity
on State Protected Indian Trust Lands, including repair of suppression activity damage, will

Any restrictions to normal firefighting tactical techniques, such as use of heavymech

Procedures for the protection of special management areas will be acknowledged and included

24. Wildland Fire Situation Analysis (WFSA)
Bureau policy requires that an WFSA be completed for all fires on or threatening Indian Trust

objectives for the suppression action. when fires occur on State Protected Indian Trust
Lands, the responsible Bureau Line Officer will actively involve the State in this process.
Operating Plans will contain procedures for completion and Line Officer approval of the
iPP
WFSA. Final responsibility for strategy and tactical implementation within the selected
alternatives in the WFSA shall rest with the Incident Commander.
21. Reimbursement for wildland Fire Services
The Bureau shall reimburse State as set forth below for wildland fire services costs on State
Protected Indian Trust Lands.
The State shall prepare and submit invoices for wildland fire services provided on State
Protected Indian Trust Lands. A separate invoice will be prepared for each fire when such fire
is not exempted by a local Operating Plan in accordance with Section 49, Billing Procedures.
Cost reimbursement to be claimed by State shall be the actual cost to State (as determined by
State and approved by Bureau) for those services or items that were necessarily used in
providing wildland fire services on State Protected Indian Trust Lands.
The reimbursement to State by the Bureau for fires which burn State Protected Indian Trust
Lands and State Protected Non -Indian Lands shall be determined by the ratio of State
Protected Indian Trust Lands to the burned acreage of State Protected Non -Indian Lands
involved in the fire, excluding any burned acreage which is the direct protection responsibility

BUREAU PROTECTED INDIAN TRUST LANDS
22. Bureau Direct Protection
Since certain Tribes, delineated in EXHIBIT D, have elected to coma
p ct or contract a Bureau
wildland fire program, the lands of these Tribes will not be included among the lands to be
protected by State under this agreement. Bureau and the compact/contract Tribes '
es will retain
the direct fire protection responsibility for these Bureau Protected Indian Trust Lands.
23. Two Cateeories ,of Suppression Resources
It is agreed that there will be the following two categories of joint resources $ J used in the
suppression of fires on, or adjacent to, Bureau Protected Indian Trust Lands. The two
categories are herein called automatic aid and assistance by hire.
24. Automatic Aid
For the purposes of this agreement, Automatic aid is that automatic initial attack response by
suppression resources (excluding aircraft) as specified in the Operating Plan for

planned automatic aid initial attack response areas and provided at no cost

agency. automatic aid will be limited to 24 hours from the time of initial report. Automatic
aid resources should be released as soon as possible. In no case shall they be held beyond the

25. Assistance By Hire

a full reimbursable bans. All requests to hire fire protection assistance must be1

precise and shall be processed and recorded through the dispatch systems of the partii
pating
agencies. Requests not processed in this manner will not be reimbursable. Personnel
equipment, or supplies provided by a supporting agency and essential to fillip the r

Except for automatic aid, all requests for fire protection assistance in an agency's Direct

26. Initial Attack
The State and Bureau agree to aggressively pursue initial attack laps that utilize closest
. P fire
suppression resources. The Bureau and the State will identify pre -planned initial attack
response areas and document these areas in the Operating Plan.
27. Cost Sharing
A cost share agreement will be prepared when there is: (1) a multi -jurisdictional incident or,
(2) an incident which threatens or burns across State Protected Non -Iridian Lands and Bureau
Protected Indian Trust Lands and the automatic aid period has been exceeded. The State and
the Bureau agree to use the methods for cost sharing described in the State's 3 800 Handbook
and in the NWCG Interagency Incident Business Management Handbook.
28. Local Government AQency Involvement in Cost Sharing
The State and Bureau recognize that cost share agreements may contain cost shares assigned
to local government agencies that are charged with the protection ofLocat Responsibility
Area (LRA). When developing cost share agreements, LRA shares will be identified. In the
event a responsible, local government agency is unwilling to become a party to a cost share
agreement, the negotiation for recovery of LRA cost shares will be assigned to the State
and/or Bureau using the following logic:
1. If the LRA that was burned, or threatened, is entirely related to one agency's
protection responsibility, then that agency will assume the responsibility for
negotiations for recovery of LRA costs.
2. If the LRA that was burned, or threatened, is related to State Protected Non -Indian
Lands and Bureau Protected Indian Trust Lands, then the LRA cost share will be
apportioned between the respective agencies based on an agreement between the
Incident Commanders, and the negotiations for recovery of LRA costs will be assumed
by the involved agencies.
3. The decision to seek reimbursement for costs associated with protection of LRA is a
policy issue for each of the parties to this agreement that will be addressed on an
individual case basis. When the LRA cost has been split between agencies, those
agencies will coordinate reimbursement requests or remedies to the local government
agency involved. The agency with the greatest percentage share will typically lead the
reimbursement effort.

Commanders and Agency Line Officers will use cost apportionment methods in developing
incident cost share agreements. Cost apportionment methods are described in the State's
3 800 Handbook and in the NWCG Interagency Incident Business Management Handbook.
State and Federal Agency Cost Apportionment Technical Specialists (CATS) will be trained
and available to assist incident commanders in developing the cost share documentation and
agreements for appropriate incidents. These technical specialists will be available through
normal ordering and dispatching channels.
The cost apportionment settlement meetings must be held prior to the end of the 12 month
period as described in Section 49, Billing Procedures.
30. Aircraft
The use of aircraft (including both fixed and rotary wing) shall be on an assistance by hire
basis. The protecting agency shall be responsible for the payment of the hourly flight rate for
aircraft, including pilot, any applicable aircraft landing fees and appropriate retardant costs.
Aircraft contracts require their contractors to bill the contracting agency for all payments due.
Contract aircraft used under the assistance by hire terms of this agreement will be paid by the
contracting agency. The contracting agency, will, in turn, bill the protecting agency for all
assistance by hire aircraft use.
31. Wildland Fire Situation Analysis (WFSA)
Bureau policy requires that an WFSA be completed for all fires on or threatening Indian Trust
Lands which escape initial suppression action. The procedure requires a Federal Agency Line
Officer, Agency Representative, or Agency Administrator to participate in developing incident
objectives for the suppression action. For fires occurring on Bureau Protected Indian Trust
Lands and threatening State Protected Non -Indian Lands, the State Line Officer, Agency
Representative, or Agency Administrator may participate in the WFSA process. Final
responsibility for strategy and tactical implementation within the selected alternatives in the
WFSA shall rest with the Incident Commander.
32. Fire Notification
The Bureau will notify the State in a timely manner of all fires burning on Bureau Protected
Indian Trust Lands that threaten State Protected Non -Indian Lands. The State will notify

Lands, it is agreed that there shall be no delay in initial attack pending determination of the
direct protection responsibility. Each party shall assume the costs of its own initial attack
forces on such fires regardless of the relative areas burned in each agency's DPA. Unless it is
determined that the fire is confined to the DPA of either the State or the Bureau Protected
Indian Trust Lands, a unified command organization will be implemented or an incident
command team will be employed. For unified command, the Incident Commanders of the
involved parties shall mutually agree upon fire suppression objectives and strategy and
commitment of agency suppression resources. The Incident Commander of a command team
shall take direction from the Line Officers, or their delegates, of the involved parties.

If it is determined that the fire is confined to the DPA of either the State or the Bureau, the
protecting agency shall designate an Incident Commander. If necessary, the protecting agency
may request the supporting agency to assume command of the fire.
34. Bureau Protected Indian Trust Lands Operating Plans
The appropriate State Ranger Unit and each Bureau Agency and Compacted/Contracted Tribe
may enter into separate mutual aid or other appropriate agreements for assistance. Such
agreements should include those salient points from the operating plan outline as appropriate.
In the event the Bureau and Compacted/Contracted Tribe will be protecting SRA, the
appropriate State Ranger Unit and each Bureau Agency and ContractedlCompacted Tribe
shall jointly develop and annually review Operating Plans for Bureau Protected Indian Trust
Lands adjacent to State Protected Non -Indian Lands. These Operating Plans shall detail the
subjects identified in the Operating Plan Outline attached hereto as EXI;IIBIT B. Operating
Plans will be consistent with Bureau, Compacted/Contracted Tribal and State policy and the
terms of this agreement and may be more detailed than the outline.
The Operating Plan shall be an attachment to this agreement. It shall be forwarded to the
Bureau Area Director and the State by May 15, following approval by the designated State
representative, Contracted/Compacted Tribal Official and the Bureau Agency Superintendent.
The State or the Bureau may request a field review of an Operating Plan(s).

39. Motorized Ground Equipment
Use rates for all agency -owned motorized ground equipment (including operators) provided
as assistance by hire shall be paid at the rates established by each agency for its equipment.
Rates for motorized ground equipment shall include motor fuels and lubricant costs. Charges
for motor fuels and lubricant costs supplied by the protecting agency will be billed separately.
The State and Bureau agree to jointly use Emergency Equipment Rental Agreement (EERAs)
and Interagency EERA rates for privately owned equipment hired for fires. Instruction for
administering these agreements has been provided in the California Interagency Emergency
Equipment Rental Rate Packages to each agency'operational and admini
s strative units.
40. Personnel
With the exception of personnel included in automatic aid, each agency shall submit a bill
which shall include salary, overtime, employee benefit cost, travel, and subsistence ('including
lodging) related directly to the fire, for all personnel ordered by the protecting agency.
41. Duration of Assig_nme_nt_s_
Consideration must be given to the health and safety of personnel when assigned to fires of
long duration. It is agreed that twenty-one days or shorter periods dictated by agency policy
will be considered the maximum time that supporting agency personnel shall be assigned to a
protecting agency. It is the responsibility of the protecting agency to request relief personnel
in advance of the end of this time period. The protecting agency is further responsible for the
transportation costs of moving personnel to the fire and returning those relieved personnel
back to their home stations. Extensions beyond the maximum period may be requested. In all
cases, the State and Bureau agree that their Incident Commanders will release suppression
resources to their primary mission responsibilities as soon as priorities allow.
42. Re lacing Fire Supplies
Replacement of agency -owned expendable tools and supplies lost, damaged or expended by
the supporting agency may be reimbursed except as provided in Section 55, Waiver of Claims.
43. Facilities.- Equipment and Supmort
It is mutually agreed that when beneficial for the protection of Indian Trust Lands and State
Protected Non -Indian Lands, and in conformance with existing laws and regulations, the State
and the Bureau may procure, loan, lease, share or exchange facilities, equipment and support
services. This may include, but is not limited to, such things as dispatch centers, fire stations,
lookouts, warehouses, vehicles, fire equipment, remote automatic weather stations, lightning

mutual benefit exists, any fees for such use, as might be found in Special Use permits or other
similar documents, may be waived. Any operational costs required for such proposed use ma

governed in accordance with existing policy of each agency.
44. In_ Cera en Use of Communications Siem
The Bureau and the State may mutually agree to share components of their communications
systems such as: radio frequencies, computer system access, data transmission lines and
communications sites. Such use will be approved by the State Director and the Bureau Area
Director. Operating Plans detail any restrictions or special requirements of this sharing.
45. Cooperative Training
The State and the Bureau may cooperate to make use of existing personnel, equipment and
facilities for training purposes. Any payment will be made in accordance with existingpolicy

and regulations.
46. Post -Incident Action Analysis
To benefit from lessons learned on fire incidents falling under the terms of this agreement, the
State and Bureau may from time to time conduct a post -Incident action analysis. In all cases,
these critiques or reviews will be conducted jointly by the State and the Bureau and will
follow discussions between the Incident Commander and the appropriate Line Officer.
47. Appropriate Fund Limitation
Nothing herein shall be interpreted as obligating the Bureau or the State to expend funds or as
involving the United States or the State of California in any contract or other obligation for
the future payment of money in excess of appropriations authorized by law and
administratively allocated for the work contemplated in this agreement.
48. Accounting for Wildland Fire Services and Assistance by Hire Costs
The State will document all expenditures incurred for providing wildland fire services and
assistance by hire under the terms of this agreement. The Bureau will document all

Expenditures include both direct costs and indirect or administrative costs. The
administrative charge, used for all billings, will be applied to all direct costs. Both the State
and the Bureau shall use a comparable method to determine the rate for such administrative
charges. All costs will be calculated using established agency procedures.

49. Billing Procedures
On any incidents or projects where costs are incurred pursuant to the terms of this agreement,
the billing agency shall submit the final bill for reimbursement, in duplicate, as soon as
possible, but no later than 12 months ager the incident is controlled or project completed.
This bill, identified by incident name and appropriate order number or project identification,
will be adequately documented. A separate bill will be submitted for each incident or project
unless otherwise negotiated. Both agencies may agree to submit a partial bill, so identified,
for major incidents.

All bills will have a due date 60 days after the date of issuance. If payment cannot be made
before the 60 days expire, then a 30 -day extension, with oral or written justification, may be
requested. Written notice that a bill is contested must be mailed to the address listed above
within 90 days of issuance of the original bill, and must fully explain the area of dispute.
Contested items will be resolved not later than 120 days following notification of contested
items. The uncontested portion of the bill may be paid pursuant to normal requirements with
a notation that the contested portion is being withheld, or the entire bill may be paid with a
credit provided when final resolution is made. For bills remaining unpaid at the close of the
respective fiscal years, the billing agency must provide obligational amounts to the other. The
Bureau will submit obligational figures to the State by June 15 for the period of the time
starting on July 1 of the previous calendar year through June 30 of the current calendar year.
The State will submit obligational figures to the Bureau by September 15 for the period of
time starting October 1 of the previous calendar year through September 30 of the current
calendar year.
Payments for reimbursement made pursuant to the above billings will refer to the bill number
and will be sent to the appropriate billing address.

The State and Bureau agree not to bill any actions authorized by this agreement where the
total costs of services (not including any administrative charges) is less than thirty-five dollars
($35).
50. Employment Policy
It is agreed that employees of the parties to this agreement shall at all times be subject only to
the laws, regulations, and rules governing their employment, regardless of agency, and shall
not be entitled to compensation or other benefits of any kind other than specificallyprovided
by the terms of their employment.
51. Mutual Sharing of Information
The State and the Bureau will furnish to each other, or otherwise make available u

request, such maps, documents, instructions, records, and reports, including, but not limited
to, fire reports, employment records, and law enforcement reports as either party considers
necessary in connection with the agreement, in accordance with applicable State and Bureau
rules and regulations.
52. Mutual Interest Projects
The State and the Bureau may jointly conduct appropriate mutual interest projects to maintain
or improve the fire protection capability of these agencies. Such projects will be properly

documented and will set forth the objective of each undertaking and the role each agency will
play in accomplishing that objective. Anticipated cost and the amount of each agency's share
of the cost will be shown and itemized. A local agreement should be executed whenever such
a mutual undertaking is of a localized nature, involves an exchange of funds, and/or involves a
considerable exchange of services.
Such local agreements shall not be in conflict with the terms of this agreement. Local
agreements may be executed by the Ranger Unit Chief, or the Bureau Line Officer.
53. Suppression and Damage Collection
Nothing in this agreement shall preclude the Bureau or the State from collecting damages and
suppression costs from third parties (civil actions for recovery will be taken independently)
under civil liabilities provisions of Federal and State statutes and common law in a manner
provided applicable law. Any anticipated or planned suppression or damage collections by
either the State or the Bureau , will be preceded by notification to the other agency. Joint
collection actions shall comply with the current provisions of Health and Safety Code §
13009, regarding lead agency designation and authority for collection. whenever such
collections have the effect of reducing the net expenditures of the State or Bureau to
accomplish services provided for in this agreement, then such collections shall be reported and

54. Accident Investigations
Whenever an accident occurs involving the equipment or personnel of a supporting agency,
the protecting agency shall take immediate steps to notify the supporting agency that an
accident has occurred. As soon as practical, the protecting agency shall conduct an
investigation of the accident. The investigation shall be conducted by a team made up of
appropriate representatives of the State and the Bureau.
The sharing of information between agencies on accident investigations and their findings and
probable causes is a valuable tool for safety and must be encouraged. •
Investigation cost for personnel will be agency specific and will be borne by the sending
agency. Other accident or incident investigation costs are the fiscal responsibility of the
agency (ies) that has jurisdiction and/or investigative responsibility.
55. Waiver of Claims
The State and Bureau hereby waive all claims between and against each other, arising in the
performance of this agreement, for compensation for loss or damage to each other's property,
and personal injury, including death, of employees, agents, and contractors, except that this
indemnification shall not apply to intentional torts or acts of violence against such persons or
property.
56. Officials Not to Benefit
No member of, nor Delegate to, Congress, or Residence Commissioner, shall be admitted to
any share or part'of this agreement or to any benefit to arise therefrom unless it is made with a
corporation for its general benefit.
57. Previous Agreement Canceled
This agreement supersedes and cancels the Cooperative Fire Protection Agreement, as
amended, entered into on April 1, 1992, between the Bureau and the State.
58. Duration of Agreement
The term of this agreement shall commence on the last signatory date below, and shall
continue through December 31, 2002, unless sooner terminated upon one year prior written
notice between the State and the Bureau.

60. Examination and Audit
Bureau and the State shall be subject to examination and audit for three years after final
payment under the terms of this agreement. Examination and audit shall be
confined to those
matters connected with the performance of this agreement including, but '
not limited to, the
cost of administration.
61. Nondiscrimination
The State and Federal Agencies shall comply with all Federal statutes relating to
nondiscrimination. These include, but are not limited to: (a) Title VI of the Civil Rights Act
of 1964 (42 U.S.C. 2000d through 2000-6); (b) Title IX of the Education Amendments of
1972, as amended (20 U.S.C. 1681-1683, and 1685-1686), which prohibits discrimination on
the basis of sex; (c) Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794) which
prohibits discrimination on the basis of disabilities and provides for reasonable accommodation
in hiring of persons with disabilities; (d) the Older American Act of 1965 as amended (42
U.S.C. 3056 and 6101 et seg.); and (e) USDA 9 AR, Title VI Implementation Regulations.
62. Bureau Obligation of Funds
The total amount payable by Bureau to State. shall not exceed $2,500,000 during the term of
the agreement. Contingent upon availability of funds, the total estimated budget g t for this
agreement is $2,500,000 as follows:

From October 1, 1999 through September 30, 2000

ADMINISTRA= CHARGE: That pre -established percentage charge that will be applied b the
billing agency.
PP y
AGENCY ADMINISTRATOR: See Line Officer.
AGENCY REPRESENTATIVE: A supporting agency employee with full authority to make
decisions on all matters affecting that agency's participation at the incident.
APPROPRIATE SUPPRESSION ACTION: Fire suppression action consistent with protecting
agency fire suppression policy, except where modified by local Operating plans or EFSA.
ASSISTANCE BY HIRE: Fire suppression resources that are to be paid for by the protecting
agency. Assistance by hire resources must be requested by the protecting agency and be recorded by
the resource order process within the dispatching systems of both the State and the Bureau. All
resources not processed in this manner will be considered as automatic aid resources or as a voluntary
contribution and therefore not reimbursable.
AUTOMATIC AID: Automatic initial attack response by suppression resources (excluding aircraft
and pilot(s)) as specified in the Operating Plan for specific pre -planned initial attack response areas
and provided at no cost to the protecting agency for the first 24 hours from the time of initial report.
Automatic aid is limited to those initial attack resources or move -up and cover assignments that have
been determined to be appropriate in the annual Operating Plans. Aircraft (fixed and rotary -winged,
including pilot(s)) shall always be assistance by hire.
AVAILABLE: Following the Incident Command System protocols, the status of a fire fighting
resource that indicates its availability for assignment on an incident.
BOUNDARY FIRE: A fire burning on, or directly adjacent to, the protection boundary of the State
and the Bureau.
BUREAU FIRE FIGHTING RESOURCES: Bureau or Tribally owned, leased or rented vehicles and
equipment, and qualified Bureau and Tribal personnel.
BUREAU PROTECTED INDIAN TRUST LANDS: Indian Trust Lands provided wildiand fire
protection by either the Bureau or a contract/compact tribe.

CO CTED/COMPACTED TRIBE: A tribe which has assumed responsibility for wildland Fire
Management Programs conducted by the Bureau pursuant to Public Law 93-638.
CONTRACTING AGENCY: The agency which holds a contract for specific services or
commodities with a vendor.
COST APPORTIONMENT: A cost share methodology as described in the State's 3800 Handbook
and the NWCG Interagency Incident Business Management Handbook.
COST SHARE AGREEMENT: An interagency agreement describing the conditions and/or
percentage of State, Bureau and possibly Local Agency financial Liability for costs incurred as a result
of jointly approved operations pursuant to the terms of this agreement. This includes suppression
costs for incidents that have a mutual impact on the participating agencies.
DETECTION: The act or system of discovering and locating a fire.
DIRECT PROTECTION AREA (DPA): That area which, by law or pursuant to the terms of this
agreement, is provided wildland fire protection by the State or by the Bureau. DPAs may include a
mixture of state, federal and Local Responsibility Areas (LRA).
DRAWDOWN LEVEL: Predefined commitment levels for fire engines and firecrews, on a ranger
unit and area basis, based on the number of fire engines and firecrews in a respective unit or area.
Used as a measure to assure that the balance of initial attack forces is proportionate and that the
probability of success of the initial attack system remains consistent statewide, given current predicted
fire danger and activity.
FIELD REVIEW: A review of fire protection designed to verify that the boundaries and suppression
forces of wither agency conform to the intent of this Cooperative Fire Protection Agreement.
HANDCREW: A wildland fire suppression crew consisting of approximately 15 to 20 persons.
INCIDENT: An occurrence or event, either human -caused or natural phenomena, that requires
action by emergency service personnel to prevent or minimize loss of life or damage to property
and/or natural resources.
INDIAN TRUST LANDS: Those Indian lands held in trust by the Federal Government, for which the
Bureau has trust responsibility.
INITIAL ATTACK: Resources initially committed to an incident.
LINE OFFICER: The individual assigned administrative responsibilities for an established
organization unit.

LOCAL RESPONSIBILITY AREA (LRA): Those areas of California that are the wildland fire
responsibility of neither the State nor the Bureau nor any other agency of the United States
Government.

OPERATING PLAN: A plan developed at the Bureau Line Officer, compacted/contracted tribe
where applicable, and State Ranger Unit Chief levels for implementing this Cooperative Fire
Protection Agreement in their respective areas of responsibility.
PRESCRIBED FIRE: The planned use of fire on wildlands to accomplish specific objectives
including reducing fire hazard, providing flood protection, enhancing wildlife and fisheries, im rovin

water yields and/or air quality, or enhancement of cultural species.
P ENGINEERING: Programs or activities that are undertaken prior to a fire starting that
will reduce the hazards and risks associated with wildland fires. These could include, but are not
limited to, fuels management, structure -vegetation clearance, fire service access, building construction
accessments, local ordinance or tribal law development, use of federal grants for hazard mitigation,
designation of high value, high hazard, or high risk areas, or other activities or improvements of a
similar purpose.
PRELIMINARY FIRE INVESTIGATION: Actions taken and reports written to determine and
record the origin and cause of a fire, including determining names, addresses, telephone numbers,
descriptions of victims, witnesses, suspects, tenants, owners, insurance companies, etc.; obtaining
initial statements, observations, license numbers, equipment ID, train or electrical pole numbers, on
scene evidence, weather observations, photographs, etc.; developing initial options and conclusions;
and, taking measurements and drawing fire scene sketches. May be taken by initial attack engine
company officer or investigative officer responding to incident.
PREVENTION: Activities directed at reducing the number of fires that start, including public
education, law enforcement, dissemination of information and the reduction of hazards through
engineering methods.
PROTECTING AGENCY: The agency responsible for providing direct wildland fire protection to a
given area pursuant to this agreement.
PROTECTION UNIT: Bureau Protection Units shall mean Bureau of Indian Affairs Agencies and
Contract or Compact Tribe's reservations, and State Protection Units shall mean Ranger Units.
REPAIR OF SUPPRESSION ACTIVITY DAMAGE: Those activities undertaken by fire
suppression forces during or immediately after the control of a wildland fire to ensure the prevention
of erosion or to repair other damages resulting from fire suppression activities.

State Director by May 15, following approval by the designated State representative and the Bureau

COOPERATIVE FIRE PROTECTION AGREENMNT
FIRE PREVENTION
PUBLIC LAW 280
Under Public Law 280 (P. L. 83-280, August 15, 1953), the State of California (distinguished from
State as defined in this agreement) has jurisdiction over criminal offenses occurring on Indian Truss
Lands. Such jurisdiction falls on the law enforcement agency(ies) having the responsibility for
enforcement of the appropriate statutes within the respective county.
The State, where applicable, will enforce State Forest and Fire Laws and other appropriate criminal
statutes/regulations upon State Protected Indian Trust Lands pursuant to Public Law 280. The laws
to be enforced by the State will be delineated in the Operating Plan.
DETERNHNATION OF CAUSE AND PRESERVATION OF EVIDENCE
The initial attack personnel of the State and Bureau are responsible to gather and preserve
information and evidence pertaining to the origin and cause of the fire. To the extent permitted by
Federal and State law, the State will provide investigation files relative to the fire to the Bureau. To
the extent permitted by Federal and State law, the Bureau will provide investigation files relative to
the fire to the law enforcement agency having primary jurisdiction under Public Law 280.
C AL AND CIVIL ACTION S
State and Bureau will promptly notify the other when there is potential for criminal or civil action on
a fire occurring on lands under the jurisdiction of the other agency. For civil actions for wildland fires
that occur on or involve State Protected Indian Trust Lands and mutli-jurisdictional wildland fires a
lead agency will be designated and authorization will be provided for the lead agency to bring an
action to recover costs incurred by all participating agencies.
RESTRICTION AND CLOSURES
When any State protection unit plans, activates, or deactivates any suspension, closure, or restriction,
the Bureau Agency Office and compact/contracted tribe will be immediately provided a copy of the
notice.

CDF/Butte Fire Department has reviewed the Gold Country Casino Draft Environmental
Review document and submits the following comments:
1. The bottom of page 35 states that the Butte County Fire Department and the
Oroville City Fire Department provide fire protection services for the Berry Creek
Rancheria and the surrounding vicinity. This statement is not correct and points
to a serious problem in fire protection for the Rancheria. The Butte County Fire
Department, through along -standing cooperative agreement with the California
Department of Forestry and Fire Protection, provides fire protection for the area
surrounding the Rancheria. Both the CDF Fire and Butte County Fire have
jurisdictional responsibilities for fire, rescue, and hazardous material incidents.
The Rancheria, since opening, has been receiving free services for its separate
jurisdiction. In order to continue receiving services, it is imperative that the
Rancheria either develop its own capabilities or enter into a cooperative
agreement with Butte County Fire Department. Oroville City has entered into a
mutual aid agreement with Butte County for mutual protection. The Rancheria is
not included in this agreement.
2. On page 36 it is noted that Squad 64 provides basic life support services. Squad
64 has not existed for several years and has been replaced by Rescue 64. It
should be sufficient to state that, "The CDF/Butte County Fire Department also
provides basic life support services from the Kelly Ridge Fire Station that is
located approximately two miles east of the Berry Creek Rancheria and has an
estimated response time of four minutes."
3. Paragraph #1 (above) should also note that at this time the CDF/ Butte County
Fire has no agreement to provide fire or emergency medical services to the
Rancheria. The Rancheria is a separate government entity that must provide its
own fire and medical response system, or the Rancheria must enter into an
agreement with the CDF/Butte County Fire. Just as a new city must provide for
itself; it is also required that the Rancheria provide or contract for its needs.
4. Page 36 notes that domestic water is obtained from Lake Oroville. In fact,
600
domestic water comes from other sources as distributed by the Oroville-
Wyandotte Irrigation District.
We do not agree with the conclusion of the statement that there will be no
environmental impact from the proposed hotel/casino. There are many impacts upon
the Fire Department. The impacts include, but are not limited to, additional
responses to fires, medical emergencies and traffic collisions. These impacts affect
the fire department in two ways: [1 ]The increased number of calls cost money for
fuel, wages, equipment, and wear and tear on that equipment as well as increasing
the safety risk to fire fighters. [2] When there is a fire response to one location that
unit is no longer available to respond to another location. In the current context that
could conceivably mean that a fire response to the casino (who don't pay for the
service) is taking place while another call for service goes unattended else where in
the area (from people who do pay for the service.) As the casino expands its
operations the impacts also expand. Below are mitigation measures:
1. The Rancheria is required by the Tribal -State Compact (Section 6.4.2(b)) to
adopt building and safety code standards identical to Butte County or adopt the
Uniform Building Code and all related codes. This requirement appears to have
been neglected in past construction. The Rancheria should provide proof that this
requirement is being met. It is imperative that the Rancheria follow this
requirement and allow fire department and building inspectors to carry out proper
plan checking and on-site inspections as required by the codes.
2. The current tent structures are connected by an unprotected passageway to the
portable buildings. Smoke from a fire in the portables could easily move into the
tent structures causing an extreme safety hazard. The proposal presented in this
draft environmental review does not indicate the final disposition of the portables.
Appropriate automatic fire doors are needed between the structures.
3. The hydrant system serving the facility is currently inadequate, and with the
proposed construction the inadequacy may increase. One hydrant is on the
wrong side of the driveway, and large diameter hose would block exit and entry
by the main road. The proposed hotel/casino will have an estimated required fire
flow of 5,300 gallons per minute. The current available fire flow is about 3,800
gallons per minute. Several new hydrants and water mains may be required to
meet appropriate spacing and fire flow requirements.
4. As mentioned in the draft environmental statement, automatic sprinkler systems
will be required throughout the structure and special extinguishing systems will
be required in kitchens. The statement does not mention other types of required
construction standards such as fire department elevator control, standpipe
systems in stairwells, etc. These safety measures are all required and need to
meet code.
5. The current casino is already the busiest call address in the Kelly Ridge area.
The only other facility served by the Butte County Fire Department that may
compete in number of calls is the Feather Falls Casino. The Berry Creek
Rancheria is receiving free fire protection and this unfair liability must end. The
County recognizes that the Rancheria pays money to the State to help defray
local costs. This money has not been made available to Butte County, and it is
not appropriate for the County to spend local tax dollars on a jurisdiction that
pays no local property tax. The Fire Department recommends that the Rancheria
pay for fire service through the Butte County Fire Department. The cost of an
agreement could be based upon one of several different methodologies: cost per
call; cost per year; or some combination of costs representative of expenses. It is
expected that the call load at the Rancheria will increase significantly with the
proposed construction.
6. The proposed hotel/casino will be one of the tallest and largest buildings in the
unincorporated area of Butte County. The occupancy and height of the building
will create significant impacts upon the fire department. These impacts and the
public's expectation of service cannot be ignored, and yet, the Butte County Fire
Department does not own the equipment necessary to provide full fire protection
at a high-rise hotel. The mitigation measure for a high rise is for the Rancheria to
purchase a ladder truck of a size and design as determined by the Butte County
Fire Department. In order to staff and house a ladder truck at the Kelly Ridge Fire
Station the Rancheria would also provide money for staffing and for remodel at
the fire station. It is common in many localities for developers of new buildings
and subdivisions to provide equipment and personnel. The Rancheria may find
there are savings on insurance when proper fire protection is provided to their
facility.
7. Access to the facility is extremely poor. Access to all sides of all structures, tent
casinos, bowling alley and high rise hotel must be developed to meet the fire
department's requirements. This includes adequate paving to allow the raising of
aerial ladders at positions predetermined by the fire department.

Sec. 6.0. REGULATION OF GAMING
Sec. 6.1. Tribal Gaming Ordinance. All g-ti•t"ies
conducted under this Gaming Compact shall at a minimum comply with a
Tribal gaming ordinance duly adopted by the Tribe and approved in
accordance with IGRA.
Sec. 6.2. Tribal Ownership, Management, and Control of Gaming
Facility and Gaming Operation. All gaming operations and facilities
authorized under this Gaming Compact shall be owned solely by the
Tribe. The parties acknowledge that most tribal gaming operations
and facilities within the State presently are controlled and
conducted solely by a tribe, and that a goal of the Act is to enable
all tribes to control and conduct their own gaming operations and
facilities, provide tribal job training and employment, and achieve
tribal self-sufficiency. Therefore, although the Tribe shall be,
entitled to contract for the management of the gaming facility and
operation in accordance with'IGRA, any such management contract shall
provide that, to the extent permitted by law, members of the Tribe
will be trained for and advanced to key management positions, and
that a goal of the management contractor is to prepare the Tribe to
assume the control and conduct of the operation and facility.
Sec. 6.3. Prohibition Regarding Minors. Tribal gaming facilities
operated pursuant to this Gaming Compact shall be subject to the
same minimum -age restrictions for patrons that currently apply to the
California State Lottery. If alcoholic beverages are served in any
area of a Tribal gaming facility operated pursuant to this Gaming
Compact, prohibitions regarding age limits in that area shall be
governed by applicable law.
Sec. 6.4. Licensing Requirements and Procedures.
Sec. 6.4.1. Summary of Licensing Principles. All persons in any
way connected with the gaming operation or facility who are required
to be licensed under IGRA and any others required to be licensed
under this ing Compact, including, but not limited to, all gaming
employees and gaming resource suppliers, must be licensed by the
Tribal gaming agency. The Tribal gaming agency shall have the
primary responsibility for licensing those persons and entities and
for the regulation of the gaming operation and facility. The Tribal
gaming agency shall also certify, through the use of experts and with
participation by the State gaming agency if it so desires, that the
gaming facility and any construction to be undertaken in regard
thereto meet specified building and safety standards. The State
gaming agency shall be provided with licensing application
information. and 'reports regarding facility inspections and
compliance. The State gaming agency may review that information and
object or refrain from objecting thereto. In the event that the
State gaming agency fails to object to a gaming license application
within 90 days after receipt of that information and notification
that the Tribal gaming agency intends to issue a temporary or
permanent license, the State gaming agency is deemed to have
certified that it has no objection to that issuance, but the State
gaming agency shall be free at any time to revoke that certification,
or to request the Tribal gaming agency to suspend or revoke a gaming
license. The dispute resolution processes between the State and the
Tribe provided for herein shall be available to resolve disputes
between the Tribe and the State regarding such requests and building
and safety certifications. The parties intend that the licensing
process provided for in this Gaming Compact shall involve joint
cooperation between the Tribal gaming agency and the State gaming
agency, as more particularly described herein.
Sec. 6.4.2. Gaming Facility. (a) The gaming facility authorized
by this Gaming Compact shall be licensed by the Tribal gaming agency
in conformity with the requirements of this Gaming Compact, the

Tribal gaming ordinance, and IGRA. The license shall be reviewed and
renewed, if appropriate, every two years thereafter. Verification
that this requirement has been met shall be provided to the State
gaming agency. The Tribal gaming agency's certification to that
effect shall be posted in a conspicuous and public place in the
ga 'ng facility at all times.
(b) In order to protect the health and safety of all gaming
-facility patrons, guests, and employees, all gaming facilities of the
Tribe constructed after the effective date of this Gaming Compact
shall meet the building and safety codes of the Tribe, which, as a
condition for engaging in that construction, shall amend its existing
building and safety codes if necessary, or enact such codes if there
are none, so that they meet the standards of either the building and
safety codes of any county within the boundaries of which the site
of the facility is located, or the Uniform Building Codes, including
all uniform fire, plumbing, electrical, mechanical, and related codes
then in effect, provided that nothing herein shall be deemed to
confer jurisdiction upon any county or the State with respect to any
reference to such building and safety codes.
(c) Aria gaming facility in which gaming authorized by this Gaming
Compact is conducted shall be licensed by the Tribal gaming agency
prior to occupancy if it was not used for any gaming activities under
IGRA prior to the effective date of this Gaming Compact, or, if it
was so used, within one year thereafter. The issuance of this
license shall be reviewed and renewed every two years thereafter.
Inspections by qualified building and safety experts shall be
conducted under the direction of the Tribal gaming agency as the
basis for issuing or renewing any license hereunder. The Tribal
gaming agency shall determine and certify that, as to new
construction or new use for gaming, the facility meets the Tribe's
building and safety code, or, as to facilities or portions of
facilities that were used for the Tribe's gaming activities prior to
this Gaming Compact, that the facility or portions thereof do not
endanger the health or safety of occupants or the integrity of the
gaming operation.
(d) The State gaming agency shall be given at least 30 days'
notice of each inspection by those experts, and, after 10 days'
notice to the Tribe, may accompany any such inspection. The Tribe
agrees to correct any facility condition noted in an inspection that
does not meet the standards set forth in subdivision (b). The Tribal
gaming agency and State gaming agency shall exchange any reports of
an inspection within 10 days after its completion, which reports
shall also be separately and simultaneously forwarded by both
agencies to the Tribal Chairperson. Upon certification by those
experts that a facility meets applicable standards, the Tribal gaming
agency shall forward the experts' certification to the State within
10 days of issuance. If the State objects to that certification, the
Tribe shall make a good faith effort to address the State's
concerns, but if the State does not withdraw its objection, the
matter will be resolved in accordance with the dispute resolution
provisions of Section 9.0.
Sec. 6.4.3. Suitability Standard Regarding Gaming Licenses. In
reviewing an application for a gaming license, and in addition to any
standards set forth in the Tribal gaming ordinance, the Tribal
gaming agency shall consider whether issuance of the license is
inimical to public health, safety, or welfare, and whether issuance
of the license will undermine public trust that the Tribe's gaming
operations, or tribal government gaming generally, are free from
criminal and dishonest elements and would be conducted honestly. A
license may not be issued unless, based on all information and
documents submitted, the Tribal gaming agency is satisfied that the
applicant is all of the following, in addition to any other criteria
in IGRA or the Tribal gaming ordinance:

(a) A person of good character, honesty, and integrity.
(b) A person whose prior activities, criminal record, if any,
reputation, habits, and associations do not pose a threat to the
public interest or to the effective regulation and control of
gambling, or create or enhance the dangers of unsuitable, unfair, or
illegal practices, methods, or activities in the conduct of gambling
or in the carrying on of the business and financial arrangements
incidental thereto.
(c) A person who is in all other respects qualified to be licensed
as provided in this Gaming Compact, IGRA, the Tribal gaming
ordinance, and any other criteria adopted by the Tribal gaming agency
or the Tribe, provided that any applicant who supplied services or
equipment to a tribal gaming operation prior to the effective date of
this Act, such as, but not limited to, a person who would be deemed
to be a gaming employee or gaming resource supplier under this Gaming
Compact, or any person who may have been deemed to have violated,a
law in the exercise of or protection of a tribe's sovereignty rights
in connection with fishing, hunting, protection of burial grounds,
repatriation of remains or artifacts, or gaming, may not, for that
reason, be deemed unsuitable. Nothing herein may be deemed to exempt
any such applicant from otherwise qualifying for licensing or
certification under this Gaming Compact.
Sec. 6.4.4. Gaming Employees. Every gaming employee shall
obtain, and thereafter maintain, a valid Tribal gaming license, which
shall be subject to biannual renewal, provided that in accordance
with Section 6.4.9, those persons may be employed on a temporary or
conditional basis pending completion of the licensing process.
Sec. 6.4.5. Gaming Resource Supplier. Any gaming resource
supplier who provides, has provided, or is deemed likely to provide
at least twenty-five thousand dollars ($25,000) in gaming resources
in any 12 -month period shall be licensed by the Tribal gaming agency
prior to the sale, lease, or distribution, or further sale, lease, or
distribution, of any such gaming resources to or in connection with
the Tribe's operation or facility. These licenses shall be renewed
at least every two years.
Sec. 6.4.6. Financial Sources. Any party extending financing,
directly or indirectly, to the Tribe's gaming facility or gaming
operation shall be licensed by the Tribal gaming agency prior to
extending that financing. Licensing shall be effective for no more
than two years before a renewal must be obtained, provided that, if a
lender's gaming license is revoked or not renewed, reasonable
arrangements may be made with regard to payment of any balance due tc
that lender so as to not impose undue hardship on the Tribe,
provided that reasonable attempts shall be made to avoid ongoing
conflicts with any licensing standard herein. A gaming resource
supplier who provides financing in connection with the sale or lease
of gaming resources obtained from that supplier may be licensed
solely in accordance with licensing procedures applicable, if at all,
to gaming resource suppliers. The Tribal gaming agency may, at its
discretion, exclude, from the licensing requirements of this section,
financing provided by a federally regulated or state -regulated bank,
savings and loan, or other lending institution, a federally
recognized tribal government or tribal entity thereof, or any agency
of the federal, state, or local government.
Sec. 6.4.7. Processing Tribal Gaming License Applications. Each
applicant for a Tribal gaming license shall submit the completed
application along with the required information and an application
fee, if required, to the Tribal gaming agency in accordance with the
rules and regulations of that agency. At a minimum, the Tribal
gaming agency shall require submission and consideration of all
information required under IGRA, including Section 556.4 of Title 25
of the Code of Federal Regulations, for licensing primary management
officials and key employees. For applicants who are business

entities, these licensing provisions shall apply to the entity as
well as: ( i ) each of its officers and directors; (ii) each of its
principal management employees, including any chief executive
officer, chief financial officer, chief operating officer, or general
manager; (iii) each of its owners or partners, if an unincorporated
business; (iv) each of its shareholders who owns more than 10 percent
of the shares of the corporation, if a corporation; and (v) each
person or entity (other than a financial institution that the Tribal
gaming agency has determined does not require a license under the
preceding section) that has provided financing in connection with any
gaming authorized under this Gaming Compact, if that person or
entity provided more than 10 percent of (a) the start-up capital, (b)
the operating capital over a 12 -month period, or (c) a combination
thereof. For purposes of this section, where there is any
commonality of the characteristics identified in clauses ( i ) to (iv),
inclusive, between any two or more entities, those entities may be
deemed to be a single entity. Nothing herein precludes the Tribe or
Tribal gaming agency from requiring more stringent licensing
requirements.
Sec. 6.4.8. Background Investigations of Applicants. The Tribal
gaming agency shall conduct or cause to be conducted all necessary
background investigations reasonably required to determine that the
applicant is qualified for a gaming license under the standards set
forth in Section 6.4.3, and to fulfill all requirements for licensing
under IGRA, the Tribal gaming ordinance, and this Gaming Compact.
The Tribal gaming agency may not issue a license until a
determination is made that those qualifications have been met. In
lieu of completing its own background investigation, and to the
extent that doing so does not conflict with or violate IGRA and the
Tribal gaming ordinance, the Tribal gaming agency may rely on a State
certification of nonobjection previously issued under a Gaming
Compact involving another tribe, or a State gaming license previously
issued to the applicant, to fulfill some or all of the Tribal gaming
agency's background investigation obligation. An applicant for a
Tribal gaming license shall be required to provide releases to the
State gaming agency to make available to the Tribal gaming agency
background information regarding the applicant. The State gaming
agency shall cooperate in furnishing to the Tribal gaming agency that
information, unless doing so would violate any agreement the State
gaming agency has with a source of the information other than the
applicant, or would impair or impede a criminal investigation, or
unless the Tribal gaming agency cannot provide sufficient safeguards
to assure the State gaming agency that the information will remain
confidential.
Sec. 6.4.9. Temporary Licensing. Notwithstanding anything herein
to the contrary, if the applicant has completed a license
application in a manner satisfactory to the Tribal gaming agency, and
that agency has conducted a preliminary background investigation,
and the investigation or other information held by that agency does
not indicate that the applicant has a criminal history or other
information in his or her background that would either automatically
disqualify the applicant from obtaining a license or cause a
reasonable person to investigate further before issuing a license, or
is otherwise unsuitable for licensing, the Tribal gaming agency may
issue a temporary license and may impose such specific conditions
thereon pending completion of the applicant's background
investigation as the Tribal gaming agency in its sole discretion
shall determine. Special fees may be required by the Tribal gaming
agency to issue or maintain a temporary license. A temporary license
shall remain in effect until suspended or revoked, or a final
determination is made on the application. At any time after issuance
of a temporary license, the Tribal gaming agency may suspend or
revoke it in accordance with Sections 6.5.1 and 6.5.5, and the State

gaming agency may request suspension or revocation in accordance with
subdivision (d) of Section 6.5.6.
Sec. 6.5. Gaming License Issuance. Upon completion of the
necessary background investigation (including any reliance in whole
or in part on a State certification of nonobjection, or a State
gaming license under Section 6.4.8), receipt and review of such
further information as the Tribal gaming agency may require, and as
to applicants who are not Tribal members, actual or constructive
receipt by the Tribal gaming agency of a certificate of nonobjection
by the State gaming agency, and payment of all necessary fees by the
applicant, the Tribal gaming agency may issue a license on a
conditional or unconditional basis. Nothing herein shall create a
property or other right of an applicant in an opportunity to be
licensed, or in a license itself, both of which shall be considered
to be privileges granted to the applicant in the sole discretion of
the Tribal gaming agency.
Sec. 6.5.1. Denial, Suspension, or Revocation of Licenses. Any
application for a gaming license may be denied, and any license
issued may be revoked, if the Tribal gaming agency determines that
the application is incomplete or deficient, the applicant is
determined to be unsuitable or otherwise unqualified for a gaming
license, or the State objects to the issuance of that license
pursuant to subdivision (c) of Section 6.5.6. Pending consideration
of revocation, the Tribal gaming agency may suspend a license in
accordance with Section 6.5.5. All rights to notice and hearing
shall be governed by Tribal law, as to which the applicant will be
notified in writing along with notice of an intent to suspend or
revoke the license.
Sec. 6.5.2. Renewal of Licenses; Extensions; Further
Investigation. In the event a licensee has applied for renewal prior
to expiration of a license and the Tribal gaming agency has, through
no fault of the applicant, been unable to complete the renewal
process prior to that expiration, the license shall be deemed to be
automatically extended until formal action has been taken on the
renewal application or a suspension or revocation has occurred.
Applicants for renewal of a license shall provide updated material as
requested, on the appropriate renewal forms, but, at the discretion
of the Tribal gaming agency, may not be required to resubmit
historical data previously submitted or that is otherwise available
to the Tribal gaming agency. At the discretion of the Tribal gaming
agency, an additional background investigation may be required at any
time if the Tribal gaming agency determines the need for further
information concerning the applicant's continuing suitability or
eligibility for a license.
Sec. 6.5.3. Identification Cards. The Tribal gaming agency shall
require that all persons who are required to be licensed shall wear,
in plain view at all times while in the gaming facility,
identification badges issued by the Tribal gaming agency.
Identification badges must include information including, but not
limited to, a photograph and an identification number, which is
sufficient to enable agents of the Tribal gaming agency to readily
identify the employees and determine the validity and date of
expiration of their license.
Sec. 6.5.4. Fees for Tribal License. The fees for all tribal
licenses shall be set by the Tribal gaming agency.
Sec. 6.5.5. Suspension of Tribal License. The Tribal gaming
agency may summarily suspend the license of any employee if the
Tribal gaming agency determines that the continued licensing of the
person or entity could constitute a threat to the public health or
safety or may be in violation of the Tribe's licensing standards.
Any right to notice or hearing in regard thereto shall be governed by
Tribal law.
Sec. 6.5.6. State Certification Process. (a) Except for enrolled

members of a federally recognized California tribe,, who shall be
licensed exclusively by the Tribe, upon receipt of a completed
license application and a determination by the Tribal gaming agency
that it intends to issue the earlier of a temporary or permanent
license, the Tribal gaming agency shall transmit to the State gaming
agency a copy of all Tribal license application materials together
with a set of fingerprint cards, a current photograph, and such
releases of information, waivers, and other completed and executed
forms as have been obtained by the Tribal gaming agency, unless the
State gaming agency waives some or all of those submissions, together
with a notice of intent to license that applicant. Additional
information may be required by the State gaming agency to assist it
in its background investigation, provided that such State gaming
agency requirement shall be no greater than that which is typically
required of applicants for a State gaming license in connection with
nontribal gaming activities and at a similar level of participation
or employment. The State gemming agency and the Tribal gaming agency
(together with Tribal gaming agencies under other Gaming Compacts)
shall cooperate in developing standard licensing forms for Tribal
gaming license applicants, on a statewide basis, that reduce or
eliminate duplicative or excessive paperwork, which forms and
procedures shall take into account the Tribe's requirements under
IGRA and the expense thereof.
(b) Temporary License Objection. The State gaming agency shall
notify the Tribal gaming agency as promptly as possible if it has an
objection to the issuance of a temporary license, but the Tribal
gaming agency may not be required to await objection or nonobjection
by the State gaming agency in issuing a temporary license. Any
objection shall be made in good faith, and shall be given prompt and
thorough consideration in good faith by the Tribal gaming agency.
Nothing herein prevents the State gaming agency from at any time
requesting suspension or revocation of a temporary license pursuant
to subdivision (d) of Section 6.5.6. Any dispute over the issuance
of a temporary license shall be resolved in accordance with the
procedures set forth in Section 9.0.
(c) Background Investigations of Applicants. Upon receipt of
completed license application information from the Tribal gaming
agency, the State gaming agency may conduct a background
investigation to determine whether the applicant is suitable to be
licensed in accordance with the standards set forth in Section 6.4.3.
The State gaming agency and Tribal gaming agency shall cooperate in
sharing as much background information as possible, both to maximize
investigative efficiency and thoroughness and to minimize
investigative costs. Upon completion of the necessary background
investigation or other verification of suitability, the State gaming
agency shall issue a notice to the Tribal gaming agency certifying
that the State has no objection to the issuance of a license to the
applicant by the Tribal gaming agency ("certification of nonobjection"
), or that it objects to that issuance. If notice of objection is
given, a statement setting forth the grounds for the objection shall
be forwarded to the Tribal gaming agency together with the
information upon which the objection was based, unless doing so would
violate a confidentiality agreement or compromise a pending criminal
investigation. If a notice of objection or a certificate of
nonobjection is not received by the Tribal gaming agency within 90
days of the first receipt by the State gaming agency of the
application information and intent to issue a temporary or permanent
license, as provided herein, the State gaming agency shall be deemed
to have issued a certificate of nonobjection.
(d) Grounds for Requesting Tribal License Revocation or Suspension
or Denying State Certification of Nonobjection. The State gaming
agency may revoke a State certification of nonobjection if it
determines at any time that the applicant or license holder does not

meet the standards for suitability set forth in Section 6.4.3. Upon
the Tribal gaming agency's receipt of notice of that action, it shall
immediately and in good faith consider the action of the State
gaming agency and, if the circumstances warrant it, take action to
suspend or revoke the licensee's Tribal license, unless within seven
days of receipt of that notice it has notified
the State gaming agency that good cause
exists to defer taking that action, including the need for further
investigation. Disputes regarding the action taken or not taken in
response to the State gaming agency request shall be resolved
pursuant to Section 9.0. If at any time the State gaming agency
becomes aware of information that would constitute good cause to deny
or revoke the Tribal license of any person, including members of
federally recognized Indian tribes in California who are exempt from
the State review process, it shall convey that information to the
Tribal gaming agency promptly after being made aware of that
information, and may request that appropriate action be taken by the
Tribal gaming agency as to that person.
Sec. 6.5. Licenses Required. A person may not be employed by, or
act as a gaming resource supplier to, any gaming activity or facility
of the Tribe unless that person, if required to be licensed, has
obtained all licenses required hereunder.
Sec. 7.0. TRIBAL ENFORCEMENT OF GAMING COMPACT PROVISIONS
Sec. 7.1. On -Site Regulation. It is the responsibility of the
Tribal gaming agency to conduct on --site gaming regulation and control
in order to enforce the terms of this Gaming Compact, IGRA, and the
Tribal gaming ordinance with respect to gaming operation and facility
compliance, and to protect the integrity of the gaming activities,
the reputation of the Tribe and the gaming operation for honesty and
fairness, and the confidence of patrons that tribal government gaming
in California meets the highest standards of regulation and internal
controls. To meet those responsibilities, the Tribal gaming agency
shall adopt regulations, procedures, and practices as set forth
herein.
Sec. 7.2. Investigation and Sanctions. The Tribal gaming agency
shall investigate any reported violation of this Gaming Compact and
shall require the gaming operation to correct the violation upon such
terms and conditions as the Tribal gaming agency determines are
necessary. The Tribal gaming agency shall be empowered by the Tribal
ordinance to impose fines or other sanctions within the jurisdiction
of the Tribe against gaming licensees or other persons who interfere
with or violate the Tribe's gaming regulatory requirements and
obligations under IGRA, the Tribal gaming ordinance, or this Gaming
Compact. The Tribal gaming agency shall report continued violations
or failures to comply with its orders to the State gaming agency,
provided that the continued violations and compliance failures have
first been reported to the Tribe and no corrective action has been
taken within a reasonable period of time.
Sec. 7.3. Assistance by State Gaming Agency. If requested by the
Tribal gaming agency, the State gaming agency shall assist in any
investigation initiated by the Tribal gaming agency and provide other
requested services to ensure proper compliance with this Gaming
Compact. The State shall be reimbursed for its reasonable costs of
that assistance provided that it has received approval from the Tribe
in advance for those expenditures.
Sec. 7.4.- Access to Premises by State Gaming Agency;
Notification; Inspections. Notwithstanding that the Tribe has the
primary responsibility to administer and enforce the regulatory
requirements, the State gaming agency shall have the right to inspect
the Tribe's gaming facilities with respect to class III gaming
activities only, and all gaming operation or facility records
relating thereto, subject to the following conditions:

Sec. 7.4.1. Inspection of public areas of a gaming facility may
be made at any time without prior notice during normal gaming
facility business hours.
Sec. 7.4.2. Inspection of private areas of a gaming facility not
accessible to the public may be made at any time during normal gaming
facility business hours, immediately after the State gaming agency's
authorized inspector notifies the Tribal gaming agency and gaming
facility management of his or her presence on the premises, presents
proper identification, and requests access to the nonpublic areas of
the gaming facility. The Tribal gaming agency, in its sole
discretion, may require an employee of the gaming facility or the
Tribal gaming agency to accompany the State gaming agency inspector
at all times that the State gaming agency inspector is on the
premises of a gaming facility. If the Tribal gaming agency imposes
such a requirement, it shall require such an employee of the gaming
facility or the Tribal gaming agency to be available at all times for
those purposes.
Sec. 7.4.3. Inspection and copying of gaming operation records
may occur at any time, immediately after notice to the Tribal gaming
agency, during the normal hours of the facility's business office,
provided that the inspection and copying of those records may not
interfere with the normal functioning of the gaming operation or
facility. Notwithstanding any other provision of the law of this
State, all information and records, and copies thereof, that the
State gaming agency obtains, inspects, or copies pursuant to this
Gaming Compact shall be and remain the property solely of the Tribe,
and may not be released or divulged for any purpose without the Tribe'
s prior written consent, except that the production of those records
may be compelled by subpoena in a criminal prosecution or in a
proceeding for violation of this Gaming Compact without the Tribe's
prior written consent, and provided further that, prior to the
disclosure of the contents of any such records, the Tribe shall be
given at least 10 court days' notice and an opportunity to object or
to require the redaction of trade secrets or other confidential
information that is not relevant to the proceeding in which the
records are to be produced.
Sec. 7.4.4. Whenever a representative of the State gaming agency
enters the premises of the gaming facility for any such inspection,
that representative shall immediately identify himself or herself to
security or supervisory personnel of the gaming facility.
Sec. 7.4.5. Any person associated with the State gaming agency
who is expected to have access to nonpublic areas of the gaming
facility shall first be identified to the Tribal gaming agency as so
authorized, and following a sufficient period of time for the Tribal
gaming agency to conduct a reasonable inquiry into the person's
character and background, and to grant approval to that person's
presence, which approval may not be unreasonably withheld.
Sec. 8.0. RULES AND REGULATIONS FOR THE OPERATION AND MANAGEMENT
OF THE TRIBAL GAMING OPERATION
Sec. 8.1. Adoption of Regulations for Operation and Management;
Minimum Standards. In order to meet the goals set forth in this
Gaming Compact and required of the Tribe by law, the Tribal gaming
agency shall be vested with the authority to promulgate, at a
minimum, rules and regulations governing the following subjects, and
to ensure their enforcement in an effective manner:
Sec. 8.1.1. The enforcement of all relevant laws and rules with
respect to the gaming operation and facility, and the power to
conduct investigations and hearings with respect thereto and to any
other subject within its jurisdiction.
Sec. 8.1.2. The physical safety of gaming operation patrons,
employees, and any other person while in the gaming facility.
Sec. 8.1.3. The physical safeguarding of assets transported to,

within, and from the gaming facility.
Sec. 8.1.4. The prevention of illegal activity from occurring
within the facility or with regard to the gaming operation,
including, but not limited to, the maintenance of employee procedures
and a surveillance system as provided below.
Sec. 8.1.5. The detention of persons who may be involved in
illegal acts for the purpose of notifying appropriate law enforcement
authorities.
Sec. 8.1.6. The recording of any and all occurrences within the
gaming facility that deviate from normal operating policies and
procedures (hereafter "incidents") . The procedure for recording
incidents shall (1) specify that security personnel record all
incidents, regardless of an employee's determination that the
incident may be immaterial (all incidents shall be identified in
writing); (2) require the assignment of a sequential number to each
report; (3) provide for permanent reporting in indelible ink in a
bound notebook from which p4ages cannot be removed and in which
entries are made on each side of each page; and (4) require that each
report include, at a minimum, all of the following:
(a) The record number.
(b) The date.
(c) The time.
(d) The location of the incident.
(e) A detailed description of the incident.
(f) The persons involved in the incident.
(g) The security department employee assigned to the incident.
Sec. 8.1.7. The establishment of employee procedures designed to
permit detection of any irregularities, theft, cheating, fraud, or
the like.
Sec. 8.1.8. Maintenance of a list of persons barred from the
gaming facility who, because of their past behavior, criminal
history, or association with persons or organizations, pose a threat
to the integrity of the gaming activities of the Tribe or to the
integrity of regulated gaming within the State.
Sec. 8.1.9. The conduct of an audit of the gaming operation, not
less than annually,' by an independent certified public accountant, in
accordance with the auditing and accounting standards for audits of
casinos of the American Institute of Certified Public Accountants.
Sec. 8.1.10. Submission to and prior approval from the Tribal
gaming agency of the rules and regulations of each class III game to
be operated by the Tribe, and of any changes in those rules and
regulations. No class III game may be played that has not received
Tribal gaming agency approval.
Sec. 8.1.11. Maintenance of a copy of the rules, regulations, and
procedures for each game as presently played, including, but not
limited to, the method of play and the odds and method of determining
amounts paid to winners. Information regarding the method of play,
odds, payoff determinations, and player pool balances shall be
visibly displayed or available to patrons in written form in the
gaming facility. Betting limits applicable to any gaming station
shall be displayed at that gaming station. In the event of a patron
dispute over the application of any gaming rule or regulation, the
matter shall be handled in accordance with the Tribal gaming
ordinance and any rules and regulations promulgated by the Tribal
gaming agency.
Sec. 8.1.12. Maintenance of a closed-circuit television
surveillance system consistent with industry standards for gaming
facilities of the type and scale operated by the Tribe, which system
shall be approved by, and may not be modified without the approval
of, the Tribal gaming agency. The Tribal gaming agency shall have
current copies of the gaming facility floor plan and closed-circuit
television system at all times, and any modifications thereof first
shall be approved by the Tribal gaming agency.

industry standards for such facilities.
Sec. 8.1.14. A description of minimum staff and supervisory
requirements for each gaming activity to be conducted.
Sec. 8.1.15. Regulations specific to technical standards for the
operation of Tribal gaming terminals and other games authorized
herein to be adopted by the Tribe, which technical specifications may
be no less stringent than those approved by a recognized gaming
testing laboratory in the gaming industry.
Sec. 8.2. Criminal Jurisdiction. Nothing in this Gaming Compact
affects the criminal jurisdiction of the State under Public Law 280
(18 U.S.C. Sec. 1162) or IGRA, to the extent applicable, provided
that no gaming activity conducted in compliance with this Gaming
Compact and the Act may be deemed to be a civil or criminal violation
of any law of the State. Except as otherwise provided herein, to
the extent the State contends that a violation of this Gaming Compact
or any law of the State regarding the regulation or conduct of
gambling has occurred at or `in relation to the Tribe's gaming
operation or facility, the violation shall be treated solely as a
civil matter to be resolved pursuant to Section 9.0.

I have been informed that the Office of the State Fire Marshal (OSFM) is working
with the Governor's Office regarding the compact with Indian Casinos throughout the
state. The OSFM involvement is limited to fire prevention of the structures, water
supply, and access. Many of these casino facilities have agreements with local fire
agencies for fire'protection. In some -cases, the Department of Forestry and Fire
Protection may be the entity providing the local agency fire protection services.
It has been requested by the State Fire -Marshal that if any of our units are
interacting, either from a state or local perspective, with tribes or casino representatives
regarding fire protection requirements, that this be coordinated through the OSFM.

We are in receipt of a memo dated September 24, 2002, from Chief of Fire Protection
Jim Wright. This memo is in reference to notifying you of interactions with tribes or
casinos regarding fire protection requirements. We have been interacting with two
casinos: Feather Falls Casino, which is sponsored by the Mooretown Rancheria, and
the Gold Country Casino, which is sponsored by the Tyme Maidu Rancheria.
In the case of the Feather Falls Casino, their facility recently expanded approximately
120,000 square feet and we had fairly good cooperation during the construction process.
However, there were no pre -construction Environmental Impact Reviews and we have
an ongoing issue with a part of their sprinkler system.
In the case of Gold Country Casino, we reviewed the Environmental Impact Statement
that they developed as part of their plan to build a seven -story hotel casino expansion. It
is our understanding that they are set to start construction very soon.
What additional information do you need to assist with this project? We are actively
engaged at the County level (Butte County) attempting to get some control over the
activities taking place at these facilities. Any assistance you can provide will be greatly
appreciated.

Dave stated he attended one or more classes pertaining to "Indian Lands", which include any and all future land
bought and incorporated into the "Indian Lands" whether connected or unconnected.
The class was taught by an American Indian lawyer and clearly pointed to the problems facing everyone who has
the need to regulate, advise, and or assist in making fire and life safety as safe as possible on "Indian Lands".
I would suggest you contact Dave at Glenn County Sheriffs Office and determine for yourself if this class would
be of benefit to your dealings with "Indian Lands" in Butte County.

Re: Draft Environmental Review for the Proposed Gold County Casino Expansion and
Hotel project and Findings of No Significant Impact
Dear Mr. Edwards:
After review of the Draft Environmental Review for the proposed Gold County Casino Expansion
and Hotel project located on the Berry Creek Rancheria, the County of Butte feels that the
Environmental Review is inadequate in that it does not address several important health and safety
aspects. Additionally, the proposed project would have a significant financial impact on County
services.
1. The Butte County Public Works Department states that the Draft Environmental Review
significantly understates the problems created by the proposed casino/hotel facility. The
most significant impact is traffic. To assume that the casino/hotel facility will only
generate 150 cars per day (300 ADT, page 41), entering and leaving the facility is
seriously understated. The hotel component alone would generate an estimated 1,081
vehicle trips if all the rooms were occupied (Institute of Transportation Engineers' Trip
Generation (6`h Edition). Additionally, the traffic estimate of 16,000 ADT for Olive
Highway is substantially greater than the 2001 Caltrans counts of 12,300 ADT for
Highway 162 at Oroville Quincy Highway, which is 1,550 feet east of Thyme Way.
While the Tribe has offered to pay the cost of the access road and other improvements,
including a traffic signal at this new intersection, at an estimated cost of $350,000, this
will not mitigate all the traffic impacts related to the existing development, let alone the
proposed development. Also it appears the Tribe retracts its offer on page 49, wherein

the author states, "Given the costs of needed roadway improvements, the County of
Butte and Tribe will actively seek State and federal funds to construct needed
improvements." Therefore it is unclear what the Tribe intends to do to mitigate its
traffic impacts, which are much greater than a signal at the intersection. The County of
Butte requests that a full traffic study be accomplished by the Tribe to define their
current and proposed traffic impacts and appropriate mitigations.

2. There are severe flooding problems downstream of the Tribe property in this drainage
basin and thep roject would have a significant impact on storm water drainage. The
detentionp and described on page 20 does not comply with County Standards in that it
does not contain the 100 -year storm flows. Based upon the information provided in the
Draft it cannot be determined whether or not this pond mitigates peak runoff
downstream to at or below predevelopment levels as required by County Standards.
Theand does not appear to be designed to mitigate the peak runoff from the casino,

bowling alley, parking lots or the proposed 103 -room hotel. The Tribe needs to mitigate
itseak runoff to at or below pre -development levels to not exacerbate existing flooding

problems. The County of Butte requests that the project provide for full containment of
excess runoff from a 100 -year event.
3. The project would have a significant impact on Sheriffs Office resources. The Butte
County Sheriffs Office currently emends approximately 460 hours a year providing law
enforcement services to the Gold County Casino and Tyme Rancheria, at a cost of
$23,000. The Sheriffs Office expects that the project would result in an increase of 15%
in time spent with the addition of the hotel/casino complex. This amounts to
approximately 530 hours, at a cost of $26,500.
4. The County of Butte requests that a safety and emergency plan be developed for the
hotel/casino complex to facilitate response by local law enforcement for critical
incidents and that a service agreement be entered into wherein the County of Butte
would be reimbursed for direct and indirect costs associated with law enforcement
services. Additionally, the County of Butte requests that voter/repeater radio equipment,
antennas, cables, or other remedies be designed into the construction of the proposed
facility to allow uninterrupted law enforcement radio communications.
5. The Butte County Fire Department points out that there is no agreement between the
County and the Rancheria to provide fire or emergency medical services to the existing
facility. The Rancheria has been receiving free fire protection services. The Fire
Department requests that the Rancheria either develop its own fire fighting capabilities
or enter into a cooperative agreement with the Butte County Fire Department to provide
fire protection services to the facility.
6. The Fire Department recommends seven mitigation measures to address the impacts to
fire protection services that would be created by the proposed casino/hotel facility.
These mitigation measures are:
(1) The Rancheria is required by the Tribal -State Compact (Section 6.4.2(b)) to
adopt building and safety code standards identical to Butte County or adopt the
Uniform Building Code and all related codes. This requirement appears to have
been neglected in past construction.
(2) The current tent structures are connected by an unprotected passageway to the
portable buildings. Smoke from a fire in the portables could easily move into the

tent structures causing an extreme safety hazard. The proposal presented in the
draft environmental review does not indicate the final disposition of the
portables. Appropriate automatic fire doors are needed between the structures.
(3) The hydrant system serving the facility is currently inadequate, and with the
proposed construction the inadequacy may increase. The proposed hotel/casino
will have an estimated required fire flow of 5,300 gallons per minute. The current
available fire flow is about 3,800 gallons per minute. Several new hydrants and
water mains may be required to meet appropriate spacing and fire flow
requirements.
(4) As mentioned in the draft environmental statement, automatic sprinkler systems
will be required throughout the structure and special extinguishing systems will
be required in kitchens. The statement does not mention other types of required
construction standards such as fire department elevator control, standpipe
systems in stairwells, etc.
(5) The current casino is already the busiest call address in the Kelly Ridge area.
The Rancheria should pay for fire service through the Butte County Fire
Department. The cost of an agreement could be based upon one of several
different methodologies: cost per call; cost per year; or some combination of
costs representative of expenses. It is expected that the call load at the Rancheria
will increase significantly with the proposed construction.
(6) The proposed hotel/casino will be one of the tallest and largest buildings in the
unincorporated area of Butte County. The occupancy and height of the building
will create significant impacts upon the fire department. The Butte County Fire
Department does not own the equipment necessary to provide full fire protection
at a high-rise hotel. The mitigation measure for a high rise is for the Rancheriaa, to
purchase a ladder truck of a size and design as determined by the Butte County
Fire Department. In order to staff and house a ladder truck at the Kelly Ridge
Fire Station the Rancheria would also provide money for staffing and for
remodel at the fire station.
Access to all sides of all structures, tent casinos, bowling alley and high-rise
hotel must be developed to meet the fire department's requirements. This
includes adequate paving to allow the raising of aerial ladders at positions
predetermined by the fire department.
The County of Butte request that these mitigation measures be included in the Draft
Environmental Impact Report and that the Rancheria take affirmative steps to implement
these mitigation measures.
5. The proposed parking lot will create a significant aesthetic unpact. Trees should be
planted in the parking lots, both existing and proposed, to help soften the view and to
help reduce heat generated by the paved surfaces. All lighting in the parking lot should

be fully shielded to prevent glare and excess light. The County of Butte requests that
these issues be addressed in the Project.
In conclusion, the Draft Environmental Review is severely deficient, for the reasons stated above, in
addressing critical life -safety and environmental issues. The County of Butte wishes to be a good
neighbor to the Rancheria and supports the concept of the Project. However, as currently
contemplated, the Project will severely impact public safety services provided by the County of
Butte, at the expense of other taxpayers services, and will have serious environmental impacts
outside of the Rancheria boundaries. Therefore, until these issues are adequately addressed and
mitigated, the County of Butte cannot support the proposed casino/hotel. The department most
directly affected, and I, stand ready to meet with you and members of your project team to enable
these issues to be resolved. Please contact me at your earliest convenience.

Dear Folks:
On September 13, 1 met with the head of the Berry Creek Rancheria (Gold Country Casino), Jim Edwards. With him was
Francis Steele, the facilities manager. The meeting lasted 90 minutes.
Executive Summary
1. 1 had written a letter to Mr. Edwards detailing our concerns (not directly gelated to the new hotel) on hydrants,
FD costs, and building code inspection.
2. Mr. Edwards sent the letter to their law firm who helped write the original Tribal Compact with the State.
3. The lawyer says we are obligated to provide fire protection services.
4. The lawyer says the casino is not required to pay for those services.
5. The casino will work with OWID to get proper hydrant flows (however, we may not be involved to be sure it is
right).
6. Construction on the new high rise may begin in about one month.
7. The Rancheria has adopted the UBC standards (although I was not shown a copy of the resolution).
8. The lawyer says that the Rancheria may either adopt local building standards OR the UBC.
9. The bowling alley was not built to UBC standards (Russ Fowler convinced them to install sprinklers) as the
Tribal Compact only regulate gambling facilities.
10. The tent structures were not built to UBC standards (nor the portables) as they were built before the Tribal
Compact was signed. I'm not sure if this is true.
11. The Rancheria MAY allow us to inspect plans.
12. According to Public Law 280 (and their lawyer), State of California tribes are required to abide by State laws,
but they are not required to abide by local regulations.
13. The need for a ladder truck was discussed.
14. No money was offered.
15. Beginning in October of this year the casino is paying money to the State for use in defraying local
governement costs. Mr. Edwards said we could all pursue these funds (this could be a real cat fight).
(General comments:
Mr. Edwards was very polite and friendly, but I don't believe he made one significant commitment to anything. He
wanders a lot while talking, and it was quite difficult to keep the conversation progressing. He talked a whole lot about the
traffic signal that CalTrans finally approved on Olive Highway. We discussed fire protection in general for the County as
he was not aware of the CDF Fire relationship with the County.
told Mr. Edwards, at the end, that my vision was to provide public protection and that even if the lawyers and we could
not agree that the Rancheria would at least allow us to be integral for doing plan checking and inspections (even if only
for recommendations). Mr. Edwards did not commit to this but I will write an email to him requesting a set of plans ASAP.
I told him I thought it would be much more efficient for them to pay us the relatively cheap share of fire protection costs
(not including the need for a ladder truck). He did ask about the price of a ladder truck, and I advised him of additional
costs for storage, staffing, barracks, etc.
e bottom line is that the Rancheria will continue doing as it wants regardless of our needs and the draft Environmental
