Your facility meets the requirements of an "accessible" facility and there is no alarm requirement until you reach an occupancy of 50 or more persons and/or you utilize more than one classroom. BUTTE COUNTY FIRE DEPARTMENT Fire Prevention Bureau CALIFORNIA DEPARTMENT OF FORESTRY AND FIRE PROTECTION (530) 538-7888 GUIDELINES FOR DAY CARE CENTERS REQUIREMENTS The California State Department of Social Services/Community Care Licensing (CCL) requires a Fire Safety Inspection for day care centers. While processing a licensing application, CCL requests the clearance from the local fire department and within 30 days a fire inspector is sent out to do a pre -inspection. Once the prospective licensee completes the necessary requirements a final inspection is done. A $50.00 fee is required for the pre -inspection (Health and Safety Code 13235) for centers with 1-25 occupants. For centers with 26 + occupants the fee is $100.00. Only personal checks are accepted Please make them out to the Butte County Fire Department. PURPOSE It is the intent of this guideline to provide minimum requirements for day care centers. The purpose of the inspection is to ensure that the facility is free of fire and life safety hazards, and that it has proper and sufficient fire prevention devices/equipment, evacuation plans and escape routes. PROCESS The fire inspection can take 20-60 minutes depending on the size and condition of the center. If unsafe conditions are found approval will not be granted until these conditions are corrected. If, during a visit, the fire inspector notes possible building code violations, a County code enforcement officer will be notified. ZONING AND BUILDING PERMITS A fire clearance does not constitute zoning or building clearance. Butte County requires all Community Care licensed facilities to have a minor use permit. Contact Butte County Development Services (Planning) at 538-7601 for information. CONSTRUCTION REQUIREMENTS All references in BOLD are from the 2001 California Fire (CFC) and Building Codes (CBC). Croup E, Division 3 Any nonresidential building used for day-care purposes for more than six children/persons. Any residential building used for day-care purposes for more than 14 persons. ❑ Exterior walls must be 2 -hour less than 5 from property line, 1 -hour if less than 10 feet. Day Gazes having an occupant load of less than 20 (700 square feet) may have exterior walls as for R-3 occupancies (1 -hour less than 3 feet). (CBC Table 5-A) ❑ No openings are permitted in exterior walls within 5 feet of a property line; openings must be protected within 10 feet of property line. Day care facilities having an occupant load of 20 or less (700 square feet) may have opening protection as for an R-3 occupancy. (CBC Table 5-A) ❑ A 1 -hour occupancy separation is required between E-3 and B-2, R-1 and R-3 occupancies. (CBC Table 3-B) Administrative offices which do not exceed 25% of the floor area of the day care do not require separation. ❑ E-3 occupancies may be of any type of construction. (CBC Table 5-B) E-3 occupancies shall not be located above the first floor in non -rated construction. (CBC 305.) ❑ All buildings housing Group E occupancies shall front directly on a public street or have access to such a street by means of a 20 -foot -wide unobstructed access way maintained solely as access to the public street. At least one exit shall be located on the public street or access way. (CBC 305.3) ❑ A SFM listed and approved fire alarm system must be provided for all E-3 occupancies having an occupant load of more than 50 or containing more than one classroom. When more than one fire alarm control unit is used, they shall be interconnected and shall operate all indicating devices. E-3 occupancies having an occupant load of less than 50 shall be provided with an approved early -warning device.
