that includes horse boarding, horse riding, training clinics, individual
training, and a caretaker's residence. Use of the equestrian center would be
restricted to people boarding their horses at the facility, people attending
classes or training clinics, and participants and spectators at the special
events. No "drop-in" customers - people who want to rent a horse or people
who want to bring their own horse to the site and ride for the day - are
proposed. Up to 60 horses are proposed to be kept at the center: up to 45
horses boarded by their owners, and up to 15 horses owned by the applicant.
The equestrian center will provide horse boarding, arena riding, trail and open
range riding, competitive events, performance riding, training clinics, and
private lessons. Performance riding will include the use of cattle for team
penning and roping. The applicant intends to keep 30 to 50 head of cattle on
the property. The property is zoned "U" (Unclassified) and is located on the
west side of Messilla Valley Road, approximately 0.44 miles north of

SUGARY: Staff recommends approval of this project subject to the findings and conditions
contained herein.
PROJECT DESCRIPTION/SITE CHARACTERISTICS:
The site is currently developed with an 8,800 -square foot church, a 5,400 -square foot daycare
facility, and associated parking. The Use Permit request is to allow a 26,000 -square foot expansion
to the main church, 10,000 square feet of classroom space, a 14,200 -square foot gymnasium, a 2,000 -
square foot caretaker residence, an existing structure, and extensive outdoor recreation facilities
including three baseball fields, two basketball courts, and concessions stand. A total of 306
automobile parking spaces will be provided, as well as 10 bus parking spaces. The estimated
maximum occupancy of each structure is: church — 600, school — 435, Gymnasium — 800.
The existing church facility was developed under Use Permit 94-100, approved September 22, 1994.
Use Permit 94-100 allows a 20,000 -square foot church facility including six nurseries, four
classrooms, offices, and auditorium. A baseball field and football field were also approved as part
of the permit. Instead of developing a 20,000 -square foot structure, the church constructed an 8,800-

square foot main sanctuary building and associated detached classroom structures.
One caretaker residence is proposed on parcel 007-420-060 which is zoned SR -1 and no Use Permit
is needed for the residential use in the SR -1 zone. An existing structure located on the same parcel
will be used for the daycare facility. This structure was originally constructed as a grange hall and
has. been used for several purposes over the years. The last permitted use allowed in the building was
a children's theater group.
ANALYSIS:
Approximately 21 acres of the 25 -acre site is zoned Public/Quasi-Public (PQ). The balance of the
property is zoned Suburban Residential 1 -acre minimum parcel size (SR -1). The PQ zone allows
public uses by right and requires a Use Permit for quasi -public uses. The SR -1 zone also requires
a Use Permit for public and quasi -public uses. Churches are defined by the Zoning Ordinance as a
quasi -public use. The project is also within the North Chico Specific Plan (NCSP). The NCSP
zoning require that at least 5% of the entire site is devoted to landscaping and building coverage does
not exceed 60%. The proposed project meets these requirements.
When granting a Use Permit, the Planning Commission must make the findings that the proposed
use of the property will not impair the integrity and character of the zone in which the land lies, and
that the use would not be unreasonably incompatible with, or injurious to, surrounding properties
or detrimental to the health and general welfare of the persons residing or working in the
neighborhood or of the residents of the county.
The PQ zone allows by right a wide variety of public uses including schools, parks, hospitals,
libraries, recreation areas, and other public uses. The use of this site will not impair the integrity of
the zone because a church facility is very similar in operational characteristics as by -right uses
allowed in the zone and a church use, including classrooms, is already established on the site. This
permit will not change the character of the use but simply expand the size of the structures and,
consequently the intensity of use. Since the existing use has already been found to be compatible and
the site is physically capable to accommodate the expansion , the proposed use will not impair the
character or integrity of the PQ or the SR -1 zones.
The Chico Area Land Use Plan, adopted in 1982, shows the entire site as a Public land use
designation. The Public designation lists "quasi -public uses" as a secondary use. The proposed use
is, therefore, consistent with the uses envisioned for this area by the General Plan.
To make the findings that the use would not be unreasonably incompatible with, or injurious to,
surrounding properties or detrimental to the health and general welfare of the persons residing or
working in the neighborhood, the Commission should examine the existing and uses in the
surrounding area. The character of the surrounding area is a mixture of urban commercial and
industrial uses, and suburban residential uses. Commercial and industrial uses exist to the west and
south west of the site. Suburban uses with parcels averaging approximately 1 -acre in size exist to
the north and east.

The major compatibility issues with this project are: traffic, drainage, lighting, and construction -
related dust generation. These items will be discussed in this report, for a full discussion of all
potential impacts, the Initial Study is attached.
Traffic
The expansion of both the church and classroom facilities would result in an increase in traffic on
area roads. In particular, the intersection of Highway 99 and Garner Lane and the V4 mile section of
Garner from its intersection at Highway 99, north to the entrance of the church, will experience the
most impacts. Though the church will expand significantly in size, and presumably members, the
peak hour traffic for the church does not coincide with normal residential peak traffic generating
hours. The church traffic will, therefore, not impact the Level of Service (LOS) on the surrounding
roads. The school traffic, particularly morning traffic between 7:30 and 8:83 a.m., will coincide with
the peak hour traffic for the area roadways. At full build out, the morning peak -hour traffic will
reduce the LOS on Garner Lane from B to C. Level C is still, however, an acceptable level of
service consistent with the Butte County General Plan Circulation Element.
A left turn lane already exists on Garner Lane at the entrance to the church, a condition of the
previous Use Permit. The Department of Public Works has recommended additional improvements
be made to the left turn lane including increasing the storage capacity and the installation of raised
median for channelization. Overall, traffic impacts can be mitigated to an acceptable level and
mitigation measures and conditions.
Drainage
Because the project would be disturbing more than 5 acres of soil, a Construction Activities Storm
Water Permit would be required from the California Regional Water Quality Control Board. This
permit would address erosion and water quality issues related to site construction. Once completed,
the issue of runoff water quantity and quality should be addressed. The project proposes a paved
parking lot with room for 306 vehicles and 10 buses. Oils and other residues build up on paved
surface and can affect water runoff quality. The "first flush," represented by the first 1/2 inch of
rainfall, has the potential to have the highest contaminant levels. In order to reduced the water
quality impact to drainage courses and ultimately streams and rivers, treatment of the first flush
water is typically recommended. Treatment generally takes the form of on-site detention and
infiltration. The increase in impervious surfaces from new structures and paving areas would also
increase the volume of peak runoff flows and would reduce the time of concentration. This could
result in an increase in local flooding, off-site. To mitigate this impact, a drainage plan would be
required with a design to maintain peakflow runoff at or below current levels. A large detention
basin is shown on the applicant's site plan along the Highway 99 frontage.

It is anticipated that the church will install outdoor lighting for the structures and parking area, as well
as for the baseball fields. With an adjacent Highway and several residences in the area, night lighting
has the potential to distract motorists and impact neighbors' enjoyment of their property. Reducing
light and glaze from the project can be achieved through the thoughtful use of various light sources,

fixture design, and lighting location. For the parking lot and security, low-pressure lights represent the
best available type of lighting to reduce glare and conserve energy. In addition, the fixtures used
should be designed to shield direct light from spilling over onto the highway and surrounding
� residential parcels. With respect to the lights for the ball fields, a lighting plan would be required to
be submitted to the Butte County Department of Development Services prior to installation of the
lights. The design of the lighting system shall also incorporate measures to shield adjacent properties
from direct lighting. It is also recommended that the field lighting not be allowed past 10 pm. and that
the parking lot lighting be reduced to a minimum needed for security; the intent is to reduce overall
glare and energy consumption after 11:00 p.m.
Air Quality
Both the California Air Resources Board and the Environmental Protection Agency have established
air pollution standards in an effort to protect human health and welfare. Geographic areas are
designated as "attainment" if these standards are met and "non -attainment" if they are not met. In
addition, each agency has several levels of classifications based on the severity of the problem. Butte
County, and all northern Sacramento Valley Air Districts, are designated as "moderate" non -
attainment areas for the state standards for ozone (03) and fine particulate matter (PM 10). Currently,
Butte County is in attainment for all the federal (less stringent) air quality standards.
The project may result in a minor increase in vehicle emissions in the project area due to the vehicle
trips generated by people driving to and from the site. These emissions are not expected to be
significant within the air basin because the trips generated are essentially trips that would still occur
within the basin, just to other churches and schools.
Some fugitive dust emissions may occur during development activities on the site, which have the
potential to cause a significant impact to adjoining and nearby parcels. These fugitive dust emissions
have the potential to cause short term impact on nearby residents and to the overall air quality of
Butte County. The Butte County Air Quality Management District requests that measures, such as
site and driveway watering and/or use of other acceptable soil palliatives, be incorporated during
development activities on the site. A mitigation measure is recommended that requires measures be
taken to prevent fugitive dust emissions during development activities.
Long term, the project would have cumulative impacts resulting from energy consumption and the
pollutants generated on-site by heating systems and water heaters. In addition, utility emissions
associated with this project and other future development in the Northern Sacramento Valley Air Basin
would cumulatively contribute to existing regional pollutant levels. Though they represent a small
percentage of emissions, utility -related emissions would collectively contribute to existing and
projected future regional exceedances of State and Federal ambient air quality standards. The use of
energy efficient heating will help reduce this cumulative impact.

ACTIONS FOR CONSIDERATION:
i Staff recommends that the Planning Commission take the following actions:
I. Adopt a Mitigated Negative Declaration with the following findings:
A. An Initial Study was completed in compliance with the California Environmental
Quality Act identifying potentially significant environmental effects that the project
may have. Provisions and the design of the project and the conditions added to the
project will mitigate such effects to a level of insignificance; and
B. The planning Commission has independently reviewed, analyzed and considered the
proposed Negative Declaration with mitigation measures prior to making its decision
on the project, and the Negative Declaration reflects the independent judgment of the
County of Butte; and
II. This project will not have an impact to fish and/or wildlife habitat because the site does not
contain significant wildlife habitat and the property is located in an urban area with
surrounding development. Pursuant to Fish and Game Code Section 711.4(d)(3) and 14
CCR 753.5, Department of Fish and Game fees are not required and a de minimus exemption
to the collection of Department of Fish and Game Environmental Filing Fees is
recommended.
III. Approve Use Permit 01-22, subj ect to the conditions found in Exhibit "A" and subj ect to the
following findings:
A. The proposed uses of the property will not impair the integrity and character of the
zone in which the land lies, and that the use would not be unreasonably incompatible
with, or injurious to, surrounding properties or detrimental to the health and general
welfare of the persons residing or working in the neighborhood, or to the general
health, welfare and safety of the residents of the County as supported by the
following:
1. The site is already developed with a church use including classrooms. The
church has operated for the past 6 year without incompatibilities with the
neighborhood. The proposed project will not change the use of the site.
2. Expansion of the church and school facility will not significantly impact the
roadway serving the site. Peak trip generation of the facility does not
generally occur during normal peak -hour traffic times and the roadway has
the capacity to handle the additional traffic. Additionally, Condition
9requires additional improvements to be made to Garner Lane at the entrance
to the project site to mitigate traffic flow concerns.

3. The expansion of the church has the potential to create a new source of light
and glare in the area, but Conditions 1,2,3, and 4 requiring specific lighting
sources and fixture types to reduce glare and stray light address the impact.
4. Additional runoff generated by the facility will be detained on-site. The
design of the detention facility will include first -flush treatment for petroleum
and heavy metal contaminants.

Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below: Pleasant Valley Baptist Church is hereby granted a Use Permit in accordance with
application filed June 19, 2001.
1. Failure to comply with the conditions specified herein as the basis for approval of application
and issuance of Permit, constitutes cause for the revocation of said permit in accordance with
the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code
Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this use permit, all conditions must
be completed prior to or concurrently with the establishment of the granted use. The use
granted by this permit must be established within 24 months of the delivery of the
countersigned permit to the Permittee.
3. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public works upon receipt of a substantiated written request by
the applicant, or their respective designee, prior to such approval, verification shall be made
by each Department or Division that the modification is consistent with the application, fees
paid and environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment.
4. If any use for which a use permit has been granted is not established within two years of the
date of receipt of the countersigned permit by the Permittee, the permit shall become null and
void and reapplication and a new permit shall be required to establish the use.
5. The terms and conditions of this permit shall run with the land and shall be binding upon and
be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.

Conditions of Approval:
1. Submit with the building permit application, a lighting plan for the parking lot that utilizes
Low Pressure Sodium Vapor lighting. The lights shall incorporate a shielded design to keep
direct lighting on the project site. (Mitigation Measure)
2. Exterior lighting on the structures or for security shall be architecturally integrated with the
character of all structures, energy-efficient, and shielded or recessed so that direct glare and
reflections are confined, to the maximum extent feasible, within the boundaries of the site.
Exterior lighting shall be directed downward and away from adjacent properties and public
rights-of-way. Shielded shall mean that the light rays are directed onto the site and the light
source, whether bulb or tube, is not visible from an adjacent property. This section does not
apply to sign illumination, traffic safety lighting, or public street lighting. No permanently
installed lighting shall blink, flash, or be of unusually high intensity or brightness. Submit
to the Department of Development Services the type of exterior lighting fixtures to be used
prior to or concurrently with building permit applications. (Mitigation Measure)
3. Submit to the Department of Development Services a lighting plan for the baseball fields.
The lighting plan must show how lighting will be directed/shielded so that it will not impact
or distract traffic on Highway 99 or affect neighboring properties. (Mitigation Measure)
4. Outdoor lighting for the baseball field shall not be used past 10 pm. (Mitigation Measure)
5. Meet the requirements of the Butte County Indirect Source Review Guidelines including the
following:
a. During clearing, grading, ground disturbance or excavation operations, fugitive dust
emissions shall be controlled by regular watering, paving of construction roads, or
other dust preventative measures.
b. All material excavated or graded shall be sufficiently watered to prevent excessive
amounts of dust. Watering, with complete coverage, shall occur at least twice daily,
preferably in the late morning and after work is done for the day.
C. All clearing, grading, earth moving or excavation activities shall cease when winds
exceed 15 mph averaged over 1 hour.
d. The area disturbed by demolition, clearing, grading, earth moving, or excavation
operations shall be minimized at all times.
e. Portions of the construction site to remain inactive longer than a period of 3 months
shall be seeded and watered until grass cover is grown.
f. All on-site roads shall be paved as soon as feasible or watered periodically or
chemically stabilized.
g. Mud carried onto street surfaces by construction equipment shall be removed on a
daily basis.
h. Haul trucks shall be covered with tarpaulins or other effective covers at all times.

6. Strive to reduce energy consumption by:
a. Use of energy-efficient lighting (including controls) and process systems such as
water heaters, furnaces, and boiler units.
b. Use of energy-efficient and automated controls for air conditioning.
C. Incorporate shade trees, adequate in number and proportional to the project size,
throughout the project site to reduce building heating and cooling requirements.
(Mitigation Measure)
7. Should any archaeological artifacts be discovered during construction or excavation, the
Planning Division shall be notified immediately, and all work shall cease until a qualified
archaeologist has examined the artifacts and the site and submitted his or her findings to the
Planning Division, and recommended clearance to continue. Recommencement of
construction shall be upon the approval of the Planning Division. (Mitigation Measure)
8. The applicant shall prepare and submit a storm drainage plan for review and approval by the
Department of Public Works. Approval of the plan shall be based on criteria including, but
not limited to:
Incorporation of Best Management Practices (BMPs) such as grass or lawn filter strips,
infiltration trenches, oil/grease trap separators, and/or retention swales into the project
drainage design to intercept "first flush" contaminants from the initial %2 inch of rainfall for
each storm event prior to discharge off-site and to reduce storm water runoff pollutants
generated by the project to the maximum extent practical which satisfy water quality
protection goals. The system shall include reduction of suspended solids and reduction of
heavy metal concentrations by increasing infiltration time. The system shall also maintain
peak flow runoff at or below pr -development levels. The design and selection of BMPs shall
be based on site specific considerations such as geology, topography, and hydrology, in
addition to the type and size of the subject proposal. BMPs shall be included in
improvement plans or landscaping plans, whichever is applicable, for review and approval
by County staff. In addition, prior to issuance of building permits, the developer(s) shall
comply with any applicable requirements of the RWQCB. (Mitigation Measure)
9. Provide a left turn pocket at the entrance to the project with a storage length of a minimum
of 250 feet, excluding taper length. Acceleration and deceleration lanes should be provided
entering and exiting the project site. The acceleration lane towards SR 99 should be a
minimum of 300 feet in length plus taper, and the deceleration lane should be a minimum
of 375 feet plus taper. The channelization lines shall be raised concrete curb to create
medians, to help calm traffic in this area and provide additional safety. (Mitigation
Measure)
10. Under County permit, provide a sewage disposal system that meets Butte County
Environmental Health Division Standards for development in the Chico Urban Area.
11. All new facilities and structures must connect to a County -permitted community water
system.

12. Approval of this project is based upon a plan submitted to and received by the Butte County
Division of Environmental Health on July 3, 2001. Any changes to the plan must first be
submitted to the Butte County Division of Environmental Health for review an approval
prior to any construction.
13. Prior to any work within the right-of-way along Garner Lane for driveway improvements,
as required, obtain an encroachment permit from the Department of public works.
14. Prior to the issuance of building permits, a plan for a permanent solution for drainage shall
be submitted to and approved by the Department of Public Works. The drainage plans shall
specify how drainage waters shall be detained on site and or conveyed to the nearest natural
or publicly maintained drainage channel or facility and shall provide that there shall be no
increase in the peak flow runoff to said channel or facility. Pay appropriate drainage, plan
check, and inspection fees for the drainage facilities.
15. Prior to any soil disturbance activities, obtain a Construction Activities Storm Water Permit
from the California Regional Water Quality Control Board (RWCB). In addition, meet all
other requirements of the RWCB, including but not limited to the necessity for a de -watering
permit and a wastewater treatment and disposal permit.
16 Building Permits Required. Prepare 4 sets of construction plans and make an application
for permit. Construction shall comply with federal, state, and local regulations. Plans
shall be prepared, sealed and signed by a California Licensed Architect or Registered
Engineer for non-residential buildings and certain residential buildings.
17. All structures shall be made accessible to the disabled. Disabled accessible parking and
an accessible path of travel shall be provided.
18. Proposed improvements shall comply with Title 24 energy conservation regulations.
Appropriate compliance forms (two sets) shall be submitted indicating compliance with
those standards.
19. Proposed improvements shall comply with recorded map conditions applicable to
construction.
20. Development fees for the proposed residential or non-residential improvements shall be
paid prior to the issuance of building permits. The fees shall be those in effect at time of
application, and shall include, but not be limited to, School Fees, Park and Recreation
District fees, Water and Sewer Service Fees, Permit and Plan Check fees, and Fire
Protection Fees.

21. Construction, installation or development of structures or facilities on the parcels/lots
shall comply with the latest California Fire Safe Regulations, (Public Resources Code
4290), and all other applicable State and County codes, ordinances and regulations in
effect at the time of application for improvement permits.
22. Building identification and/or addresses shall be installed in conformance with Public
Resources Code 4290 and shall be posted at the beginning of building construction and
maintained continuously thereafter.
23. Fire hydrant identification, reflector or post reflectors shall be installed acceptable to the
County Fire Warden.
24. A pressurized community water system for fire protection is required. The specific
locations and fire flow requirements shall be in accordance with the Fire Department
specifications and to the satisfaction of the County Fire Warden. Average required
hydrant spacing 300 feet, hydrant size - 6 inches, and a residual fire flow to be determined
based on construction plans. Submit plans to the Fire Department for review and
approval prior to construction of facilities.
25. Provide an all weather access to all structures. The access shall have a minimum 10 foot
width and 15 foot vertical clearance, and be able to accommodate a 40,000 pound fire
apparatus.
26. Grant to the City of Chico an avigation easement for overflight from the Chico Municipal
Airport
27. Plant street trees along the Garner Lane frontage at 40 feet on center, in accordance with
the North Chico Specific Plan.
28. Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.

On Monday, July 29, the Butte County Fire Engine #41 did a pre -plan
inspection of your church. They found the electricity for the water pump
that charges the fire hydrants had been turned off. In the future, any time the
hydrant pump is shutoff for any reason, please call our Emergency
Command Center (ECC) at 538-6841. Also notify them when the system is
back in service. The ECC will immediately notify all the affected fire
stations by radio. It's a long run between the pump and the hydrants—time-
better

Also, Captain Ted Crawford asked me to remind you that the required
annual pump test results are overdue into his office. Please send them to him

I'm sorry I was not in the office on Tuesday, March 13'. 1 teach at a college in the Bay Area every
Tuesday. I certainly would have wanted to be there for your inspection. Allow me to respond to some of
the concerns listed on the copy of the enclosed report.
1. Yes, our address is posted on our front fence and is visible from the road.
2. On March 14, the day after the inspection, all of our auditoriurn chairs were set a minimum of 44"
from the sanctuary walls. Interior aisles were also at a minimum of 44".
3. On March 14, the three filing cabinets in the hallway leading to the secretary's office were
removed and put in the room with the water fountain.
4. On March 14, we had four extra copies of the fire alarm system keys made. They will be held by
the pastor and the two secretaries, and one will be kept in a lock box, so there is a key on site at
all times.
5. The photocopier was moved out of the hallway and placed into the office. Also all backpacks and
children's belongs were removed from the hallway.
6. On March 14, we checked all of our interior doors and made sure they were lubricated and would
completely close upon release.
7. Four luminous exterior signs were ordered on March 14, and are expected to arrive on March 21,
at which time they will be installed.
Thank you so much for the inspection. If you need a reinspection, that would be fine with us. If it would
at all be possible on a day rather than Tuesday, I would like to be there for the inspections. Thank you
so much for your help to keep this ministry a safer place for all.

1. Classification of the building is the critical first step in the effective use of the Uniform
Building Code. To an even greater degree, the proper determination of occupancy and type of
construction is the basis for all other code determinations. Provide a complete code analysis
for the entire building and include the mixed occupancy ratio. This analysis must include the
basic allowable floor area and the proposed floor area. The number of stories allowed and
proposed. Height in feet allowed and proposed. Allowable area increase's, occupant load, and
exiting requirements. Indicate any assumed property line and provide a composite for each

2. The D. S.A. approved plans are not clear and legible. Provide a clear and legible S-1 page. I
will need two additional sets of building plans including pages T-1, Al, A2, TS -1, & S-1.
I will also need two sets of fire alarms plans and specifications.
3. The deck construction details do not appear complete. Please indicate girder size and spacing
along with the joist size and spacing for non-residential loading requirements.
4. The existing restroom facilities will not be able to accommodate the additional occupant load
of the classrooms. The existing facilities will be adequate if the modular classrooms are
removed at the end of the 2001 school year. Please provide a letter of intent, on church
letterhead, indicating how long the classrooms will be at this location.
