They are often historic village homes or farms in beautiful country settings. The age aful character of these buildings and the occasional architectural whimsey create unique challenges in complying with modern fire and life safety standards. These codes are designed to protect visitors from the threat of fire and loss of life and should be an important consideration for any building owner. This brochure highlights fire and building code issues that you should be aware of and helps you get the information you need to provide an enjoyable and safe environment for your guests. Code Classifications The Vermont Department of Labor and Industry administers fire, electrical, and building codes as well as handicapped accessibility requirements in the state. The Department relies predominantly on national standards such as the National Fire Protection Association (NFPA) codes and the Americans with Disabilities Act (ADA). Although the Department relies on a consistent set of standards, there are many different classifications within these codes. For instance, fire safety requirements vary in stringency depending on the size of an inn. If you provide accommodation for 0-6 guests, 7 to 16, or more than 17 guests you will face an ascending level of requirements. Likewise, there are three different classifications based on the use and history of the building. These include existing occupancies, new occupancy/use in an existing building, or new construction. Inns that have operated for many years in the same location are usually classified as existing occupancies. This is the so called "grandfathering" provision. This category includes the least stringent requirements but still requires basic life safety features such as working smoke detectors and reasonable means of exiting the building in the event of fire. There are additional sets of criteria for renovations and new construction. If you are undertaking major renovations, putting on an addition, or putting up a new building you must submit the plans to your local regional office for review. The plan review fee is $4.50 per $1,000 valuation for new buildings and $3.75 per $1,000 valuation for structures built prior to 1983. You will receive a plan review letter informing you of any changes or required alterations. Plans should take no more than 30 days to review and generally take about two weeks. Your local office can provide you with any details about this process and can update you on the time frame for your plans. Finally, exhaust and fire protection requirements for kitchens are dependent on the types of equipment and cooking done, as well as numbers of meals served. It is important to keep these differences in mind. Historic Buildings If your inn is a historic building you might wish to obtain a copy of "Fire Prevention and Building Code Compliance for Historic Buildings: A Field Guide". The publication provides illustrated solutions to common life safety code compliance issues and is free of charge. It was prepared by the University of Vermont Graduate Program in Historic Preservation in cooperation with the Vermont Division for Historic Preservation and the Vermont Department of Labor and Industry. Inspection Reports Bed and Breakfasts are considered a high risk occupancy by the Department of Labor and Industry. All lodging establishments that have a transient population unfamiliar with their surroundings fall into the high risk category. This means that most of the larger existing bed and breakfasts have already been inspected by Labor and Industry staff. If you are unfamiliar with the regulatory history of the building you own or wish to buy you can obtain copies of all file information from the Department of Labor and Industry. Files are maintained at all of the regional offices. These are listed on the back of the brochure. If your inn has not been inspected recently it may be due for an inspection in the near .future. Your inn may also be inspected if a complaint about building safety or accessibility is forwarded to the Department. Prior to an inspection an Assistant Fire Marshal from your region will contact you and schedule a time to visit your building. An inn owner, manager, or representative may accompany the inspector on a tour of the building. Compliance Schedules If your building is inspected and found to have violations of fire and building codes, a compliance schedule will be set for all items. Some problems such as nonworking smoke detectors must be fixed immediately. Other issues can be resolved over a longer term. It is the Department's goal to assist you in meeting code requirements over a time period that meets life safety goals and that is manageable for owners. Handicapped Accessibility Depending on the type of building you own you may also need to comply with handicapped accessibility requirements. The .Americans with Disabilities Act does include special waivers for lodging establishments which are owner occupied and offer not more than 5 rooms. Please contact the Department if you have questions about these requirements. Variances You should be aware of the variance process. The variance process allows certain code requirements to be waived given an equivalent level of fire safety or accessibility is provided through alternate means. If you own a historic building you can seek a variance from the Historic Variance Board. Variances for newer buildings are granted by the Commissioner of Labor and Industry. The Department makes every effort to resolve these issues at the local level before proceeding with the formal process. The first step is to attempt to resolve issues with the Assistant Fire Marshal and then in collaboration with the Regional Manager. Electrical Work Notices If new electrical work is done at your building, the electrical contractor is required to file an electrical work notice with the Department. Working electricians are also required to hold the appropriate licenses. You may wish to check with your contractor to make sure the appropriate requirements have been met as their work will be inspected. There are two electrical inspectors in each regional office. You may contact the regional office to find out who is responsible for work in your area. Fire Protection Equipment Fire Protection Equipment includes fire alarm systems, sprinklers, and suppression systems on kitchen hoods. If you own a smaller bed and breakfast you might not be required to have some of these systems. All of this equipment should be regularly inspected by Technically Qualified Individuals certified by the Department of Labor and Industry. Kitchen hood suppression systems should be inspected every six months. Most other systems should be inspected annually. It is possible to obtain a list of all certified individuals from the Department. Before choosing to work with a particular company you might wish to shop around for both price and quality of service. Boilers Many buildings use hot water or steam boilers for the heating system. All commercial boilers are inspected annually. If you carry boiler/mechanical insurance, your boiler is inspected by an insurance company inspector. All other boilers are inspected by Labor and Industry. When a boiler is inspected a Proof of Inspection (POI) sticker is attached. Please check your boiler to make sure that it has a recent inspection sticker. There is a fee for each state boiler inspection. Plumbing The Department of Labor and Industry employs a plumbing inspector who makes random inspections of plumbing work being done in public buildings. The inspector also checks the licenses of any individuals doing plumbing work on site. If any new plumbing work is being done at your building you may receive a random inspection. Federal Hotel/Motel Safety Requirements The Federal government has certain safety requirements for lodging establishments. These standards must be met in order for federal employees to receive reimbursement for expenses. Generally the federal law has stricter requirements for certain existing buildings. For most new construction, meeting state requirements is acceptable. An S corporation avoids double taxation and payment of taxes at higher rates than personal taxes. If you are being charged on an hourly basis, advice on formation of a partnership and drafting the agreement usually costs $150 or more. The organization of a simple corporation, from the articles of incorporation through the first stockholders' and director's meeting, may cost $250 to $350, plus a filing fee of $50 to $100 to the Secretary of State. These charges normally include certain rebates, general advice, and counseling. Many attorneys do not charge for a call requiring only a quick response. However, there is likely to be a charge for questions requiring a long response or for several calls. Regulations or ordinances that can effect the operation of B&Bs are primarily in the areas of zoning, fire codes, and public health. To some degree, these regulations may be in effect at the municipal, county, and state governmental levels. When a regulation or ordinance exists at a higher government level, lower levels will often adopt the same policy. Keep in mind that ordinances in effect at lower levels are often more strict than those operating at higher levels. You should learn about the regulating details at all government levels by discussing your situation with the zoning administrator, fire marshal, and public health sanitarian Each state varies in regard to specific legislation for B&B operations. You may have to consult legislation pertaining to other types of housing or lodging to find out which laws apply to you. Zoning Normally, there are no zoning laws at the state level that would affect B&B businesses. At the county level, zoning laws generally apply to rural areas outside corporate limits. See Appendix R for examples of B&B - related zoning ordinances established in Galena, Illinois, and Warsaw, Indiana When reviewing zoning variance or change requests, administrators consider factors such as impact on the neighborhood and benefits and detriments, including any visual nuisance that might be caused by the enterprise. You should address these concerns in your request for a zoning change or variance. Also, try to meet the people in your neighborhood, as they will be notified of a zoning change and have an opportunity to appear at a public hearing on the proposed change. You should explain the benefits of having a B&B in the neighborhood and try to alleviate any of your neighbors' misgivings. If some are unsure about the establishment of a B&B, your neighbors could easily become polarized on the issue. Keep in mind that applying for a zoning variance takes time and will 33 require a public hearing. It may also cost money and require the help of an attorney. Fire Safety Local fire codes are often a direct function of the state fire code and of the area's building and zoning codes. Additional safety provisions may also be included in the state building code, these would be enforced in those communities where the state building code is in effect. The language in the codes is very derailed, often with several options given. All B&Bs should have smoke alarms, clearly marked exits, floor plans on display, and fire extinguishers visible and accessible. The fire codes identify other types of unsafe conditions including interior surface finishes that allow a quick spread of flame, improper storage of flammable materials, and attached garages without fire walls. The code requirements may differ according to the size of the operation. It is incumbent upon the B&B operator to see that the fire codes are met and the safety of the visitors is ensured. Licensing and Certificates Aside from zoning there may be concern with building codes, historic district regulations, liquor licenses, (laws and regulations), etc. Changing a home to a B&B in some states requires a new certificate of occupancy. Health Regulations Health regulations will vary from state to state and according to the size of your B&B and how the operation is zoned. Some states do not regulate the public health aspect of a B&B at all, while others have very specific laws requiring inspection before a license is issued. Periodic inspections may occur subsequently. Horses are kept on the parcel. • The project site is located in an area that is zoned A-20, and has a General Plan Land Use designation of Orchard and Field Crops. • Most of the surrounding parcels are 10 acres or less in size and are developed with single family dwelling units. • Existing agricultural uses on the surrounding parcels includes orchards, row crops, and field dwelling crops. The project site is located approximately 150 feet from the parcels to the g on the north and west, which currently consist of open, fallow fields. An orchard is located to the east of the site, which is located approximately 330 feet from the dwelling on the site. Another open, Now field is located on the parcel to the south of the site, and which is approximately 570 feet from the dwelling on the project site. • Nord Highway, which is a public road and is paved, is classified as a major arterial roadway. • The project site is not located within a 100 -year flood zone, an earthquake fault zone, or an i arport compatibility zone. ANALYSIS: • The A-20 zoning district allows a bed and breakfast home with approval of a Minor Use Permit (Butte County Code Section 24-90(d)(2)). The General Plan states that the Primary Use of the Orchard and Field Crops land use designation is agricultural. Secondary Uses include dwellings. • The impacts caused by the dwelling on the project site to the adjoining agricultural uses already exist, and the project is not expected to create any additional impacts. The Butte County Agricultural Commissioner's Office stated that the project would not have any significant impacts on agricultural uses. • The proposed bed and breakfast use would generate approximately 10 vehicle trips per occupied room. With all three bedrooms occupied approximately 30 vehicle trips per day would be generated due to the bed and breakfast use. The increase in vehicular traffic would be minor and would not cause any significant impacts to traffic circulation in the project area. • The proposed bed and breakfast use would cause a slight increase in noise in the project area. The additional vehicles entering and exiting the site would generate some noise, along with the increase in human activity on the site. Noise resulting from the construction of the 740 square foot addition to the dwelling may be heard off-site but would be short-term in nature. Bed and breakfast homes are usually quiet and generally do not create loud noises.
