In order for California DFW, a consulted agency on the monitoring plan, to be a party to this proceeding, it must have intervened pursuant to Rule 214 of the Rules of Practice and Procedure,5 not later than 30 days after issuance of the Order (September 15, 2025).6 California DFW did not intervene in this 1 Pacific Gas and Electric Company, 192 FERC ¶ 62,090 (2025) (Order). 2 California DFW Rehearing Request at 2. In substance, the pleading is a motion for a stay of the Order and is treated as such. See San Diego Gas & Elec. Co., 133 FERC ¶ 61,014, at P 15 (2010) (explaining that the Commission is “not obligated to accept a filing solely on the basis of its party-bestowed title. Instead, we examine the substance of the pleading.”). 3 16 U.S.C. § 825l. 4 18 C.F.R. § 385.713(b) (2025). 5 18 C.F.R. § 385.214 (2025). 6 Where public notice of a proceeding is not required, a motion or notice to intervene by a consulted agency will be considered timely if it is filed within the 30-day period for seeking rehearing of the order. Request for rehearing by the Commission of this rejection notice must be filed within 30 days of the date of issuance of this notice,as provided in section 313(a) of the Federal Power Act10 and section 385.713 of the Commission’s regulations.11 Debbie-Anne A. Reese, Secretary. 7 18 C.F.R. § 385.214 (2025). 8 However, this notice does not foreclose future modifications to the Monitoring Plan since the Commission reserved its authority “to require changes to the plan based on agency comments and monitoring data,”and the licensee could request an amendment as a result of further consultation with the agencies.
