NOTICE REJECTING REQUEST FOR REHEARING AND STAY
(October 15, 2025)
On August 15, 2025, Commission staff issued an order approving and
modifying Pacific Gas and Electric Company’s Foothill-Yellow-Legged Frog
Monitoring Plan for the DeSabla-Centerville Hydroelectric Project No. 803, located
on the Butte Creek, West Branch Feather River, and their tributaries in Butte County,
California.1 On September 15, 2025, the California Department of Fish and Wildlife
(California DFW)filed a request for rehearing of the Order and requested that the
Commission stay the Order for 60 days to allow further consultation.2
Under section 313(a) of the Federal Power Act3 and Rule 713(b) of the
Commission’s Rules of Practice and Procedure,4 only a party to the proceeding may
file a request for rehearing. In order for California DFW, a consulted agency on the
monitoring plan, to be a party to this proceeding, it must have intervened pursuant to
Rule 214 of the Rules of Practice and Procedure,5 not later than 30 days after issuance
of the Order (September 15, 2025).6 California DFW did not intervene in this

proceeding and thus is not a party.7 Therefore, California DFW’s request for
rehearing is rejected.8 Additionally, California DFW’s request for stay is rejected
because, under Rule 212(a)(2) of the Commission Rules of Practice and Procedure,
only parties may file motions in a proceeding.9
This notice constitutes final agency action. Request for rehearing by the
Commission of this rejection notice must be filed within 30 days of the date of
issuance of this notice,as provided in section 313(a) of the Federal Power Act10 and
section 385.713 of the Commission’s regulations.11
