On October 24, 2024, PG&E requested a “Pre-filing Meeting” with SWRCB staff, initiating the 30-day waiting period to file the amendment request. The meeting took place on December 5, 2024, during which the following amendments and plan revisions were discussed. The Forest Service, United States Fish and Wildlife Service (USFWS), and California Department of Fish and Wildlife (CDFW) were in attendance. PG&E filed an amendment request to the SWRCB for WQC Cond. 1, in addition to WQC Cond. 9, and an amendment request with the Forest Service for Section 4(e) Condition No. 23 on December 19, 2024. The Environmental Protection Act gives the SWRCB a full year to respond to PG&E’s amendment request. PG&E requested comments or concurrences from the SWRCB and the Forest Service by February 15, 2025, and received comments from the Forest Service on June 24, 2025 (Enclosure 1). The Forest Service stated that they are not ready to concur with the amendment request at this time. PG&E is awaiting SWRCB response to continue the discussion on the amendment and plan revisions. My staff have reviewed both the redlined and clean Condition No. 23 prepared and submitted by PG&E on December 19, 2024. It is my understanding that my staff and Kurt Sable, Pacific Southwest Region Hydroelectric Program Coordinator met with you on June 18, 2025 to discuss PG&E’s request. As we mentioned, the Forest Service is not ready to concur with this request at this time. The Poe Reach of the North Fork Feather River is critical habitat for the federally listed Foothill Yellow Legged Frog (FYLF) and this species is known to be very sensitive to flow fluctuations depending on the time of year. There are also temperature concerns for fish species in this reach. This is a fairly new license that was issued in 2018 when the potential listing of the frog was expected and considered in negotiations. Minimum instream flows, ramping rates, and notification procedures were examined closely. The notification periods in this amendment request are significantly shorter and preclude FERC’s involvement. The Forest Service is open to discuss the amendment further with PG&E. We believe some adjustments to Condition No. 23 are possible, but given the sensitivity of this reach, longer notification times are needed. The amendment also needs to consider US Fish & Wildlife consultation timelines and the amendment to the Water Quality Certification. We look forward to working with you on the continued management of the Poe Project and the important habitat along the North Fork Feather River.
