APN Acres Before LLA Resultant Parcel Acres After LLA  058-300-013 +/- 6.58 Lot A +/- 2.63  058-230-038 +/- 1.8 Lot B +/- 9.51  058-360-098 +/- 42.72 Lot C +/- 39.13  The parcels are located on the east side of Concow Road and north side of Ishi Trail approximately 16,587 feet east of Town of Paradise. The Butte County Public Works Department verified that all three lots were properly created. Surrounding parcels are zoned Foothill Residential (FR-5 and FR-10) and Public (P). The surrounding areas largely consist of residential uses and public use by the Butte County Volunteer Fire Station No. 38. APN 058-300-013 falls under General Plan land use designation Retail and Community Commercial (C-C) zoning. APN 058-300-013 has an existing home, barn, shop, two septic systems and three wells.. Lots in the C-C zone must maintain a 10,000 square foot parcel area minimum. APN 058-230-038 falls under General Plan land use designation Foothill Residential and Foothill Residential-5 acre minimum (FR-5) zoning. APN 058-230-038 has an existing home, and septic system. . Lots in this zone must maintain a 5 acre parcel area minimum. APN 058-360-098 falls under General Plan land use designation Foothill Residential and Foothill Residential-10 acre minimum (FR-10) zoning. APN 058-300-013 has an existing home, barn, septic system and well. Lots in this zone must maintain a 10 acre parcel area minimum. APN Zoning Parcel Minimums  058-300-013 C-C 10,000 square feet  058-230-038 FR-5 5 acres  058-360-098 FR-10 10 acres   Analysis The project would not result in the creation of any new parcels. The proposed lot line adjustment will reconfigure the three lots minimum acreages and bring APN 058-230-038 into compliance with the applicable FR-5 zone 5 acre parcel minimum. The project will maintain compliance with Zoning development standards as applicable to resultant lot respectively. CEQA Issues Applicable Rule: Categorical Exemption. This project is exempt from the requirements of the California Environmental Quality Act (CEQA) under Section 15305(a) of the CEQA Guidelines (Class 5). This exemption includes minor alterations in land use limitations with an average slope of 20 percent where the project would not result in any changes in land use or density, including minor lot line adjustments that do not result in the creation of any new parcels. Factual Reasoning & Analysis. Minor Alteration: The proposed lot line adjustment is a minute reconfiguration of the property lines for the three lots each of which has an average slope less than 20 percent. APN 058-300-013 has an average 8.75% slope, APN 058-230-038 has an average 7.5% slope and APN 058-360-098 has an average 9.76% slope. No change in use, density, or parcel creation: The resultant parcels would remain under the same zoning designations with the same existing uses continuing to occur on each, without affecting a change in use or density. Lastly, the project would not result in the creation of any new parcels. ACTIONS FOR CONSIDERATION: Staff recommends that the Director of Development Services take the following action: Find that the project is exempt from environmental review under Section 15305(a) of the California Environmental Quality Act (CEQA). A Class 5 exception consists of minor alterations in land use limitations in areas with an average slope of less than 20%, which do not result in any changes in land use or density, including but not limited to minor lot line adjustments, side yard, and setback variances not resulting in the creation of any new parcel. Approve the Lot Line Adjustment for Lot Line Adjustment Application LLA25-0009, subject to the Conditions of Approval in Exhibit A. EXHIBIT A CONDITIONS OF APPROVAL Moak Lot Line Adjustment LLA25-0009 APNs: 058-300-013, 058-230-038, and 058-360-098 Public Works 1. Deeds and plats (if required) with the appropriate checking fee shall be submitted to the Department of Public Works, Land Development Division for checking and approval prior to recordation and shall contain the notes specified below. 2. Provide documentation from a title company of the applicant's choice verifying that any deed of trust affected has been partially re-conveyed or modified to reflect the lot line adjustment and to prevent the creation of any additional lot or parcel. 3. Prior to recordation of deeds, provide documentation verifying payment of taxes as required by Subsection (d)(4)a. of Section 20-95.1 of the Butte County Code and as specified in Article 8 of Chapter 4 of Division 2 of Title 7 of the Government Code, commencing with Section 66492. Deed Note (To be placed on any deed to effect lot line adjustment) The purpose of this deed is to effect a lot line adjustment as approved by the Butte County Director of Development Services on ______________________. The above described lands are to be combined with and become a part of those lands as described in the deed to ________________________________ as filed for record in Butte County Official Records at Serial Number _____________ Book _____________ Page ___________. No additional lots or parcels are created hereby. The scope of review of said lot line adjustment was limited as specified in Government Code Section 66412(d), and approval of it does not constitute assurance that future applications for building permits or other land use entitlements on the modified lots or parcels will be approved by the County of Butte.
