Subject: Extension of Time for Additional Information - 2025 Amendment Requests and
Biological Monitoring Plan Revisions
Dear Ms. Maggard:
This is in response to your extension of time request, filed with the Federal Energy
Regulatory Commission (Commission) on November 10, 2025, for the Poe Hydroelectric
Project No. 2107.1 The project is located on the North Fork Feather River in Butte
County, California.
On August 13, 2025, we issued a letter containing a request for additional
information that would enable us to begin processing your June 2, 2025 request to amend
Section 401 Water Quality Certification (WQC) condition 1, 9, and U.S. Forest Service
(Forest Service) 4(e) condition 23, and to revise your Amphibian Monitoring Plan and
Poe Bypass Reach Fish and Benthic Macroinvertebrate Monitoring Plan. Your requests
require amendment to the license’s WQC issued by the California State Water Resources
Control Board (California SWRCB); concurrence from the Forest Service to amend their
4(e) condition 23; concurrence from the California SWRCB, Forest Service, California
Department of Fish and Wildlife, and U.S. Fish and Wildlife Service (FWS) regarding
revisions to the monitoring plans; and the completion of Endangered Species Act (ESA)
consultation resulting in a Section 7 document issued by the FWS, before the
Commission can act on your request.

Your extension of time request indicates that you applied for a WQC amendment
on December 19, 2024, and you explain that the California SWRCB is statutorily given
one year from the date of application to respond to your amendment request. Further,
you request more time, until June 30, 2026, to prepare the biological evaluation needed to
initiate consultation with the FWS regarding potential effects to ESA-listed species.
Your request also contains a formal response from the Forest Service, indicating that it is
not concurring with your amendment to its condition as proposed at this time; however,
that it is open to discussing alternative adjustments to 4(e) condition 23, if given more
time to analyze your request. The Forest Service also indicates that ESA consultation is
required to proceed, and its letter does not address the biological monitoring plan
revisions.
Based on your filing, the California SWRCB amendment should be issued by the
end of 2025, given the one-year response limit. In addition, the Forest Service does not
give its concurrence to amend its condition and therefore, more time is needed to consult
with them to come to a resolution. Considering these factors, it is reasonable to wait to
receive the approvals and/or possible modifications the resource agencies may require of
your proposed amendments, before initiating consultation with FWS so that the proposed
action presented to them is accurate. Thus, your request to delay the filing of the
California SWRCB’s WQC amendment approval, the Forest Service’s concurrence, and a
biological assessment to support ESA Section 7 consultation with the FWS until June 30,
2026, is reasonable. If your proposed amendment/plans are further modified from the
version presented in your June 2, 2025 filing, or if a resource agency amends its
mandatory conditions as part of its approval, please include an updated draft with the
revisions/conditions clearly marked as part of your filing. Agency concurrence with the
biological monitoring plan revisions should also be part of the filing.
Please provide the above information by June 30, 2026. The first page of any
filing should include the docket number associated with the topic of the filing. Due to the
complexity of your request, we will be considering your amendment requests of WQC
condition 1 and 9, and U.S. Forest Service Section 4(e) condition 23 under P-2107-067;
the revisions to the Poe Amphibian Monitoring Plan under P-2107-068; and the revisions
to the Poe Bypass Reach Fish and Benthic Macroinvertebrate Monitoring Plan under P-
2107-069. If a filing provides information for multiple subdockets, please indicate that
on the first page of any filing with the Commission.
