Subject: FORMAL GRIEVANCE: Violation of Marsy’s Law and Systemic Failure – Case #24-007133
To the Butte County Board of Supervisors, the District Attorney, and the California
Attorney General:
I am filing this formal grievance regarding the handling of a violent crime committed
against me on November 16, 2024, on Silver Dollar Way in Chico.
Case Information:
• Case Number: 24-007133 (Chico PD)
• Suspect: David Samuel Saunders
• Primary Charge: PC 245(a)(1) – Assault with a Deadly Weapon (Felony)
I am filing this grievance based on significant violations of my rights under Marsy’s Law
(California Constitution, Article I, § 28). Despite being the victim of a felony stabbing
that resulted in hospitalization, I have experienced a total absence of advocacy and
protection from the county.
I am formally alleging the following violations and policy failures:
1. Complete Failure to Advocate: Throughout this process, no agency has
advocated for my safety or my rights as a victim. I was left to navigate a
violent trauma alone, while the system prioritized the release of my attacker
over my basic right to security.
2. Violation of the Right to Protection: The decision to release a
violent offender who has made active threats against my life is a
direct failure of the mandate to ensure victim safety (Art. I, § 28(b)
(2)). I have been told "nothing can be done," which I believe
constitutes gross negligence.
3. Selective Justice & ADA Violations: The county's policy of
"selective justice" regarding mental health stabilization violates the
Equal Protection Clause and the Americans with Disabilities Act
(ADA). By failing to provide stabilization and reform for unstable
individuals, the county is creating a "state-created danger."
4. Notice of Liability: Please be advised that by ignoring these
threats and failing to uphold Marsy’s Law, the County of
Butte and the District Attorney’s office may be held
responsible for any future actions taken by David Samuel
Saunders against my person.
5. Failure to Confer: I was denied my right to confer with the
prosecuting agency regarding the pretrial disposition of this case or the
decision to decline filing (Art. I, § 28(b)(6)).
Request for Action:
• Immediate Advocacy: I request the immediate assignment of a Victim-Witness
Advocate who will actually uphold their duty to protect my interests.
• Formal Case Review: An immediate review of the decision to dismiss Case #24-
007133.
• Written Protection Plan: A formal explanation of how the county intends to
mitigate the threat posed by the suspect.
