Ladies and Gentlemen: The mine operator of the Pentz Pit (Mine No. 91-04-0001) previously submitted an application for a Minor Modification to amend the provisions of the Reclamation Plan (RP 78-99) to further address the range of historic mining operations on the site and related mine reclamation details. This Reclamation Plan amendment application had been referred to the Division of Mine Reclamation (DMR) for review, and DMR provided the County with a comment letter dated July 28, 2021, asking that additional information and clarifications be provided in the document. On March 14, 2022, the mine operator’s consultant, Compass Land, Inc., submitted a revised Reclamation Plan Amendment addressing DMR’s comments. The County reviewed the document resubmittal and found it was complete and acceptable. Therefore, Butte County approved the Minor Modification to the Pentz Pit Reclamation Plan, pursuant to the attached County approval letter dated May 26, 2022, as well the applicant’s letter of March 14, 2022 addressing changes made to the previous version of the Reclamation Plan Amendment. The project was approved with the findings that the minor modification would not result in a substantial deviation from the original reclamation plan approval, the goals and terms of the original reclamation plan will remain in effect, and that the project would not result in new significant environment impacts, or an substantial increase in previously identified environmental impacts.
