Existing parcel sizes are 11.48 acres (Parcel A) and 5.0 acres (Parcel B). The project proposes to transfer 0.61 acres from Parcel A to Parcel B, resulting in parcels with sizes of 10.87 acres (Parcel A) and 5.61 acres (Parcel B). •The proposed application is to correct an encroachment of an existing residence, several accessory structures, and fencing owned by Ramiro Medrano (Parcel B) onto the Morris parcel (Parcel A). Parent Parcel APN Acres Before LLA Acres After LLA Parcel A 025-340-076 11.48 10.87 Parcel B 025-340-077 5.00 5.61 •The project site is at 346 and 378 Lone Tree Road, approximately one mile north of Palermo Road, in South Oroville. •The subject parcels are zoned RR-5 (Rural Residential, 5-acre minimum parcel size). Both parcels have a land use designation of RR in the Butte County General Plan. •Surrounding parcels are zoned RR-5 and largely consist of single-family residential uses and limited agricultural uses, primarily consisting of livestock and grazing lands. MEMORANDUM Principal Planner January 28, 2026 • The existing parcel sizes of both parcels conform to the zoning’s minimum parcel size requirement. • Parcel A includes a single-family residence and accessory structures, along with an onsite septic system. Parcel B also has a single-family residence, an accessory structure, and an on-site septic system. The South Feather Water and Power Agency provides water to both parcels. Analysis • The project would not result in the creation of any new parcels. • The Butte County Public Works Department verified that both parcels were created in conformance with the Subdivision Map Act and local regulations. • The resultant parcels will both exceed the minimum parcel size of 5 acres. • Resultant parcels will retain access to an existing 60-ft wide road and utility easement situated along the north property line, which provides access to Lone Tree Road, a County road. • The existing residence on resultant Parcel B will meet the minimum 10-foot interior side property line setback and all other objective development standards. • The Land Development Division of Public Works, Environmental Health Division of Public Health, and Butte Fire reviewed the project. None of the agencies objected to the proposed project, subject to the conditions of approval noted in Exhibit A below. CEQA Issues This project is exempt from the California Environmental Quality Act (CEQA) requirements under Categorical Exemption Section 15305(a). ACTIONS FOR CONSIDERATION: Staff recommends that the Director of Development Services take the following action: I. Find that the project is exempt from environmental review under Section 15305(a) of the California Environmental Quality Act (CEQA). A Class 5 exception consists of minor alterations in land use limitations in areas with an average slope of less than 20%, which do not result in any changes in land use or density, including but not limited to minor lot line adjustments, side yard, and setback variances not resulting in the creation of any new parcel.
