APN Acres Before LLA Resultant Parcel Acres After LLA 038-250-022 +/- .36 Lot 1 +/- 2.66 038-250-043 +/- 36.27 Lot 2 +/- 2.05 038-250-026 +/- 12.73 Lot 3 +/- 44.65 •The parcels are located on the south side of East Biggs Road approximately 12,115 feet east of City of Biggs. The Butte County Public Works Department verified that all three lots were properly created. •Surrounding parcels are zoned Agriculture (AG-80) which has an 80-acre minimum for the creation of new lots. The surrounding areas largely consist of agriculture and residential uses. •APN 038-250-022 is developed with a residence addressed as 1594 Nelson-Shippe Rd., Durham CA 95965. •APN 038-250-043 is developed with a residence addressed as 1566 Nelson-Shippe Rd., Durham CA 9596, a shop, a barn, and is used for rice production. •APN 038-250-026 is developed and used for rice production. MEMORANDUM Rowland Hickel Senior Planner APN Zoning Parcel Minimums 038-250-022 AG-80 80 acres 038-250-043 AG-80 80 acres 038-250-026 AG-80 80 acres Analysis •The project would not result in the creation of any new parcels.The proposed lot line adjustment will reconfigure the three lots in way that reduces APN 038-250-043 further below the 80 acreage minimum from 36.27 acres to 2.05 acres. Consequentlly, Zoning Ordinance (Hereinafter ZO) Section 24-302 applies and requires at least one of three exceptions to apply in order for the proposal to be approvable. o Pursuant to ZO §24-302(3) , the proposal would improve design of the existing lots without altering existing land uses by. . . . Combining all rice fields into one parcel for agriculture use on APN 038-250-026; and Increasing the usability of APN 038-250-022 by increasing its size. •The project will maintain compliance with Zoning development standards as applicable to each resultant lot respectively. CEQA Issues •Applicable Rule: Categorical Exemption. This project is exempt from the requirements of the California Environmental Quality Act (CEQA) under Section 15305(a) of the CEQA Guidelines (Class 5). This exemptionincludes minor alterations in land use limitations with an average slope of 20 percent where the project wouldnot result in any changes in land use or density, including minor lot line adjustments that do not result in thecreation of any new parcels. •Factual Reasoning & Analysis. o Minor Alteration: The proposed lot line adjustment is a minute reconfiguration of the property lines for the three lots each of which has an average slope less than 20 percent. All three parcles have less than 1%average slope. o No change in use, density, or parcel creation: The resultant parcels would remain under the same zoning designations with the same existing uses continuing to occur on each, without affecting a change in use or density. Lastly, the project would not result in the creation of any new parcels. ACTIONS FOR CONSIDERATION: Staff recommends that the Director of Development Services take the following action: I.Find that the project is exempt from environmental review under Section 15305(a) of the California Environmental Quality Act (CEQA). A Class 5 exception consists of minor alterations in land use limitations in areas with an average slope of less than 20%, which do not result in any changes in land use or density, including but not limited to minor lot line adjustments, side yard, and setback variances not resulting in the creation of any new parcel. II.Approve the Lot Line Adjustment for Lot Line Adjustment Application PROJ-25-0026, subject to the Conditions of Approval in Exhibit A. EXHIBIT A CONDITIONS OF APPROVAL Lundberg Lot Line Adjustment PROJ-25-0026 APNs: 038-250-022, 038-250-043, & 038-250-026 Public Works 1.Deeds and plats (if required) with the appropriate checking fee shall be submitted to the Departmentof Public Works, Land Development Division for checking and approval prior to recordation and shallcontain the notes specified below. 2.Provide documentation from a title company of the applicant's choice verifying that any deed of trustaffected has been partially re-conveyed or modified to reflect the lot line adjustment and to prevent thecreation of any additional lot or parcel. 3.Prior to recordation of deeds, provide documentation verifying payment of taxes as required bySubsection (d)(4)a. of Section 20-95.1 of the Butte County Code and as specified in Article 8 of Chapter4 of Division 2 of Title 7 of the Government Code, commencing with Section 66492. Deed Note (To be placed on any deed to effect lot line adjustment) The purpose of this deed is to effect a lot line adjustment as approved by the Butte County Director of Development Services on ______________________. The above described lands are to be combined with and become a part of those lands as described in the deed to ________________________________ as filed for record in Butte County Official Records at Serial Number _____________ Book _____________ Page ___________. No additional lots or parcels are created hereby. The scope of review of said lot line adjustment was limited as specified in Government Code Section 66412(d), and approval of it does not constitute assurance that future applications for building permits or other land use entitlements on the modified lots or parcels will be approved by the County of Butte.
