Under the federal Telecommunications Act, local governments must act on wireless facility permit applications within a “reasonable period of time.” In 2009, the Federal Communications Commission (“FCC”) issued a declaratory ruling, commonly known as the “Shot Clock ruling,” which clarified this obligation. Under the Shot Clock ruling, local
governments generally must take final action on a wireless facility permit application within 150 days of the submission of an application for a tower facility. On behalf of VB BTS III, LLC, I am pleased to submit this application for a proposed
new wireless tower facility to be located at the address listed above (the “Application”). Given
that the Application relates to a new tower facility, the local permitting authority must make a final decision on this Application within 150 days from the date of this submission.
