Agricultural Commissioner’s Office
1. Prior to recordation of final map, indicate 300-foot Agricultural Buffer setback from all adjacent
lands zoned Agriculture and all newly-created parcel lines for future residential development.
2. Place the following note on the recorded map: “Fencing for areas other than residential areas
shall be limited to a maximum of five (5) wire strands. The lowest strand shall be at least
sixteen (16) inches above the ground and the upper strand shall be no higher than forty-eight
(48) inches above the ground.”
Public Works
A. COUNTY SURVEYOR
1. Map Recordation: Prior to map recordation:
a. The applicant shall submit to the County Surveyor for review and approval a final map
pursuant to Subdivision Map Act Section 66444-66450.
b. The applicant shall prepare a Supplemental Data Sheet for all information not affecting
record title interest. The Supplemental Data Sheet shall contain a statement that the
additional information, conditions of approval or comments are for informational
purposes only and are not intended to affect record title interest. Additional information
may include but is not limited to building setback lines, flood hazard zones, seismic
lines and setbacks, leach field free areas and usable sewage disposal areas.
c. The applicant shall show all easements of record on the final map and shall provide
deeds establishing all existing and proposed easement and rights of way on the
property.
d. The applicant shall pay in full any and all delinquent, current and estimated taxes and
assessments as specified in Article 8 of Chapter 4 of Division 2 of Title 7, of the
California Government Code commencing with Section 66492. A tax certificate is to
be provided to the County Surveyor prior to recording.
e. The applicant shall submit a Preliminary Title Report that has been prepared within 6
months of the map recordation date.
f. The applicant shall provide deeds establishing property boundaries.
g. The applicant shall provide copies of all lot and boundary closures (calculation showing
error of closure).
h. The applicant shall pay the recording fees in effect at the time the final map and related
documents are recorded.
i. The parcel map shall contain a certificate by the engineer or surveyor responsible for
the preparation of the map that states that all monuments are of the character and
occupy the positions indicated, or that they will be set in such positions on or before
ninety (90) days from the date of recordation, per Butte County Code of Ordinance
Approved by: Zoning Administrator
Approval Date: 04/01/2026
Section 20-109.5. The certificate shall also state that the monuments are or will be
sufficient to enable the survey to be retraced.
j. Prior to recordation of the Parcel Map, a note shall be shown on an additional map sheet
of the parcel map that states: “Designated Remainder is not created for sale, lease or
financing. Prior to sale, lease or financing of the Remainder, or issuance of any
development permit, the property owner shall obtain a Certificate of Compliance, in
accordance with the Butte County Code.”
B. STREETS
1. Road Maintenance: Prior to map recordation, the applicant shall provide a fully
executed road maintenance agreement, which forms a Road Maintenance Association,
for all non-publicly maintained access roads on the county approved form. A note shall
be placed on a separate document which is to be recorded concurrently with the map
or on an additional map sheet stating: "In accordance with Civil Code Section 845,
maintenance of the road as shown hereon shall be shared by those properties with a
legal interest in it."
2. Interior Streets: Prior to map recordation, construct or provide a performance, labor
and material bond for construction of interior streets in conformance with Town of
Paradise standard A-2B within the project site through Parcel 2 to its boundary with
Parcel 3. Submit for approval a roadway structural design and improvement plans to
the Land Development Division prior to construction. An “R” value determination and
other data may be required to support the section design. Submit a Notice of Materials
to be Used, materials test results, and mix design in compliance with 2018 Caltrans
Standard Specifications, Section 39, to the department of Public Works for approval at
least 14 days prior to the start of paving operations. Testing of hot mix asphalt materials
shall be performed by a qualified laboratory and test results shall be signed and stamped
by a licensed civil engineer. Conduct material testing during construction and submit
the results to Department of Public Works to ensure compliance with Standard
Specifications, approved materials, and approved mix design.
3. Cul-de-Sac/Turnaround: Provide a cul-de-sac or building-free turnaround area
designed and constructed as specified in the county improvement standards. The
recorded map shall show the cul-de-sac or building-free turn-around area.
4. Street Name Signs: The location of street sign installations shall be shown on the
improvement plans for review and approval. A street sign will be required at the
intersection of Out of the Way Road and SR191/Clark Road. Prior to final road
inspection, install all necessary traffic safety signs including stop signs. Street signs
shall be of the type and size shown in the Butte County Improvement Standards. Stop
signs, speed limit signs, and other traffic control signs shall be of the size and type and
shall be installed in locations that are in conformance with the State of California
Manual of Uniform Traffic Control Devices and approved by the Public Works
Engineering Department.
5. Dedications and Easements:
a. All access rights shall be reserved by deed per county ordinance, offered for
dedication, and depicted on the recorded map in accordance with Butte County
Code of Ordinances Section 20-134. Place the following note on the map to be
recorded: “Out of the Way Road is a non-exclusive easement for ingress, egress,
road and public services purposes, to be reserved in deeds and is hereby offered for
dedication to the County of Butte.”
b. Per Butte County Code of Ordinances Section 20-132, where the subdivision
adjoins unsubdivided land, adequate or necessary street dedication in the
subdivision shall be extended to the adjacent unsubdivided land to provide access
in the event of its future subdivision, and in a manner to provide the most
advantageous development of the street pattern in the area. The dedication of Out
of the Way Road shall be extended to the southern property line to provide a
potential future circulation connection.
c. Drainage and other utility easements shall be provided where they are needed. The
subdivider shall provide rights-of-way or easements for storm drainage purposes
conforming substantially with the lines of any watercourse, channel, lake, stream,
or creek. The width of the rights-of-way or easements shall be adequate to provide
for the necessary maintenance of the channels and incidental structures.
6. Engineer’s Certification: The subdivider's engineer shall certify that any required
improvements have been completed in conformance with the applicable standards.
C. SOILS, DRAINAGE, FLOODING
1. Stormwater Quality Management: Coverage under the stormwater Construction General
Permit (CGP) will be required by the State Water Resources Control Board if the
project results in ground disturbance, including clearing, excavation, filling, and
grading of one or more acres or disturbs less than one acre but are part of a larger
common plan or development consisting of one acre or more of total disturbance.
Coverage under this General Permit must be obtained from the State Water Resources
Control Board prior to starting construction. If coverage under the CGP is required,
engineering plans shall show the Waste Discharge Identification (WDID) number on
the title sheet of the plans and a copy of Storm Water Pollution Prevention Plan
(SWPPP) shall be provided to the Land Development Division of the Public Works
Department. Submit with improvement or grading plans the estimated areas to be
disturbed to the Department of Public Works for consistency with the SWPPP.
Additionally, place a note on a map sheet that states: “The development of this parcel
(or subdivision) map required coverage under the Stormwater Construction General
Permit. Construction activities that result in a land disturbance of less than one acre,
but which are part of a larger common plan of development, also require coverage
under this permit. Development of individual lots may require an additional permit
coverage.”
Environmental Health Division
1.Prior to recordation of the final map, parcel map must show Minimum Usable Wastewater Area
as follows:
A.Resultant Parcel 1 – 15,000 square feet with pressure distribution.
B. Resultant Parcel 2 – Show existing wastewater system. A site evaluation will need to be
completed at the time of a repair or future development.
C.Resultant Parcel 3 – 15,000 square feet with pressure distribution or 15,000 square feet
with pressure and supplemental treatment, if utilizing a 24-inch vertical separation.
D.Resultant Parcel 4 – 15,000 square feet with pressure distribution and supplemental
distribution.
2. Prior to recordation of the final map, parcel map must show existing and proposed well locations
for each parcel indicating 100-foot setback to Minimum Useable Wastewater Area. All water wells
will meet the minimum 100-foot setback from all leach fields.
Butte County Fire
1. Parcels are located in the State Responsibility Area (SRA) and within a Very High Fire Hazard
Severity Zone. CALFIRE Butte County is the Fire Department having jurisdiction.
2. Construction, installation or development of buildings and/or roads, driveways, gates and
bridges on parcels/lots shall comply with the current adopted California Building Standard
Codes, California Fire Safe Regulations—Public Resources Code 4290, 4291 and current Butte
County Improvement Standards, whichever is stricter.
3. Place a note on a separate document, which is to be recorded concurrently with the Parcel or
Final map, or on an additional map sheet stating, “Building identification and/or addresses shall
be installed in conformance with Public Resources Code 4290 and shall be posted at the time
of permit issuance and maintained continuously thereafter.
II. NOTATION
A. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by
the applicant, or their respective designee. Prior to such approval, verification shall be
made by each Department or Division that the modification is consistent with the
application, fees paid and environmental determination as conditionally approved. Changes
deemed to be major or significant in nature shall require a formal application for
amendment.
