NOTICE OF INTENT TO LITIGATE
TO: Butte County Counsel
TO: Chico City Attorney
CC: Butte County Board of Supervisors / JPA Board Members
RE: Formal Notice of Impending Legal Action and Demand for Compliance
To the County and City Attorneys:
This letter serves as a formal notification that your current course of action has
reached a critical deadline. The clock is ticking, and we are prepared to move forward
with a filing that will result in a red line—effectively seeking to shut down the
contested operations immediately.
Be advised that our legal strategy is fully prepared. We intend to demonstrate, both in
open court and to the public, the failures in oversight and execution by the Joint
Powers Authority (JPA). We will make it undeniably clear to the five members of the
Board of Supervisors who sit on the JPA that they, along with the City of Chico, will
be held fully accountable.
We are confident in our position and prepared to pursue this matter until a total
resolution is reached. This is your final opportunity to address these grievances
before we seek a court-ordered shutdown and full damages.
