Subject: Designation of non-federal representative to conduct informal consultation
under Section 7 of the Endangered Species Act
Dear Mr. Ratcliff:
On October 24, 2024, Pacific Gas and Electric Company, licensee for the Poe
Hydroelectric Project No. 2107, filed a request with the Federal Energy Regulatory
Commission (Commission) for a temporary minimum flow variance to complete radial
bypass gate recoating and resealing, and hoist work maintenance on Poe Dam.1 The Poe
Project is located on the North Fork Feather River in Butte County, California, and
occupies lands within the Plumas National Forest. According to the U.S. Fish and
Wildlife Service (FWS)’s Information for Planning and Consultation tool, Endangered
Species Act (ESA)-listed foothill yellow-legged frog (Rana boylii), California red-legged
frog (Rana draytonii), and proposed-to-be-listed Northwestern Pond Turtle (Actinemys
marmorata) can occur in the area and may be affected by the proposed variance. No
designated critical habitats occur in the affected area.
Also on October 24, 2024, the licensee filed a request to be designated as the
Commission’s non-federal representative for the purpose of formal consultation with the
FWS, pursuant to section 7 of the ESA.2 By this letter, we designate the licensee as our

non-federal representative for the purpose of conducting ESA consultation on the
aforementioned species with your office pursuant to the regulations at 50 C.F.R. § 402.08
implementing section 7 of the ESA. The role of the non-federal representative may
include conducting studies, developing and providing information, attending meetings,
ensuring that pertinent endangered species information is maintained in a project file,
participating in informal consultation with your agency, developing a draft biological
assessment, if necessary, and keeping the Commission apprised of its actions. However,
the Commission remains ultimately responsible for all findings and determinations
regarding the effects of the project on any federally-listed species or critical habitat.
We appreciate your assistance with ESA consultation regarding the Poe temporary
minimum flow variance in support of radial gate repairs and maintenance. Please note
