ADMINISTRATIVE NOTICE: All recipients on the TO: line are placed there purposely
and strategically to include all relevant oversight bodies, enforcement branches, and executive
leadership. This configuration is a mechanical measure to curb administrative boilerplating
and jurisdictional obstruction. Every agency and executive leader listed is now formally and
concurrently noticed of the facts herein; any attempt to deflect responsibility to lower-level
staff or other agencies will be documented as a deliberate act of negligence.
Commissioner Sunquist, Chief Deputy Commissioner McCarther, Commissioner Quist,
and Oversight Authorities,
This serves as a formal rejection of the preliminary findings regarding the chemical
application at 1090 Shadowbrook Way, Apt. 4. This is a mandatory notice of evidence that
renders the vendor’s current narrative scientifically and legally impossible. The Butte County
Agricultural Department is currently operating under a falsified chemical log provided by
Shelby’s Pest Control (PR7217).
1. THE "CHECKMATE" ADMISSION: THE $16,500+ PIVOT The most damning
evidence of the severity of this chemical deployment is the landlord’s own desperate attempt
to buy silence, documented in the attached evidence:
Initial Mitigation: On March 24, 2026, Ferguson & Brewer offered $5,000 for a
liability waiver (See Attachment:
F&B_ATTEMPT_TO_SILENCE_SETTLEMENT_OFFER.PDF).
Legal Escalation: As of April 22, 2026, the law firm of Kimball, Tirey & St. John
has intervened, tripled that offer to over $16,500 to secure a "full release" and a waiver
of California Civil Code § 1542 (See Attachment:

Forensic Conclusion: High-level legal counsel does not authorize a 300% increase in
settlement funds for a "safe" botanical application. This financial pivot is an objective
Admission by Conduct that the substance applied was hazardous, synthetic, and illegal.
The landlord’s counsel has effectively conceded the liability that your office continues
to ignore.
2. SCIENTIFIC IMPOSSIBILITY OF "ESSENTRIA IC3" CLAIM Essentria IC3 is a
botanical concentrate composed of high-concentration peppermint and rosemary oils. It is a
physical impossibility for the reporting parties to have stood in the saturation zone 10–15
minutes post-application and detected zero olfactory evidence. The absence of scent during
the peak off-gassing window proves the vendor submitted a fraudulent log to conceal the use
of an odorless synthetic neurotoxin.
3. CRIMINAL AND PROFESSIONAL VIOLATIONS The saturation of a residence
without notice, consent, or signage is not a "paperwork error." It is:
Battery (PC § 242) and Assault with Caustic Chemicals (PC § 244.5).
Elder or Dependent Adult Abuse (PC § 368): Specifically, the infliction of physical
pain and mental suffering upon a person with known disabilities through the clandestine
application of hazardous chemicals.
Criminal Conspiracy (PC § 182) to facilitate a "stealth" and illegal application.
Professional Fraud (BPC § 8642): Submission of a fraudulent log by a licensee to a
regulatory body.
4. MANDATORY DEMANDS FOR ADMINISTRATIVE ACTION The DRE and the
Agricultural Department have a mandated duty to investigate and penalize fraud. We demand:
1. DRE LICENSE REVOCATION: Commissioner Sunquist and the DRE Executive
Leadership must immediately move to revoke the professional licenses of Ferguson &
Brewer and all involved licensees. The use of a law firm to facilitate a $16,500+ hush-
money payment to cover up a criminal chemical application against a disabled person is
a per se violation of professional ethics, public trust, and the Business and Professions
Code.
2. Immediate Forensic Sampling: Collect residues from the sheltered areas of the patio
and furniture to test for synthetic agents.
3. DPR Enforcement Intervention: We demand the DPR Northern Regional branch take
over this investigation to address the Butte County Agricultural Department’s refusal to
acknowledge physical and financial evidence of fraud.
The existence of the $16,500 settlement offer is now part of the administrative record. If
these departments continue to ignore this evidence and allow the destruction of physical
residues, that failure will be cited as a central act of negligence in the pending Writ of
Mandate.

Your demand for compensation is rejected. We are willing to counter by proposing a
settlement whereby you and your father vacate the property entirely within thirty days
and execute a full release of all claims against us and our vendors/employees, including
a waiver of California Civil Code §1542. In exchange, we will refund your $1,050
security deposit and pay $5,000 once the unit is fully vacated. This offer is provisional
only and no binding agreement shall exist between the parties as to these terms until
and unless the parties sign a formal written instrument evidencing the same. This offer
is open and valid until March 25 at noon, at which time it will be rescinded in full.

Shadowbrook Way, Apartment 4 in Paradise, CA (the “Property”). I am reaching out regarding settlement
discussions related to Mr. Jeff Coat’s tenancy at the Property and complaints. Our clients would like to offer the
following settlement agreement described below.
Our clients will offer the tenants:
$15,000
Refund of $1,050 security deposit
16 Day Rent Waiver in the amount of $541.94
In exchange, tenants will agree to:
Moving out of the Property within 30 days
Signing of a settlement and release agreement
