WHEREAS, the 1st to 14th parties are owners of the lands conveyed by the
hereinafter set forth deeds, the following Books and Pages being the Books and

Owners are recorded and the lands owned by the respective Owners being the lands
conveyed by such deeds, all of such lands being parts or portions of Sections
33 and J4 in Township 21 North, Range 4 East, M. D. B. 6 M., hereinafter referred
to in the description of the easement parcel:

WHEREAS, the Beneficiaries and Trustee are respectively the beneficiaries
and trustee under chat certain Deed of Trust constituting a lien and encumbrance
upon the parcel of land owned by a certain Owner, the said trust deed being
respectively recorded in the following Book and page of the Official Records of
Butte County,

WHEREAS, the parties mutually desire to create and establish the herein-
after set forth easement for roadway purposes and ingress and egress to and from
the lands respectively owned by the Owners and wish to make the easement hereby
created appurtenant to each of the respective parcels of land owned by the Owners,
and
WHEREAS, the Owners desire to subject any right, title or. interest acquired
in the said easements by this instrument to the lien, operation and effect of the
above respective deed of trust constituting an encumbrance upon the lands of the
respective Owners now subject to said deed of trust to the same extent as though
such easement rights hereby acquired were originally made subject to and encumbered
by the lien of said deed of trust, and
WHEREAS, the Beneficiaries and Trustee except as in the last above para-
graph set forth, desire to subordinate the deed of trust and the lien, operation
and effect thereof to the easement rights hereby created in any Owners other
than the respective Trustors in said Deed of Trust.
NOW, THEREFORE, in consideration of the premises and of the mutual covenants
and grants herein contained, it is expressly covenanted and agreed as follows:
That the hereinafter described parcel of land shall be and constitute a
mutual easement and roadway for ingress and egress to and from the various lands
owned by the Owners, and each of the Owners hereby grants and conveys to each other
Owner and to each Beneficiary and Trustee any and all such right, title or interest
in and to such easement parcel as shall be necessary to fulfill the intent and
purpose of the within agreement, and to grant to each parcel of land owned by the
Owners such easement and roadway rights. Said easement and roadway rights shall be
appurtenant to each of said parcels of land and shall inure to the benefit of and
may be used by all persons who may hereafter become the owners of said appurtenant
properties, or any parts or portions of all or any of said properties.
The beneficiaries and Trustee, except in so far as the respective Owners in
the above deed of trust hereby specifically subject said Onwer's right, title and
interest in the easement parcel to the lien of said deed of trust, hereby subordin-
ate then deed of trust and the lien thereof to the easement and roadway rights here-
by created and conveyed.
BUTTE COUNTY
It is understood and agreed that there are presently in existence various
easement rights in some portions of said easement parcel and in favor of some of
the lands owned by the Owners. It is further agreed that the easement rights
hereby created shall after the execution of the within agreement by all parties
hereto, being the owners of all lands adjoining said easement parcel or. the North
and South, and the recording of the within agreement in the office of the Recorder
of Butte County, constitute the sole rights and easements for roadway and ingress
and egress to and from the various lands owned by the parties and each of the
Owners and Beneficiaries and Trustee hereby release and quitclaim to each other, to
such extent as may be necessary, any and all other heretofore existing easements or
rights of ingress and egress to and from the various lands of the Owners.
The easement parcel above referred to and hereby created as a mutual easement
for roadway purposes and for ingress and egress to and from the lands of the Owners
is more particularly described as follows:
A non-exclusive right of way for road and public utility purposes over a strip
of land 60 feet in width, the centerline of which is more particularly described
as follows:
Beginning at a point in the centerline of the Oroville-Concow Road from which
point of beginning the Section corner common to Sections 27, 28, 33 and 34,
Township 21 North, Range 4 East, M.D.B. & M., bears North 68° 12' 49" East,
1272.41 feet, said point of beginning being also the true point of beginning for
that certain right of way described in deed to Dale L. Green recorded September
13, 1963 in Book "1269" of Official Records at page 640, records of Butte County,
California; thence along said Green right of way the following courses and dist-
ances: North 80° 42' 15" East 120.67 feet; North 65° 54' 15" East 143.52 feet;
North 77°00'55" East, 128.48 feet; South 55°33'05" East, 392.32 feet; and South
47°26'05" East, 202.28 feet; thence leaving said Green right of way centerline and
along said non-exclusive tight of way centerline, the following courses and dist-

feet to the Northwest corner of the South half of the Northwest querr_or of the
