Exhibit "A"Legal Description
All that real property situate in the Southeast one quarter of the Northeast one quarter ofSection 34, Township 19 North Range 5 East, M.D.M., unincorporated area, Butte
County California described as follows;
Beginning at the East one quarter corner of said Section 34; thence North 00° 35' 40"
West along the' East line of said Northeast one quarter, 1307.08 feet; thence leaving said
East line, South 89° 31' 14" West, 1277.88 feet; thence South 00° 13' 00" East, 1309.53feet to a point on the South line of said northeast one quarter; thence leaving said South
line, South 86° 03' 39" East, 1290.21 feet to a point on the East line of the Southeastone quarter of said Section 34; thence North 00° 24' 28" West along said East line,
101.83 feet to the point of beginning.
Containing 40.01 acres more or less.

of Deer Valley Road, as shown on that certain parcel map, recorded in the office of the
Recorder of the County of Butte, State of California, in Book 148 of Maps, at Page(s) 31,
32, 33, 34, 35, 35 and 37;
These easements are appurtenant to and shall inure to the benefit of the herein
described parcel of land and applies to all heirs, successors or assigns.
The Basis of Bearings for these descriptions is the same as shown on the Parcel Map
filed in Book 148 of Maps at Pages 30 thru 37, Butte County Recorder's Office.
ft 1. Measures shall be taken to control fugitive dust emissions from all driveway and
other civil construction associated with residential development. Approved dust
control measures are found in the fugitive dust control plan for the site approved bythe Butte County Air Quality Management District, a copy of which can be obtained
from the Butte County Department of Development Services, Building Division.
2.Fencing for areas other than residential areas shall be limited to a maximum of 5wire strands. The lowest strand shall be at least 16 inches above the ground and the
upper strand shall be no higher than 48 inches above the ground.
3.At the time of building permit application, if a Deer Herd Impact fee(s) is currently ineffect, it shall be paid prior to the issuance of the building permit.
4.A plan prepared by a certified arborist, botanist or landscape architect that shows the
existing on-site mature trees, located in any area proposed for buildings andvehicular access, and provides for methods to protect the trees identified to be
preserved, shall be provided to and approved by the Planning Division prior to the
issuance of building permits and/or prior to grading or vegetation removal. The
removal of mature trees shall be minimized, where possible. A mature tree shall be
defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from groundlevel. Mature trees removed or threatened by construction activities shall be
replaced on a 3-to-1 ratio, utilizing existing oak tree stock. Each tree to be preservedshall be surrounded and protected in the manner specified by the Plan.
5.During development activities, should any archaeological artifacts be discovered, the

cease until a qualified archaeologist has examined the artifacts and the site and
Submitted his or her findings to the Planning Division, and recommended clearanceto continue. Recommencement of construction shall be upon the approval of the
Planning Division.
6.Structures, dumping, fill material, vegetation removal, and/or excavation shall not beallowed in areas having a slope of 30% or greater unless an Erosion Control Plan
prepared by a registered civil engineer or other qualified professional is submitted to
and approved by the Department of Public Works.
7.Limit soil work to periods of dry weather between April 15 to November 15 unless an
erosion control plan for wet weather conditions is prepared by a civil engineer orother qualified professional and approved by the Department of Public Works. Mulch
protect, Hydro-seed, or otherwise stabilize the soil on all areas that have beendisturbed or have been cleared of vegetation and are of erodible material.
8.Development impact fee for Sheriffs facilities shall be paid pursuant to the provisions
of Chapter 3, Article II of the Butte County Code, prior to issuance of buildingpermits. The fee amount will be determined and calculated as of the date of
application for the building permit.
9.A development impact fee for school facilities shall be paid prior to issuance ofbuilding permits. The fee amount will be determined and calculated as of the date of
application for the building permits.
10.This parcel can not be further subdivided until such time as critical winter habitat isnot designated as deer herd critical winter habitat
11.The building setback from the side and rear property lines shall be at least 30-feet tosatisfy Public Resources Code 4290 (Fire Safe Regulations).
12.Fire suppression sprinkler systems shall be installed in all new residential structures
in accordance with the National Fire Protection Association Standard for the
installation of sprinkler systems in one and two family dwellings and mobile homes,
NFPA Standard 13D, unless a pressurized community water system, with hydrantsthat meet Fire Department specifications, serves the parcels.
13.Development of these parcels may require payment into the Water Tender Fund.
14.Construction, installation or development of structures or facilities on the parcels,
including as a minimum, driveway standards, building setbacks, and addressing,
shall comply with the latest Fire Safe Regulations of Butte County, Public ResourcesCode 4290, and all other applicable State and County codes, ordinances and
regulations in effect at the time of application for improvement permits.
15.A 50-foot building setback from the centerline of all roads is required.
16.The purpose of this deed is to effect a Waiver of Parcel Map as approved by theButte County Development Review Committee on September 14, 2000.
17—A4ifty (50)-foot leachfield-setback-is-required,along any-drainage-ways.
18.A one hundred (100) foot leachfield setback is required along the highwater line of
any creek.
19.Any areas with slopes in excess of thirty (30) percent are unsuitable for sewagedisposal.
20.There is no evidence that domestic water is available.
