Dear Ms. Arbuckle,
I apologize for Butte County’s delay in responding to your August 13, 2014. After receipt of your earlier e‐mail
and accompanying documentation, I had consulted with Marina Winslow of the Local Enforcement Agency
(LEA) for the Environmental Health Division of the Public Health Department. At that time, it was my
understanding that their office would be contacting you.
The subject property, located at 704 Neal Road at the site of (but separate from) the Earthworm Soil Factory
(APN 040‐120‐007), is approximately 66 acres in size and located in two zoning districts. The northerly two‐
thirds of the property is zoned AG‐RW (Agriculture – Neal Road Recycling, Energy, and Waste Facility Overlay)
and the southerly one‐third pf the property is zoned AG‐40 (Agriculture – 40‐acre minimum). I have attached
a zoning map showing the zoning designations of the subject property. In both the AG‐RW and AG‐40 zones, a
composting facility is permitted subject to approval of a Minor Use Permit. The processing fees for a Minor
Use Permit are charges at the actual cost with an initial retainer of $4,884.15.
From discussions with Ms. Winslow, it is my understanding that the proposed composting operation will also
require approval by the LEA of an application for a Full Solid Waste Facilities Permit. Helpful information is
available on the CalRecycle website at
http://www.calrecycle.ca.gov/swfacilities/permitting/permittype/fullpermit/.
Both the Minor Use Permit and the Full Solid Waste Facilities Permit require compliance with the California
Environmental Quality Act (CEQA) as you note. The requirements specified by CalRecycle for CEQA documents
for composting facilities are relatively complex. Issues that are required to be discussed fully in an
Environmental Impact Report, or at an appropriate level of detail in a Mitigated Negative Declaration are
detailed on the CalRecycle website at
http://www.calrecycle.ca.gov/swfacilities/permitting/CEQA/Documents/Guidance/Compost.htm. Based on
this complexity, it is my recommendation that you consider obtaining the services of a qualified consultant
with experience in preparing CEQA documents for Full Solid Waste Facility Permits for aerated static pile
composting facilities.
I hope this information serves as a first step in assisting you with how to proceed with your proposed
project. As a next step, I recommend meeting with both Marina Winslow ((530) 538‐5321) of the LEA and
Principal Planner Stacey Jolliffe ((530) 538‐6573) here at the Department of Development Services. Butte
County also offers businesses interested in discussing plans to develop a new business the ability to meet with
all of the Butte County land development departments during an Economic Development Assistance
Committee (EDAC) meeting. EDAC provides an additional opportunity to discuss such items as site suitability,

zoning/permitted uses, improvement requirements, and available business/economic development
assistance.

Hello,
I realize you are all busy but we really could use some feed back as to how to proceed, thus your kind attentions to this
matter would be appreciated. Funding is based on having all our CEQA documentation done in a timely matter. It would
be unfortunate for Butte County to let this opportunity pass by. As all jurisdiction are require to reach 75% under AB 341
we have to work together to get our organics out of the landfill and into a reusable, beneficial form. Please help us help
our community reach our sustainability goals.
