Emergency Action and Contingency Plan
1.0 Executive Summary.
The purpose of this Contingency Plan and Emergency Procedures (Plan) is to provide
operators of Weiss McNair LLC essential information and guidelines to effectively
respond to emergency situations. These guidelines shall be implemented at the primary
business located at 100 Loren Avenue, Chico, CA 95928. This plan is required by
federal and state regulations, including:
➢ Community Right to Know Law (California Health and Safety Code, Chapter
6.95, § 25500 et seq.).
➢ Emergency Action Plan, Title 8, California Code of Regulations (CCR) § 3220;
➢ Fire Prevention, Title 8, California Code of Regulations (CCR) § 3221; and
➢ Hazardous Waste Regulations (California Code of Regulations (CCR), Title 22
§ 66265.50 - 56), Cal/OSA (CCR Title 8 § 5192).
Weiss McNair LLC is a limited liability corporation with approximately 95 employees.
The Facilities Manager shall become familiar with this plan and will provide training to
employees to properly implement this Plan and continuously develop, revise, and train
employees on Standard Operating Procedures (SOP) or similar program regarding
maintenance and use of equipment, management of hazardous materials, and hazardous
waste in order to mitigate potential emergency situations.
A review and evaluation of the Plan will be conducted at least annually. Amendment of
this plan will occur within three (3) months of the review in the event of the following:
➢ Regulations are adopted or revised,
➢ The Plan fails in an emergency,
➢ More effective prevention and control technology if such technology will
significantly reduce the likelihood of a spill event from the facility or if such
technology has been field -proven at the time of the review.
➢ The Emergency Coordinator (EC) changes,
➢ Hazardous materials inventory changes,
➢ The list of emergency equipment changes, or
➢ The facility changes in its design, construction, operation, maintenance, or other
circumstance in a way that materially increases the potential for fires, explosions,
or releases of hazardous waste or hazardous constituents, or changes the response
necessary in an emergency.

NOTE: Businesses must submit an amendment to the chemical inventor, within
thirty, (30) days to Butte County, Department of Public Health, and Division
of Environmental Health when:
➢ A 100 percent or more increase in the quantity of a previously
disclosed material / waste;
➢ Any handling of a previously undisclosed hazardous material / waste
exceeding the threshold quantities is stored on site for greater than 30
days;
➢ Change of business address;
➢ Change in business ownership; or
➢ Change in business name.

3.2 Description of Business Activity.
The Weiss McNair LLC business activity at this location involves the
manufacturing of agricultural equipment and parts for assembly. Activities

Spill Prevention Control and Countermeasure Plan (SPCC Plan) for oil pollution
prevention referenced in 40 Code of Federal Regulations (CFR) § 112 is not
required for this facility since no single container has a capacity in excess of 660
gallons.
Weiss McNair LLC will comply with the generator requirements with respect to
completion of the manifest and land disposal restrictions for all hazardous wastes
transported off-site for all hazardous waste generated in accordance with Title 22
CCR 66262.

6.0 Administrative Responsibilities.
The Emergency Coordinator (EC) is responsible to maintain an adequate state of
emergency preparedness. Ray Ryan is the EC for Weiss McNair LLC. The EC will
be available and retain specific duties, to include:
➢ Establish and maintain coordination with local fire, police and appropriate
specialized contractors.
➢ Regularly review facility / personnel preparedness.
➢ Serve as initial "Incident Commander" representing Weiss McNair LLC during
emergency functions, responsible for:
• Assessing the situation and possible hazards, ordering evacuations,
medical care, shutdowns, etc.
• Notifying appropriate state or local agencies and site and corporate
personnel with designated response roles.
• Directing other incident specific activities as outlined in the site plan.
• Assuring measures to ensure that Fres, releases, explosions, etc., do not
occur, recur, or spread.
• Writes and/or delivers press releases regarding the on-going incident.
Places and answers phone calls / communications to and from: fire
department, police department, other contractor personnel and
regional/corporate management personnel.
The EC will direct support personnel, as necessary, for response activities.
7.0 Notifications.
7.1 Internal Notifications.
Any employee or on-site contractor discovering a fire, explosion, chemical
release, or hazardous situation must implement the appropriate emergency
response plan, warn immediate employees, and notify their supervisor or EC
immediately. At the direction of the EC, facility -wide communications will be
carried out by verbal warnings or by public address or intercom system.
The supervisor or EC will assess the situation and determine if an emergency
exists. If a situation is more than a minor incidental event, the supervisor must
notify the Emergency Coordinator.

7.2 External Notifications.

The Emergency Coordinator (EC) is the principal individual in an emergency and
will serve as the central contact. Upon notification of an incident, the EC will
assess the information available and determine further action. The EC will
contact external primary emergency responders (Fire Dept., Police / Sheriff,
Ambulance, etc.), immediate neighbors, and regulatory agencies requiring
immediate verbal notification.
All emergency contacts are listed in Section 4.0.
The EC will oversee and coordinate with facility staff, emergency contractors (if
required), and regulatory agencies involved in emergency and remedial response.
8.0 Fire and Explosion Plan.
8.1 General.
The foundation of this plan is fire (and explosion) prevention. However, in the
event of a fire (or explosion), control will be left to the fire fighting professionals.
Employees, trained in the proper use of fire extinguishers, may quell fires only in
the incipient stage if the safety of the employee is not jeopardized.
8.2 Plan Implementation.
The plan will be implemented when an employee or other person notifies a
supervisor. Should an emergency exist, the Emergency Coordinator (EC) will be
notified. The EC will:
➢ Amass information (Hazard Evaluation) from the employee, such as:
• Are personnel injured?
• Location of fire (or explosion)
• Extent of fire (or explosion)
• Hazard potentials

➢ Evaluate the situation, and prescribe emergency counter measures, which
may include:
• Evacuation of the facility
• Contacting emergency services (Fire Department, Police,
Ambulance)
• Verbal notification of required agencies

8.3. Response Plan for Minor Fires.
➢ Rescue injured personnel, if possible / necessary

The EC shall determine if the . incident will be managed by on-site personnel or
other response services.
➢ Place debris and materials used in the clean-up in containers, labeled,
and disposed as appropriate.
➢ Call and complete written notifications to agencies, if required.
➢ Recovery will be in accordance with Section 14.0 of this plan.
➢ Conduct a formal investigation of the cause(s) and critique the incident
and associated actions which result in a written report including
recommendations for improvement.
NOTE: Fire extinguishers are located in various places within the facility.
Employees should always be aware of the closest extinguisher.
Spill / Release Plan.
9.1 General.
Spill and release incidents may be significant threats to health, safety, and the
environment. Control of spills or releases requires the talents of trained
personnel. The plan described below is a guideline for site personnel upon
discovering an emergency condition.
9.2 Release Response Plan.
➢ Rescue injured personnel, if possible / necessary
➢ Identify potential hazards when possible

10.0 Natural Disasters.
Natural disasters can occur in many forms, but all generally affect large areas and many
people in relatively brief period of time. Natural disasters will often place a considerable
strain on local government support agencies (fire, police, and civil defense). Natural
disasters may cause other emergency situations simultaneously (for example, an
earthquake may cause fires, injuries, spills or explosions).
The actions identified in this plan are general, and should supplement local government
programs and existing plans that are more comprehensive.
10.1 Tornados.
Tornados are not common in the Western U.S. and will not be addressed in this
plan.
10.2 Hurricanes.
Hurricane force winds and gusts may occur on the West Coast, however, there is
advance warning of their approach through the media, and therefore a
contingency may be planned.
High winds may directly impact transportation services and off-site services.
Gusts can cause heavy materials to be hurled about causing damage and/or injury.
Electrical power and related hazards must also be considered.

10.3 Earthquakes.

Earthquakes in the U.S. occur most frequently west of the Rocky Mountains, but
damaging earthquakes can occur in most states. This is a natural disaster that
typically offers very little or no advance warning. Casualties usually occur as a
result of falling objects and debris, splintering glass, and fires. Fires can be
caused by ruptured gas and electrical lines and aggravated by damaged water
mains that affect fire suppression systems. Coastal areas may also be affected by
tidal waves (tsunamis) that could be caused by near or distant earthquakes.
Additional sections of this Emergency Action Plan may be relevant during or after
an earthquake may include Section 17.0, Emergency Preparedness; Section 8.0,
Fire Plan; and Section 9.0, Spill (Release) Plan.
10.3.1 Preparatory Activities.
Most preparatory activities for an earthquake involve careful design,
construction, maintenance of structures, equipment, and thorough safety
training of personnel. Specific preparatory activities may include:
➢ Bolting down water heater and gas appliances.
➢ Checking the integrity and flexibility of gas and electrical
connections.
➢ Placing large and heavy objects on lower shelves, and securely
fastening shelves to walls.
➢ Bracing or anchoring other high or top-heavy objects.
➢ Storing bottled goods, glass and other breakables in low or closed
cabinets.
➢ Anchoring hanging objects such as overhead lighting fixtures.
➢ Keeping on hand batteries, portable radios, flashlights, drinking
water, nonperishable foods and a sufficient number of fire
extinguishers and first aid kits.
10.3.2 During an earthquake:
➢ Keep calm. Don't run or panic.
➢ Stay where you are. If indoors, stay indoors. Most injuries occur
as people are entering or leaving buildings.
➢ If indoors, take cover under a desk, heavy table or bench, or
against inside walls and doorways. Stay away from glass,
windows and outside doors.
➢ Don't use candles, matches or open flames either during or after
the tremor. Douse all fires.
➢ If outdoors; move away from buildings and utility wires.
➢ If in a moving car, stop but stay in the vehicle. Avoid stopping

near or under buildings, overpasses and utility wires.
10.3.3 After an earthquake:
➢ Be prepared for additional tremors or "after -shocks".
➢ Address injuries and orderly evacuations.
➢ Continue to monitor radio for latest information on the emergency
from the local authorities.
➢ Check water, gas and electrical lines and valves for damage or
leaks.
➢ Assure sewage lines are intact before using sanitary facilities.
Restrict access to downed power lines or objects in contact with
downed lines. If electrical wiring is shorting out, shut off current
at the main box.
➢ Use telephones only for essential emergency purposes.
➢ Recovery will be in accordance with Section 13.0 of this plan.
10.4 Floods.
Floods are not a major concern at this facility since the site does not lie within a
flood zone.
11.0 Other Threats (Physical Violence, Explosives, Chemical, or Biological).
Threats are a common tool of terrorists and criminal extortionists, but they most
frequently occur as a means of retaliation by employees, ex-employees and others with
real or imagined grievances. While threats may be low risk, it is addressed here for
awareness purposes.
The vast majority of threats are threats only, with no actual or intended outcome. The
desired effect of such a threat is to extort, embarrass, disrupt, frustrate, panic or cost the
targeted manager or operation. On the other hand, enough actual threats do occur and
warrant prudent planning and minimum safeguards.
This portion of the Contingency Plan and Emergency Procedures will deal with
preventive measures and the proper and safe handling of actual threats.
11.1 Preventive Measures.
The most basic preventive measure is to properly secure a facility so that a threat
cannot be enacted. Further support in security can be provided by private security
services. A higher probability of threats due to a history of past threats,
neighborhood or community trends, or a situation involving a particularly
vengeful individual may warrant more extensive measures. A higher probability
will also warrant more contact with local law enforcement authorities.

In any case, local law enforcement agencies can often provide support such as
pamphlets, training and assistance with planning. Many departments have control
/ disposal specialists who can offer extensive support.
11.2 Management of Received Threats.
11.2.1 Phoned in Threats.
➢ Keep the caller on the line as long as possible. If possible, record
the conversation.
➢ If not indicated, ask the caller for the location of the intended
threat and the date or time of the intended enactment.
➢ Inform the caller that the building is occupied, and the outcome
of the act could result in death or injury to many innocent people.
➢ Pay particular attention to peculiar background noises such as
motors running, music, and any other noise which may give a clue
as to the location of the caller.
➢ Listen closely to the voice (male or female), voice quality (calm,
excited), accents, unique phrasing, and speech impediments. Does
this voice immediately remind you of a certain individual? If so,
note it.
➢ Report the call and gathered information immediately to the EC.
➢ The EC will notify the appropriate local police, fire, or health
departments.
11.2.2 Written Threats.
➢ Save all materials, including any envelope or container.
➢ Once the message is recognized as a threat, further unnecessary
handling should be avoided. Every possible effort must be made to
retain evidence such as fingerprints, handwriting or typing, paper,
and postal marks which are essential to tracing the threat and
identifying the writer.
➢ Report the threat immediately to the EC.
➢ The EC will notify the appropriate local fire, police, or health
departments.
11.3 Threat Analysis.
A determination should be made as to the credibility of the threat. For example,
authentic threats tend to be more specific as to time and location while false
threats tend to be very general and broad.
This analysis should be made with the close direction and assistance of the police
or fire departments. In making this analysis, consider:

➢ Time of day and day of the week.
➢ Mode (telephone, mail).
➢ Specificity of threat (place, time).
➢ Identity of caller (male, female, child).
➢ Attitude (serious, prankster).
➢ Possibility of access to allow placement of explosive device.
11.4. Threat Response.
The proper response to the threat may be:
➢ Ignore the warning.
➢ Conduct limited search of specific area and secure facility perimeter.
➢ Conduct general search of facility.
➢ Order limited evacuation of a particular area.
➢ Order general evacuation.
11.5 Searches (Explosives, Chemicals, Biological Materials).
The decision to search for a particular hazard should be carefully made with the
close interaction between the EC and the police or fire departments.
The best search team is made up of volunteers, who are familiar with the search
area, working along with trained fire or police department personnel. Specific
areas should be assigned to each searcher or search team. The EC and
enforcement personnel should coordinate from a central location to allow for easy
response from the searchers.
The searchers should look for and check:
➢ Labels on containers or materials.
➢ An item that fits the threat description.
➢ An item that appears to be "out of place" or unrecognized.
➢ An object making strange noises.
➢ Near entrances (inside and outside of doors).
➢ Near exits.
➢ Around and in waste receptacles.
➢ In rest rooms, phone booths, store rooms, closets, stairwells, hallways, and
nearby vehicles.
Should suspicious objects be found, they are NOT TO BE TOUCHED and must
be immediately reported to the EC and police.

12.0 Demonstrations and Strikes.
Demonstrations or strikes are not expected. However, should a demonstration or strike
occur, only the EC or their delegate is authorized to speak with demonstrators or the news
media. The EC will determine if outside resources are required to prevent disruption to
the management of the facility.
13.0 Systems Related Emergencies.
A systems disaster is defined as a major disruption to the equipment or facility that
prevents access to or processing of data that is essential to the operation of the facility. In
case of systems emergencies, data may be processed at an alternate location designated
by the EC.
14.0 Recovery.
Only in extraordinary circumstances will a facility be totally demolished by a disaster.
As a consequence, facilities for re-entry will be in varying stages of disrepair, and certain
steps should be followed prior to re-entry.
14.1 Structural Integrity.
All structures that appear to have significant structural damage shall not be
reoccupied until a qualified engineer or contractor makes the determination for re-
entry. Additionally, buildings and grounds should be examined for precarious
equipment, weakened structures or furniture, live and exposed electrical wiring,
escaping gas, dangerous chemicals and/or damaged compressed gas containers.
Areas that can be safely reoccupied should then be identified, and priority
functions should be given the use of those areas. Usable equipment, tools,
supplies, furniture, etc. should be cleaned (if necessary) and put back to use or
stored in a secure and safe holding area.
14.2 Decontamination.
Immediately after the emergency, any recovered waste, contaminated soil or other
materials will be appropriately isolated and disposed. Care will be taken not to
combine incompatible wastes. Decontamination procedures shall be followed
before returning previously contaminated items back to service.

14.3 Emergency Equipment.

After an emergency event, all emergency equipment that has been used will be
cleaned, repaired or recharged so that it is fit for use or will be replaced. An
inspection of all safety equipment shall be conducted before any re -occupancy is
resumed.
14.4 Requirements Prior to Resuming Operations.
The owner or operator shall notify the Department of Toxic Substances Control
and appropriate agencies that the facility is in compliance with the items listed
above before operations are resumed in the affected areas.
15.0 Notification and Reporting.
In the event of a hazardous material, substances, or waste release, the EC will be
responsible to notify regulatory agencies. Table 3, Agency Notification and Reporting
Chart on the following page identifies certain release situations and identifies the
agencies to be notified in the event of a hazardous material, substance, or waste release.

16.0 Hazardous Materials and Waste Information and Location.
Hazardous materials used and hazardous wastes at the facility are provided in Facility
Information section. Location of stored products and hazardous waste is provided in the
Facility Layout of 100 Loren Avenue (see tab).
Material Safety Data Sheets for materials and Hazardous Waste Profiles (MSDS
equivalent) that provide waste characteristics are maintained at the main facility on-site,
in the control of the EC.

In addition to the implementation of the specific plans, Weiss McNair LLC has
developed the following systems to diminish or eliminate the severity of incidents to both
population and environment. Weiss McNair LLC is committed to personnel, public, and
environment to ensure safety and pollution prevention.
17.1 Training and Annual Drills
All personnel receive initial and periodic instruction in the purpose and
implementation of this Plan and other training outlined in the Weiss McNair LLC
Injury and Illness Prevention and Chemical Hazard Communication Program.
Each new hire employee will be required to read the Emergency Action Plan
information presented in the Health and Safety section of the Employee
Handbook by signing a copy of the Employee Handbook acknowledgement that
will be placed and retained in the company personnel file.
The Emergency Action Plan must be reviewed as part of the monthly department
Safety meetings agenda and an emergency evacuation drill held, at least once
every year.
17.2 Arrangements with Local Hospitals and Authorities.
The local fire department, police, county environmental health, and medical
facilities will receive a copy of this plan, and have been invited to meet with the
EC regarding any concern regarding this plan. A copy of this plan has been
forwarded to agencies identified in the "Notes" column in the Emergency Contact
List, Section 4.0. In the event of a revision of this Plan a copy of the revised plan
must be forwarded to those agencies referenced.
Documentation of agencies not wishing to participate will be maintained on-site.
17.3 Employee Alarm Systems
Scope and Application — see below
General Requirements
• An emergency evacuation alarm announcement can be
activated utilizing the paging feature of the telephone system.
• The emergency evacuation alarm announcement may be
activated, from any telephone in the building, by anyone, at
any time that an emergency incident is identified.

• All employees will be made aware how to initiate an
emergency evacuation alarm announcement using the
telephone system.
The procedure for initiating an emergency evacuation alarm announcement
is as follows:
• When an incident is identified that requires emergency
evacuation of the building, the employee should immediately
proceed to the nearest telephone and initiate the emergency
evacuation alarm announcement by dialing 911.
• Dialing 911 will automatically send the emergency evacuation
alarm announcement over the paging and speaker features of
the system.
Maintenance and Testing
• A test of the system shall be pre -scheduled, pre -announced and
initiated by the Facilities Manager every two months from a
different telephone handset using the following announcement:
➢ "Attention all employees. Attention all employees. The
following sound you hear is a test and only a test of the
emergency evacuation alarm announcement system.
Thank you for your attention to this message".
• Maintenance and Testing are used as a means to initiate corrective
action should there be a failure in the Alarm Systems - refer to tab
XII: Inspection/Corrective Action.
17.4 Emergency Evacuation Procedures
All Employ
• When you hear the emergency evacuation alarm announcement,
whether it is a practice drill or an actual emergency, you should
immediately stop what you are doing and proceed, in a safe but
immediate manner, through the exit door nearest you to the
designated Emergency Evacuation Assembly Area where a
Supervisor or Manager will take roll call to insure that no one
remains in the building.
• Do NOT take the time to turn off or shutdown equipment or tools.
Immediately leave your work area.

17.5 Equipment.
Emergency equipment is available throughout the facility. A sufficient quantity
of personal protective equipment is maintained on-site to respond to most
emergency situations. Emergency equipment includes:

17.6 Vendors.
Weiss McNair LLC maintains agreements with vendors for additional services as
needed.
17.7 Fire Control.
Personnel have met (or shall meet) with the local fire district to determine the best
methods for fire control at the facility. Current fire prevention measures / systems
include:
➢ Access Way
Containers and equipment stored within the facility will maintain an
access way of no less than 24 inches. The distance is required to provide
access of emergency equipment in the event of an emergency.
➢ Fire Suppression
Fire Extinguishers are provided throughout the main facility and
are posted.
17.8 First Aid Kits.
First aid kits are provided at wash stations and at each end of the factory in the
Fabrication and Assembly Departments and at the entrance from the Parts/Service
Department into the Materials Department.
