In cases where the zoning of a property has changed, and/or the permitted uses of a specific zone has been revised, the number of dwellings that have been legally established may no longer conform to the requirements of the current zone. Properties where the total number of dwelling units exceed the number allowed by the zoning are required to have the primary and secondary dwelling units designated by the current property owner(s) requesting reconstruction or expansion of any dwelling units. The property owner’s designation of the dwelling units, as identified in this affidavit, will be used to determine which units are non-conforming to the current zoning, and that may require subsequent discretionary approval if reconstruction or expansion of the non-conforming unit(s) are proposed. This agreement shall be attached to the preceding parcel, and “run with the land” for reference with future development and approval of building permits. This designation will dictate future determinations on legal, non-conforming uses and structures (i.e. third and fourth dwellings) and the need for a Minor Use Permit to expand such uses and structures.
