RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE
APPROVING THE DESIGNATION OF THE DEPARTMENT OF DEVELOP?vffiNT
SERVICES AS THE BOARD OF SUPERVISORS DELEGATED AU1HORITY TO GRANT
EXCEPTIONS TO THE DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL
PROHIBITION ON GRANTING NEW ALCOHOL LICENSES IN AREAS THAT HAVE
UNDUE CONCENTRATIONS OF EXISTING LICENSES
WHEREAS, The State of California has amended section 23958 of the Business
and Professions Code to prohibit the issuance of new alcohol licenses in areas they have
determined to have an undue concentration of licenses; and
WHEREAS, The amended legislation grants authority for the local governing body
or its designee to grant exemptions to this prohibition; and
WHEREAS, the Butte County Department ofDevelopment Services is responsible
for the formulation of land use criteria; and
WHEREAS, the Department of Development Services is responsible for
formulating specific and appropriate uses of land, through the Zoning Ordinance; and
WHEREAS, the Butte County Board of Supervisors finds that the assignment will
continue the efforts to streamline the permitting and regulatory process.
NOW, THEREFORE, BE IT RESOLVED as follows:
The Department of Development Services will, upon the effective date of this resolution, assume
the duties and responsibilities delegated by. the Board of Supervisors to make the necessary
findings to determine whether exemptions are warranted for approval oflicenses when alcoholic
beverage licenses are denied by the Department of Alcoholic Beverage Control because of undue
concentrations of alcoholic beverage licenses.
BE IT FURTHER RESOLVED, that the Department of Development Services will
coordinate its efforts with the Board of Supervisors and other interested Departments to insure
that the best interests of the community are served.
