Grisak 371 Ward Blvd Oroville, CA 95966 Subject: Zoning Verification letter for 340 Ward Blvd, Oroville, California 95966 Dear Mr. Grisak: The above referenced parcel, APN 068-130-026 is currently zoned Very Low Density Residential (VLDR). The County of Butte Zoning Code, Chapter 24, indicates a single family home is a permitted use in the Very Low Density Residential Zone; therefore, replacement of the existing single-family home located at 340 Ward Blvd is possible if damaged or destroyed. In addition, the VLDR zone permits an “Accessory Dwelling Unit”, thus the residence located at 344 Ward Blvd conforms to County Code and may be rebuilt if destroyed. Pursuant to Article 22. Nonconforming Uses and Structures, the structure at 364 Ward Blvd is, “Legal Pre-existing Non-Conforming” (Grandfathered) because it was constructed legally prior to need for building permits and prior to the current Zoning Ordinance. By virtue of present zoning regulations, the two residences (340 and 344 Ward Blvd) conform to the present VLDR zoning. 364 Ward Blvd is considered a “Legal Pre-existing Non-Conforming use” and can be replaced within two years with the original footprint, or expanded with a Minor Use Permit, because it was legally established in compliance with all applicable regulations in effect at the time it was established (built before building permits).
