HomeMy WebLinkAboutLetter to Al-Nasrawi FinalVia Certified Mail – Return Receipt Requested Article No. 7006 2760 0000 1246 5424 July 16, 2015 Saleh Al-Nasrawi 5131 Royal Oaks Drive Oroville, CA 95965 SUBJECT: Proposed Concert Event, Oroville Golf and Entertainment Center – July 31, 2015: 5131 Royal Oaks Dr., Oroville (APN 069-020-016) Dear Mr. Al-Nasrawi: Thank you for taking the time to speak with the Planning Division Manager, Chuck Thistlethwaite and myself on Monday, July 13, 2015. As discussed, the planned event for July 31, 2015 at the Oroville Golf and Event Center, due to its planned size and duration (greater than 100 people), requires approval of an application of a County Festival License to be in compliance with County Code (see BCC Chapter 12, Article III – Festival Permits, attached). However, at this time you will be unable to meet the 90 day lead time required for these types of events. The event license applications are made through the Treasurer/Tax Collector’s Office. The event is different from events ordinarily served by your event center. What differentiates “Leofest Starring Baby Bash” is that is classified as a concert, and is not an accessory use related to the Golf Course, Club House, or Restaurant (See BCC §24-156, attached). In addition, the event is regulated under the Butte County Festival license process because tickets are being sold for admission (See BCC §12-26). In addition, Butte County has a Noise Control ordinance (Chapter 41A of Butte County Code) that specifies maximum noise levels at the property line of surrounding properties and processes for violations of the ordinance. A copy is attached for your information. This letter is to advise you that, if this planned event is conducted, the Department of Development Services will respond to complaints received and a citation may be issued for violation of applicable Butte County codes. For your information, I have included appropriate sections of County Code and an application for a festival license. There is another option which can be found on the page 46 Use Table (Article 7) for your zone (REC). You may also apply for a Commercial Recreation Indoor/Outdoor Use Permit – which would allow for events such as these in the future to take place, this process takes approximately 4-6 months and the fee starts at around $7,000.
