AGENDA REPORT – February 15, 2017
EXECUTIVE SUMMARY:
Pursuant to Butte County Code section 24-56.1, Richard and Julie Neves, have submitted an
application to Butte County in relation to a building permit (B16-2788) for a single family
residence in order to obtain a residential setback determination. The presence of orchards in the
VLDR (Very Low Density Residential) zones to the northwest, southeast and southwest of the
proposed residential dwelling necessitate this hearing in order to make a residential setback
determination. The recommended width of the residential setback is shown on the attached site
plan and measures approximately 175 feet from the SE corner of the property and 182 feet from
the SW corner of the property and approximately 400 feet from the northwest corner of the
property. Non-residential structures may be placed within the setback.

ANALYSIS
To determine the residential setback recommendation, the applicant’s development plans have
been reviewed by the Agricultural Commissioner, in consultation with Development Services.
The Agricultural Commissioner’s office noted: Proposed residence is centered on the parcel
as described on attached site plan, this location provides least amount of impact to adjacent
agriculture. Non-habitable structures may extend into the setback area. Proposed placement
of the building appears to be appropriate. No other conditions or mitigating measures.
The recommended residential setback is approximately 175 feet from the SE side of the
property and 182 feet from the SW side of the property and approximately 400 feet from the
northwest side of the property. Non-residential structures may be placed within the setback.
PUBLIC COMMENTS
Staff had not received any comments at the time this staff report was prepared.
ACTIONS FOR CONSIDERATION
Staff recommends that the Zoning Administrator approve MISC17-0001 (residential setback from
orchards and vineyards for Building Permit B16-2788) with the recommended residential setback
as shown on Attachment C.

determination, located on Guynn Avenue (between 2911 Guynn Avenue and 1024 Henshaw

I. Makes the following findings for a residential setback recommendation as required by Butte
County Code (BCC) section 24-56.1:
A. The applicant’s development plans have been reviewed by the Agricultural Commissioner,
in consultation with Development Services in accordance with the requirements of section
24-56.1 of Butte County Code.
B. The recommended setback between the new residence and existing active orchards will
result in the proposed residence being as far away from the orchard or vineyard as
practicable, taking into account adjacent agricultural uses and practices, and does not limit
the allowed residential density permitted by the VLDR – 1.0 (Very Low Density
Residential – one-acre minimum) zone.
