Dear Mr. Smith: Thank you for the submittal of the above-referenced application on March 25, 2016 to amend Conditional Use Permit (UP09-0003). The proposed amendment would allow for an increase in the number of special events permitted to be held on the property from 12 events per year to 35 events per year, between April and October, for a maximum of 200 people. Planning Staff circulated the application to county departments and State agencies for review and comment, and to determine if the application include all the details needed to complete an accurate environmental assessment. As a result of this review, the above referenced project was deemed complete on May 4, 2016. Completeness of an application indicates that it is ready for additional processing. Following the preliminary application review and the determination of having a complete application, an initial environmental review will be performed, pursuant to the California Environmental Quality Act (CEQA). The initial environmental review of the proposed project is anticipated to be completed within the next 30 days, and will be used to evaluate whether the proposed project will have any significant effects to the environment. Comments and conditions had been provided by the Interdepartmental Review Committee at its meeting held on May 4, 2016, and are listed below or enclosed. Please review these conditions. If you have any questions regarding any specific comment or condition, please contact the appropriate department to discuss the matter further. 1. Event Management Plan. Condition No. 16 of UP09-0003 and Butte County Code §24-175.2 [Special Event Facilities] requires that a Traffic and Circulation Management Plan to be provided. The plan must describe how traffic and parking is managed at the facility, and include the following details: 1. The primary access to the facility and whether the access conforms to County improvement standards, as determined by the Department of Public Works. 2. The ingress and egress for all emergency vehicles. 3. The event site access connection to the County maintained road, and if it meets the minimum requirements as identified in the County Improvement Standards. 4. The availability of a parking attendant(s) to direct traffic into the facility and towards available parking during the arrival of guests, and directing traffic leaving the facility at the conclusion of the conclusion of the event. 5. The location of all temporary direction signs on the driveway entrance and within parking lots to ensure orderly flow of traffic. And, any temporary directional signs shall be placed prior to all events, with the signs being promptly removed at the conclusion of the event. 2. Avigation Easement Dedication / Acknowledgement of Airport Proximity. The Oroville Municipal Airport is located 1 mile north from the project site, placing your facility within the Airport Land Compatibility Zone C. Approval of the proposed project will be subject to implementing the requirements of the Butte County Land Use Compatibility Plan to ensure airport operations do not affect persons on the project site, or that future land uses on the property do not adversely affect airport and aircraft operations. As a result, Planning is recommending a condition of approval to record an avigation easement dedication with acknowledgement of airport proximity and review of objects greater than 100 feet in height (see attachment). Enclosed are the Public Works Department recommended conditions of approval. The Public Works Department is recommending that Farrer Lane, from Larkin Road to the facility parking areas, to be improved to an RS-8 LD-11 county improvement standard. This improvement standard requires a 20-foot wide travel lane with two 2-foot shoulders and a 4-inch Class 2 aggregate base with a single sealcoat (see attachment). The reviewing authority may consider an exception or modification to any of these standards. A request for exception or modification must be filed in writing and fully state the grounds or facts to support the request. For the reviewing authority to grant the request, there must be special circumstances pertaining to the property, such as condition, topography, size, shape or location that prevents an applicant from meeting these standard. Further, the granting of the exception must not be detrimental to the public welfare or injurious to other properties located within the surrounding zoning districts. Butte County Fire/CalFire is recommending that an emergency plan be added as a condition of approval. The plan includes an evacuation procedure in the event of an emergency, a procedure for isolated medical emergencies, and a procedure for any other type of emergency and training procedures for staff on how to implement the emergency plan. Environmental Health is recommending that annual bacteriological samples be taken from the domestic well used to supply water for sanitation purposes. If water from the well is used for consumption by the public who use the facility, the well would be subject to State public water system requirements, which include appropriate water quality sampling and reporting. Prior to issuance of Building Permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. ___ 2. Establish 100 year floodplain elevations and the lowest floor elevations for any structures. Show on the additional map sheet the elevations (by contours) and the location of an accepted NVGD benchmark and a temporary benchmark on-site. 3. Pay the applicable drainage fees in effect at the time of issuance of Building Permits for the . (The current fee is now $ /acre.) 4. A Construction Storm Water Permit will be required by the State Water Resources Control Board if the project results in a disturbance (including clearing, excavation, filling, and grading) of one or more acres. Construction activities that result in a land disturbance of less than one acre, but which are part of a larger common plan of development, also require a permit. The Permit must be obtained from the State Water Resources Control Board prior to construction. C. General X 1. Pay the applicable County Wide Transportation Impact Fee in effect at the time of issuance of Building Permits.
