HomeMy WebLinkAboutOrdinance 1941l ORDINANCE NO. 1941 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN 11FR-511 (FOOTHILL RECREATIONAL) DISTRICT, PURSUANT TO CHAPTER 24-29. The Board of Supervisors of the County of Butte, State 2 of California, under and pursuant to Chapter 24-29 of the Butte 3 County Code of said County DO ORDAIN as follows; 4 SECTION 1. The hereinafter described area situated in 6 the County of Butte, State of California, shall be and it is 6 hereoy zoned as an 11FR-511 (Foothill Recreational-5 acre parcel) 7 District, and such area shall be subject to the restrictions and 8 restricted uses and regulations hereinafter specified and provided. 9 Said area so zoned being located in the unincorporated 10 area of Butte County, northeast of Chico, more particularly 11 descrioed as follows: 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 All that portion of Sections 2 and 3 of T21N R2E, r1DB&11 located north of the top of the bluff of Butte Creek Canyon. That portion of Sections 4 and 5 of T21N, R2E, MJ)B&M located north and east of Skyway, except- ing therefrom that portion of Section 5 located north of Butte Creek and south of Edgar Slough, and also excepting therefrom that portion of Sec- tion 4 located south of the top of the Bluff line of Butte Creek Canyon and east of Lot 1 of that parcel map of record recorded in Map Book 52 on Page 30 of the Butte County Recorder. That portion of Sec. 2,, T22N, R2E, 1'1DB&11 located south of Humbug Road. That portion of Sec. 25, T22N, R2E, r1DB&11 located east of Humoug Road, excepting therefrom that portion of the easterly 1856 ft. of said Sec. 25 located south of the top of the Bluff line of Butte Creek Canyon. REGULATIONS FOR A 11FR-S 11 DISTRICT: The following regulations shal_l apply in a "FR-5 11 S ,-"o-c, , , ~ _, •• ~·· •-s, ,-• , • District. (A) USES PE RMI TED: 1. Single-family dwellings, including mobile homes. 2. Agricultural uses: a. Keeping and raising small animals for domestic use, including dogs, cats, and household pets, poultry and other birds, bees, fish, worms, and frogs. b. Keeping, raising, aJ1d pasturing of live- stock provided that the following lot or parcel areas shall be required for each animal raised or kept on the premises: 1. For each horse or head of cattle over one (1) year of age--eight thousand one hundred twenty-five (S, 12 5) square feet. 2. For each head of swine over ten (10) ·weeks of age --eight thousand one hlu1dred twenty-five (8,125) square feet. 3. For each head of sheep or goats--two thousaJ1d (2,000) square feet. c. Raising and harvesting trees, fruit, grain., flo1·rer s, herbs, and other plan ts and f oocl. crops. d. Protection of land and forests from fire, erosion, floods, slides, quakes, insects, diseases, and pollution, including arboretums and natural, ex- perimental and study areas. 5, Pedestrian, equestrian, and bicycle trails. 6. Agricultural and forestry experimental areas. 7. Home occupations: a. Sale of arts and crafts, goods, and services produced on the premises. b. All home occupations shall be subject to the following conditions: 1. Home occupations are considered to be accessory to the residential use and are permitted only when the proprietor resides on the premises. 2. Not more than one (1) employee or assistant may be engaged for work or service on the premises in connection with such uses. 3. Advertising displays shall be limited to one tu1lighted sign of not more than six (6) square feet of display area. Accessory uses and buildings customary and pertinent tci"'"perrilitfii"d uses, "iriclliding g1iest houses, hBrns; shops, garages, and storage areas. (B) THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT IN EACH CASE. 1. Home occupations, mining, and excavating which might be objectionable because of noise, odor, smoke, dust, bright light, vibration, pollution, traffic congestion, unsightly storage areas, mater- ials or equipment, the handling of explosives or dangerous materials, or the storage of one hundred (100) or more galons of inflammable fluids. 2. Commercial kennels and animal hospitals on sites not less than five (5) acres. 3. Private or commercial outdoor recreational facili- ties on sites not less than five (5) acres, in- cluding but not limited to golf courses, recreation- a 1 clubs, riding academies and st ables, hunting lodges and camps, boat ramps, and campgrounds. 4. Public and quasi-public uses including schools, parks, museums, meeting halls, libraries, and government offices. -6 - l 2 3 4 6 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 (C) Lot Area: 1Iinimum. required area for .. a lot per resid.e:ritial. dwelling unit shall not be less than five (5) acres for "FR-S't, (D) Lot Width: Minimum required lot width shall not be less than two hundred twenty (2 2 0) feet, except ·when adj oini!1g a major road or creek, the minimum frontage shall not be less than three hundred (300) feet. (E) Front Yard: Minimum front yard shall be fifty (50) feet from the centerline of the road, except w;iere the road is classified by the county as a Federal Aid Secondary Road, the minimum building setback requirement shall be fifty-five (55) feet from the centerline of said road. (F) Side Yard: Minimum required side building setback shall be not less than ten (10) feet :for 11FR-Srt. (G) Rear Yard: Minimum required rear building setback shall be not less than ten (10) feet for 11FR-5 11 • SECTION 3. All uses of land within the district not 23 specifically authorized and permitted are prohibited. 24 SECTION .4.
