Subject: Heavy Equipment Storage
APN: 040-550-009 and 010
Dave Day came in to discuss his heavy equipment storage on 040-550-009 (portion) and 040-550-010.
He brought in photos (dated 8/2012) showing the three heavy equipment on the property. This predated the
current code which regulates the number of heavy equipment storage on the parcel (zoning is VLDR).
Previous zoning was A-5. The actual storage of the three heavy equipment is considered a legal
nonconforming use and therefore he is allowed to have the three without an administrative permit.
The use of the heavy equipment is subject to the current standards under section 24-173.1 E. He did
mention that he does use the water truck during emergency situations (fires) and may need to leave earlier
than 6:00/8:00 am and return later than 6:00 pm. If associated with emergency situations, the county will
work with the owner.
As long as the legal nonconforming uses (2 of the heavy equipment - 1 is allowed by right) are not
abandoned for more than a year, he can continue to have the three.
