Box 359 Durham, CA 95938 Subject: Heavy Equipment Storage on 3909 Adobe Lane, Butte Valley (APN: 041-400-056) Dear Mr. Slightom On September 10, 2013, the Butte County Board of Supervisors adopted amendments to the Butte County Zoning Ordinance that became effective on October 11, 2013, whichaffect your property referenced above. Specifically, the Board adopted Section 24-172.2 –HeavyEquipment Storage in the RCR (Rural Country Residential) and FCR (Foothill Country Residential) Zones, and Article 6. Residential Zones, including a new RCR zone for several areas in the Butte Valley area including your property (enclosures). Prior code enforcement investigations regarding the heavy equipment storage taking place on your property determined that you were in compliance with the then applicable RR (Rural Residential) zone. The new RCR zone places greater restrictions on the storage of heavy equipment on your property. Pursuant to Section 24-173.2 (D) (1), only up to two pieces of heavy equipment may be stored in conjunction with a primary residence on parcels less than or equal to 10-acres in size. Heavy Equipment Storage is defined as:Definition. Heavy Equipment Storage as it applies to the RCR and FCR zones includes the storage ofall heavy equipment such as graders, excavators, bulldozers, backhoes and similar equipment;heavyvehicles such as dump trucks, semi-tractor trailers, and similar vehicles. Configurations are defined asfollows:One piece of heavy equipment may be configured as one truck without a trailer, one truck and asingle trailer (loaded or unloaded), or one truck and two trailers (loaded or unloaded).If heavy equipment that is intended for transportation on a trailer (s) is in an unloadedconfiguration (e.g., a backhoe parked on the ground), it is still counted as one piece along with itsrelated truck and trailer (s). Upon the adoption of the new zoning ordinance amendments on September 10, 2013, you have up to1-year to comply with the new requirements concerning heavy equipment storage. If you would like to continue the storage of the extra heavy equipment in excess of two pieces after the conclusion of the 1-year amortization period, you must apply for and receive approval of a minor use permit. This application is submitted to the Department of Development Services and is considered for approval by the Zoning Administrator. The Zoning Administrator may refer the Minor Use Permit to the Planning Commission, or it may be appealed to the Planning Commission and ultimately the Board of Supervisors. Additionally, the Board adopted standards that apply to all heavy equipment storage uses in the RCR zone. Please review these standards carefully and ensure that your use complies. For instance, one of these standards, standard #3,requires that all heavy equipment vehicles be screened from direct view from any adjacent public or private right-of-way or private easement through vegetation, or approved fencing/walls or other approved means.
