Subject: Incomplete Application – Saetern Tentative Parcel Map (TPM14-0009); APN: 025-340-038.
Dear Ms. Saetern:
Thank you for the submittal of the above-referenced application. The application has been reviewed by County departments to determine if the application is complete and contains the
information necessary to process the request. Upon review, the application has been deemed
to be incomplete at this time. Specifically, the following additional information and revisions are required before the application can be deemed complete:
Designated Remainder. The Designated Reminder identified on the tentative map must be revised to become Parcel 5. Pursuant to the Subdivision Map Act, the ‘Designated Remainder’ is not considered a parcel for the purpose of sale, lease, and finance. Further, the small size of
the parcel prevents further subdivision of the lot, which was determined to be contrary to the purpose of the Designated Remainder provisions of the Subdivision Map Act.
Agricultural Commissioner Review. Please contact the Butte County Agricultural
Commissioner to obtain their clearance of the proposed tentative map application. The Agricultural Commissioner’s review is needed to determine the extent of an Agricultural Buffer
that is required to be established from the adjacent agriculturally-zoned property, located west of
the subject property. The fee amount is determined by the Agricultural Commissioner at the time the applicant contacts the main office located at 316 Nelson Avenue, Oroville 95965. Phone No.

Agricultural Buffer. Article 17 of the Butte County Zoning Ordinance establishes a 300-foot buffer between lands zoned agriculture and new residential development. This ordinance
applies to new parcels where residential structures are to be developed in the following areas of
the county: (1) all lands zoned Agriculture; (2) in other zones within 300 feet of the boundary of Agriculture zones; (3) areas inside and within 300 feet of sphere of influence boundaries for
incorporated cities, where the boundary abuts parcels zoned Agriculture; and, (4) areas within 300 feet of a Williamson Act Contract. Exceptions to the 300-foot agricultural buffer setback requirement may be requested by the project applicant through the Agricultural Commissioner’s
Office and their application review process. Please delineate the Agricultural Buffer on the tentative map based on the results of the Agricultural Commissioner’s review.
Seasonal Drainage Buffer. Based on the recommendations provided by Gallaway Enterprises,
a 25-ft. wide riparian buffer on both sides of the seasonal drainages located on the subject property is recommended. Please delineate and note the riparian buffers on the tentative map.

This project will remain in an incomplete status until such time as the requested information/revisions are submitted to our department and reviewed for adequacy. No further
processing of this project will occur until such time as the required materials are received. Once
these materials have been submitted, our department will perform an initial application review for completeness within 30 days as well as refer the application to any public agency that may have
an interest in the proposed project. If additional information is required, you and your designated agent will be contacted.
