Butte County Code Article 20. Signs
Subject: 55’ Sign “V” configuration located off two lane frontage road (Entler Avenue)
and four lane Highway 99.
Background:
Stott Outdoor Advertising proposes a 55’ “V” configuration sign at APN: 040-400-034. It is
the determination of Planning staff that although the initial interpretation of County Code on
this matter limited the effective height of the sign to 35’ – because it fronted on a two lane
road per footnote (2) Table 24-105-1 – further consideration on this matter, as discussed
below, permits a 55’ high sign.
Zoning Section:
Butte County Code Section Article 20. Signs. Initial interpretation of the code through
footnote (2) Table 24-105-1: 35-feet for two-lane roads (1 lane in each direction), mandated
a 35’ height limit for proposed sign.
Analysis:
Even though the proposed sign is located off of two lane Entler Avenue, there is no private
property in intervening space between Entler (frontage road) and four lane Highway 99. In
effect, there are six lanes of traffic fronting the sign.
Resolution:
When it is determined by staff that there are no privately held parcels between a two lane
frontage road and a four lane highway – the maximum height for Off-Site and Off-Site Digital
shall be 55’.
